Introducing the special issue on ‘Families, Foreignness and Migration. Now and Then’, this essay starts from the observation that in Western Europe migrating with or without one's family in the last century was increasingly shaped by state policies. As a result, migrants' identities and family experiences not only depended, and still depend, on their cultural backgrounds but also on very time-specific politics of foreignness and citizenship. The essay's main argument is that comparing and deconstructing perceptions, policies and practices of ‘family’ and migration help to overcome the limited attention given to age and kin in the study of gender and migration. From an overview of contributions to this interdisciplinary issue, it is clear that deconstructing ‘family’ in migration studies should be developed further along three axes: child migration, the multi-level analysis of family and migration, including societies of origin and migrant organizations, and the comparison of ‘visible’ and ‘invisible’ migrants, which contributes to uncovering the relationship between foreignness, gender and age.  相似文献

Abstract

This article explores the effect of a prison sentence on an inmate's female partner, with particular reference to the impact on ‘older’ women. Drawing on the findings of an empirical qualitative research study and the existing literature, this article considers the gender role changes prompted by imprisonment, and the strategies utilized by women in coping with consequent strain. The gendered nature of the impact of imprisonment is explored, and the article concludes by drawing on multidisciplinary feminist perspectives in criminology and family studies to assess the centrality of institutionalized ‘traditional’ expectations of appropriate women's behavior to women's experiences of, and responses to, male imprisonment.  相似文献

Feminist studies of the European Union seek to make sense of a field that has become enormously complex. Gender equality has been an issue in the EU since the inclusion of Article 119 on equal pay in the Treaty of Rome 1957 but has since widened to the recognition of equality between women and men as a fundamental principle of democracy for the whole EU. Gender equality is present both in gender-specific policies, such as women's participation in the labour market, sexual harassment and reconciliation of work and family, as well as informing the basic principles and functioning of the EU institutions wherever gender mainstreaming is implemented. Feminist explorations of the EU have tended to overlook one aspect of EU gender policies: women's political representation in the EU institutions. This article seeks to address this gap.  相似文献

The present research used a mock juror experiment (N = 360) to assess two primary goals: (1) to examine the direct and indirect effects of participant gender, stalking myth acceptance, and gender role stereotyping on guilt ratings in a stalking trial; and (2) to examine the role of perceived victim fear and distress, and defendant intended danger on perceptions of a stalking trial. Using structural equation modeling, we found an indirect effect of participant gender, and both direct and indirect effects of stalking myth acceptance and gender role stereotyping on guilt ratings. Men and participants who endorsed more traditional gender role stereotypes were associated with adherence to stalking myth acceptance beliefs. Endorsement of particular stalking myth acceptance beliefs offers a partial explanation for why women and men differed on perceptions of the defendant's intent to cause danger and the victim's perceived fear and distress. Results provide insight into the efficacy of current anti-stalking legislation that relies on a juror's capacity to evaluate an ‘objective’ interpretation (i.e., ‘reasonable person’) standard of fear for intimate partner stalking.  相似文献

This study explores the relationship between the actual division of housework and men’s and women’s perceived fairness in this regard. The central question is how the actual sharing of housework influences the perceptions of fairness in the division of housework. It is hypothesised that the perceptions of fairness differ between policy models. In countries where gender equality has been more present on the political agenda and dual-earner policies have been introduced, people are expected to be more sensitive to an unfair sharing or division of housework. By analysing the relationship between actual division of housework and perceptions of fairness in household work for 22 countries representing different family policy models, the study takes on a comparative perspective with the purpose of analysing the normative impact of policy. The analysis draws on data from the 2002 round of the International Social Survey Programme on family and changing gender roles. The results show that in countries that have promoted gender equality through the introduction of policies with an aim to promote dual roles in work and family, both women and men are more sensitive to an unfair division of household labour. The difference between perceptions in the different policy models is greater among men than among women, indicating that a politicization of the dual-earner family is more important for men’s equity perceptions than women’s.  相似文献

