ABSTRACT

This article investigates the role of crime scene technicians in the Swedish criminal justice system, and particularly how Swedish crime scene technicians not only examine crime scenes but also facilitate the criminal justice system’s joint production of forensic evidence. It proposes thinking about the criminal justice system as a conglomeration of epistemic cultures, that is, of communities with different ways of producing and understanding forensic evidence. Such a perspective makes it possible to understand interprofessional frictions as epistemic frictions as well as to draw attention to the facilitations, mediations and translations that crime scene technicians perform. This perspective also makes it possible to illuminate how the crime scene technicians’ professionalization – a professionalization from the outside – affects both their future crime scene work and their facilitations.  相似文献

Ideological trends in the criminal policy of the Nordic countries since the 1960s are analysed. Although criminal policy in these countries is not unified, one can argue for the existence of a 'Scandinavian criminal policy' characterized by several common features concerning historical tradition, intensive cooperation and a similar approach to crime prevention and control. The following trends and characteristics are examined in some detail: the cycle from criticism of the treatment ideology to a reappraisal of the role of the criminal justice system and the function of penal sanctions; the differentiation of criminal policy strategies (e.g. social and situational crime prevention, cost-benefit thinking, criminal law policy, sanctions policy). Discernible tendencies towards more unified or, at least, more harmonized criminal policies on the international and European level are also examined. Active participation in this developmental process is encouraged to ensure that the fundamental principles of Scandinavian criminal policy are properly utilized.  相似文献

Most of the studies on crime show that no society is immune from crime and organized crime. Large or small, complex or simple, developed or underdeveloped, every society faces the task of controlling crime and organized crime. Furthermore, recent events reveal that the so‐called ‘'domestic crime'’ has become more globalized, or internationalized. Unless dramatic changes take place, collectively, e.g., by the United Nations, no single nation can expect to control or regulate illegal activities. In particular, crime prevention and criminal justice has been a long standing agenda item of the General Assembly and the Economic and Social Council; the two principal legislative bodies governing the United Nations program of work in the criminal justice field. The Council is, after the Assembly itself, the major legislative and policy‐making organ of the United Nations. The field of criminal justice is an important component of social and economic affair, the Economic and Social Council determines policy and initiates activities. Within the United Nations system, the most direct responsibility for international efforts toward crime prevention and control is borne by the recently created Commission on Crime Prevention and Criminal Justice (which has replaced the expert subsidiary body of the Economic and Social Council, namely, the Committee on Crime Prevention and Control) and the Crime Prevention and Criminal Justice Branch. The establishment of the Commission, by the Economic and Social Council in February 1992, ushered in a new era in United Nations involvement in crime prevention and criminal justice. The commitment of the Member States to the prevention of crime and the promotion of justice through strengthened international cooperation has been clearly spelled out in numerous General Assembly and Economic and Social Council resolutions. Those resolutions are indicative of the Member States’ heightened awareness and concern that crime, in its internationalized form, has to be tackled by a multilateral approach including international cooperative measures, and that interdependent efforts are urgently required. The Commission provides a means by which Governments can be directly involved in the determination and supervision of the program of work of the United Nations in crime prevention and can clearly manifest their political will. Its establishment was the result of a long process of review of the functioning and program of work of the United Nations in crime prevention and criminal justice, and was seen as an indispensable condition of a structural reorganization of United Nations activities in this field. The Asian Journal of Criminology aims to advance the study of criminology and criminal justice in Asia, to promote evidence-based public policy in crime prevention and to promote comparative studies about crime and criminal justice. Asia’s cultural and legal diversity are discussed in the light of the variations in rates of crime, imprisonment and victimisation. Fostering a criminological community in Asia will contribute to improvements in the provision of mutual legal assistance that is now required to combat trans-national crime.  相似文献

This article builds on the work of Barlow and Barlow, who use models based on the long economic cycle as a theoretical and empirical means for reorientating examinations of criminal justice trends. Empirically, using factor-analytic and multivariate logistic and OLS procedures, we find some support for long-cycle-model interpretations of trends in federal criminal justice legislation. Equally important, we find no support for a connection between federal criminal justice legislative trends and levels of crime. Our analysis suggests that economic processes exist independent of economic long cycles and crime trends, and that these also should be considered in discussing trends in crime control. In conclusion, we argue that alternative economically situated, contextualized models which look beyond the crimejustice nexus are needed if criminal justice theory and research are to be revitalized.  相似文献

ABSTRACT

Drawing upon feminist research on women in crime and justice, this study examines patterns of female crime in Israel over four decades and the criminal justice response to female offenders over two decades. The data show that crime patterns of Israeli women and the criminal justice response to their transgressions show remarkable resemblance to those discerned in other western countries. The article concludes that feminist insights and explanatory mechanisms suggested in other western countries are congruent with findings about women in crime and justice in Israel.  相似文献

Abstract

This case study describes the experience of effective and sustainable multi-sector co-operation in the prevention of crime between the Roodekrans Neighbourhood Watch (RNW) in Roodepoort, South Africa, the South African Police Service, private security businesses and the local business sector. This case study is illustrated in the context of empowering communities to take ownership of community safety by facilitating a multi-sector approach. Many studies have highlighted the role of the police in driving crime prevention, however, this paper focuses on the role and contribution of communities themselves as an effective vehicle of crime prevention drawing on multi-sector co-operation. Knowledge regarding best practices in this field of crime prevention remains a work in progress, therefore this paper aims to contribute to the general framework for the growth of successful multi-sector community-based crime prevention initiatives.  相似文献

In addition to the more conventional approaches of the criminal justice system, this article suggests that there is a need for restorative justice as another method of addressing sexual crime. In support of this view, the present article explores the possibility of a hybrid justice system based on a complementary relationship between restorative justice and the criminal justice system. An analysis of the limits of the criminal justice system and the need for restorative justice in the contentious area of sexual crime will be followed by a detailed examination of key justice considerations when trying to marry both criminal justice and restorative justice perspectives. Such considerations include: the meaning of justice; legislation; sentencing principles; due process; victims’ rights; and the location of restorative justice within/alongside/outside the criminal justice system. The aim of this article is to determine whether it is possible to reconcile two seemingly juxtaposed methods of justice delivery in the context of sexual crime in order to create a hybrid system of justice that best protects and responds to the rights and needs of victims and offenders.  相似文献

ABSTRACT

This article explores the propriety of long-term efforts of the South African criminal justice system in combating human trafficking. Though a crime of global dimension, human trafficking has been a reverberating issue of concern to the South African State. Steps have been taken by the State to address this menace, especially from the legal standpoint, and the enlistment of human trafficking among crimes that require an effective criminal justice approach to deal with; yet, the menace has persisted. From a broader doctoral study, using qualitative method, it was discovered (amongst others) that as currently structured, the South African criminal justice system cannot effect a long-term combating strategies against human trafficking. Findings also indicate that the solution to the precipitating factors that fuel the trade in human commodity lies outside the scope and mandate of the criminal justice system. The study further recommends that for an effective response, it is expedient for the State to first address the socio-economic, cultural and political nuances that fuel the trade, rather than mount impracticable pressure on its criminal justice institutions to perform an unrealistic task.  相似文献

作为对我国近年来发生争议的热点案件的一个理论回应,需罚性在犯罪论体系中的功能与定位被提出。我国目前的犯罪论体系均是以应罚性为中心展开的,缺乏对需罚性的判断,从而带来严重的理论与实践困境。犯罪论体系须认真对待刑法体系内的应