The socialist state run modernization produced low fertility throughout Eastern Europe. Fertility rates started falling soon after the end of the Second World War quickly reaching below replacement levels in many areas. This article examines the state responses to the falling fertility as well as birth control practices that individuals relied on in order to maintain small families. After outlining some common features of population policies under the state socialism, the article focuses on family planning policies in Yugoslavia. It is argued that liberal population policy and uninterrupted liberal abortion legislation in Yugoslavia, resulted, among other reasons, from the communist leadership's commitment to national and gender equality, respectively. It is further argued that gender hierarchy within the marriage and family remained almost untouched by the socialist project of women's emancipation and that these hierarchical gender relations shaped birth control practices in specific ways.  相似文献

This article focuses on a specific aspect of the history of crime: co-offending (offending with one or more accomplices) in a family setting at the end of the nineteenth century. The aims of this article are to analyze how genders interacted in a criminal setting and to show a possible bias in the court's decision to prosecute ‘criminal families’, either in relation to the people involved or to the environment in which the crime was committed. This article also questions the relevance of the concept of the civilizing mission in a court setting towards ‘criminal families’ and compares it with the reality of the court's work. The study is based on the archives of Amsterdam's Arrondissementsgerecht between 1897 and 1902. This court was in charge of trying criminal offences committed in Amsterdam and its surrounding area (a semi-urban environment within a 25-kilometre radius) according to the 1886 Dutch code of laws. Urban and semi-urban co-offending criminal rates in Amsterdam and its surrounding area are compared, as well as gender patterns and class origins in relation to the crimes committed, in order to highlight a possible prejudice towards working-class offenders. The analysis reveals a high rate of co-offending in female criminality and more gender interactions in the urban environment. However, the results also show that, despite a general anxiety towards working-class families and rising crime rates, magistrates were not more inclined to prosecute them. The family situation was taken into account before trials, and semi-urban families were not treated more leniently than urban families.  相似文献

Public attitudes towards sex offenders are believed to play a key role in the development of legislation and public policy designed to manage the risks posed by known sex offenders who live in the community. There have, however, been few previous attempts to validate methods by which public attitudes can be measured. The current study aims to address this issue by establishing the factor structure of the Community Attitudes Towards Sex Offenders (CATSO) scale with an Australian community sample and examine the extent to which demographic variables and support for sex offender management policies influence these attitudes. A sample of 552 participants recruited through online social media sites completed the CATSO as well as a number of items developed by the researchers designed to assess individuals' support for specific sex offender policies. Results of an exploratory factor analysis suggested the presence of four distinct factors which were labelled ‘social tendencies’, ‘treatment and punishment’, ‘crime characteristics’ and ‘sexual behaviour’. Individuals with higher levels of educational attainment rated sex offenders less negatively than those with lower educational attainment, while those who reported being supportive of community notification reported more negative attitudes towards sex offenders.  相似文献

The critical challenges of AIDS and poverty in post-apartheid South Africa impact the ways in which memories are articulated and family and fertility histories ultimately constructed. This article considers three life histories written in the course of ethnographic work on women's childbearing conducted intermittently between 1998 and 2014, and typical of other histories in the same peri-urban locale. Personal accounts of a mother and her two daughters initially centre on domestic strife and adversity – and the family as a whole is represented as struggling and disunited. In the aftermath of the death of one of the daughters from AIDS in 2001, the memories and discourse are subtly reworked by the two women in ways that are meant to counteract stigma, reclaim dignity and defend the family. The paper focuses on reproductive dynamics and memory-making in a hardship-driven and AIDS-affected setting and on the ethnographer's endeavours in witnessing, interviewing and making sense of people's ‘intent’ and ‘the urge to forget, to go on living’.  相似文献

Over the years, in the case‐law of the European Court of Justice (ECJ) determining the availability of family reunification rights for migrant Member State nationals, the pendulum has swung back and forth, from a ‘moderate approach’ in cases such as Morson and Jhanjan (1982) and Akrich (2003), towards a more ‘liberal approach’ in cases such as Carpenter (2002) and Jia (2007). Under the Court's ‘moderate approach’, family reunification rights in the context of the Community's internal market policy are only granted in situations where this is necessary for enabling a Member State national to move between Member States in the process of exercising one of the economic fundamental freedoms; in other words, where there is a sufficient link between the exercise of one of those freedoms and the need to grant family reunification rights under EC law. Conversely, under the Court's ‘liberal approach’, in order for family reunification rights to be bestowed by EC law, it suffices that the situation involves the exercise of one of the market freedoms and that the claimants have a familial link which is covered by Community law; in other words, there is no need to illustrate that there is a link between the grant of such rights and the furtherance of the Community's aim of establishing an internal market. The recent judgments of the ECJ in Eind and Metock (and its order in Sahin) appear to have decidedly moved the pendulum towards the ‘liberal approach’ side. In this article, it will be explained that the fact that the EU is aspiring to be not only a supranational organisation with a successful and smoothly functioning market but also a polity, the citizens of which enjoy a number of basic rights which form the core of a meaningful status of Union citizenship, is the major driving force behind this move. In particular, the move towards a wholehearted adoption of the ‘liberal approach’ seems to have been fuelled by a desire, on the part of the Court, to respond to a number of problems arising from its ‘moderate approach’ and which appear to be an anomaly in a citizens' Europe. These are: a) the incongruity caused between the (new) aim of the Community of creating a meaningful status of Union citizenship and the treatment of Union citizens (under the Court's ‘moderate approach’) as mere factors of production; and b) the emergence of reverse discrimination. The article will conclude with an explanation of why the adoption of the Court's liberal approach does not appear to be a proper solution to these problems.  相似文献

This article examines the formulation, application, and effects of Article 31 of Law 14.394, which introduced absolute divorce into Argentina, albeit briefly: the law was passed in December 1954 and ‘suspended’ in March 1956. Our study sheds light on the juridical dimension of a topic that has not been considered to date. We present the results of our research in two parts. The first part analyzes the text of the law and the debates around it in Argentina's Congress. The second part provides an overview of divorce sentences and then considers certain exceptional cases. The specific features of the debates and sentences considered here provide a more complex vision of Juan Domingo Perón's government's definitions of the ‘new family.’  相似文献

In this paper, we will investigate the popularity of marriage migration between Turkish communities in Western Europe and emigration regions in Turkey. Our focus here is specifically on the Belgian case, namely the ‘Emirdag connection’. In Belgium, the majority of immigrants with a Turkish background come from the region of Emirdag, in the province of Afyon. On the basis of quantitative research methodologies, we first consider the magnitude of the phenomenon and the socio-economic situation of those involved. Using the qualitative research techniques of participant observation and in-depth interviews, we analyze the mechanisms in an attempt to explain marriage migration between these regions. Why do so many young people, born and raised in Western Europe, opt for an unknown partner from a region that is largely unknown to them but which proves to be their parents', or even grandparents', region of origin? Why does migration remain such a valuable life project for many young people in these regions of origin, despite the real danger of many negative side effects? The popularity of marriage migration is often explained by its role in making migration possible. However, migration theories alone cannot explain this phenomenon. Here we will argue that the existence of a ‘culture of migration’ that binds the region of origin with the region of destination and in which ‘the family’ as an institution is capable of building a bridge between traditional praxis, as well as the challenges linked to international migration, are crucial for understanding the enduring popularity of marriage migration.  相似文献

Abstract

The sporting culture, with omnipotent coaches, fierce competition for recognition and funding, and ‘win at all costs’ ethos, creates an environment conducive to sexual exploitation of athletes. Recent increased public awareness and the development of child protection policies in sport have led to the questioning of previously accepted coach-athlete relationships. This study is an exploratory investigation into male swimming coaches' perceptions of appropriateness of coach-athlete sexual relationships. Sexual relationships with athletes under the age of 16 were unanimously considered totally inappropriate. With regard to sexual relationships with athletes above the age of consent, opinions ranged from ‘totally inappropriate’ to ‘it’s a question of civil liberties.' These results are discussed in relation to how coaches have adapted their own behaviours in the face of public scrutiny but are still reluctant to restrict the rights of their fellow coaches.  相似文献

Susan Okin criticizes John Rawls’s ‘political liberalism’ because it does not apply principles of justice directly to gender relations within households. We explain how one can be a ‘political liberal feminist’ by distinguishing between two kinds of justice: the first we call ‘legitimacy justice’, conceptions of which apply to the ‘legally coercive structure’ of society; the second we call ‘ethos justice’, conceptions of which apply to citizens’ ‘non-coercive’ relations. We agree with Okin that a society in which most persons act in accordance with ‘gender equal’ ethos justice is morally superior to one in which most persons do not. A shared commitment to a particular conception of ethos justice, however, cannot be required by a conception of legitimacy justice. A political liberal feminist is committed to promoting gender equality with respect to both legitimacy justice and ethos justice, but recognizes that different means are necessary to do so.  相似文献

To clarify the rules in a stem family, this study investigates the patterns of childrens' departures from home, using the 1870 household register of South-Tama, Musashi Province (4,787 individuals). Sons and daughters followed a schedule for home departures in their life course related to their sex and to sibling composition. Life-table analysis revealed that the ‘stayers’ were children without siblings, eldest sons, and eldest daughters with only sister; while the ‘leavers’ were younger sons with elder brothers and younger daughters. This pattern was present regardless of economic status, with some variation in the speed of leaving home among sons. The leavers in general left for various destinations via marriage, adoption, service, and work migration. Larger proportions of sons than daughters remained in the home village. Examination of the exceptions to the rule showed that they tended to be incapable of following the main pattern. Analysis of the timing of a child's departure in relation to the heir's marriage or to the birth of the heir's first child revealed that within the standard schedule, sons and daughters were retained or released for the advantage of the family. Sisters were replaced by in-marrying brides. Brothers were kept in the home until the next generation was secured. The departure of children, or heirs and non-heirs, can be a good variable for comparing the rules of family systems.  相似文献

As a professional, a lawyer's first duty is to serve the client's best interests, before simple monetary gain. In criminal defence work, this duty has been questioned in the debate about the causes of growth in legal aid spending: is it driven by lawyers (suppliers) inducing unnecessary demand for their services or are they merely responding to increased demand? Research reported here found clear evidence of a change in the handling of cases in response to new payment structures, though in ways unexpected by the policy's proponents. The paper develops the concept of ‘ethical indeterminacy’ as a way of understanding how defence lawyers seek to reconcile the interests of commerce and clients. Ethical indeterminacy suggests that where different courses of action could each be said to benefit the client, the lawyer will tend to advise the client to decide in the lawyer's own interests. Ethical indeterminacy is mediated by a range of competing conceptions of ‘quality’ and ‘need’. The paper goes on to question the very distinction between ‘supply’ and ‘demand’ in the provision of legal services.  相似文献

This paper examines a controversy that erupted in the 1860s over attempts by European settlers in the colony of Natal to regulate African marriages. In 1869 the Natal government promulgated a law enabling the Lieutenant-Governor of Natal to regulate African marital customs. The regulations proclaimed under Law 1 of 1869 imposed a tax on every marriage contracted by Africans, restricted the practice of lobola (bridewealth) and required that brides publicly express their assent before an official witness for marriages to be valid. The implementation of these measures unleashed a storm of protest that eventually forced the government to abandon the marriage tax in 1875. Intriguingly, however, while there was African resistance to the law, it was principally the outrage of the colony's European settlers and missionaries that forced the government's hand. This paper explores the creation and implementation of Law 1 of 1869, the subsequent controversy and the abandonment of the marriage tax. In doing so it argues that in the 1860s and 1870s few white Natalians embraced the idea of innate differences between races, and instead employed environmentalist discourses of ‘civilisation’ and ‘savagery’ to explain distinctions between themselves and Africans. These discourses were gendered, for domestic family arrangements in African and European societies were used as the benchmark against which the relative levels of ‘civilisation’ of whites and Africans were measured. This attempt to regulate African family life and the controversy it provoked therefore highlights the extent to which British views of marriage and proper gender roles influenced the practice of colonialism in nineteenth century southern Africa.  相似文献

This article considers the much‐criticized ‘right to be forgotten’ in the context of the European Court of Justice's judgment in the Google Spain case. It defends the ‘right to be forgotten’ as a metaphor that can provide us with a better understanding of the particular privacy concerns of the search‐engine age and their interaction with the freedom to access information, and draws on Goffman's idea of ‘information games’ and Nissenbaum's theory of ‘contextual integrity’. While supporting the principles that underpin the judgment, the article rejects the Court's binary approach of ‘forgetting’ versus ‘remembering’ personal information. Instead, it argues that the EU legislator should introduce more nuanced means of addressing modern privacy concerns. By establishing two remedies – ‘delisting’ or ‘reordering’, depending on the nature of the information – online information flows can be adjusted to preserve both the right to privacy and the freedom to access information in more contextually appropriate ways.  相似文献
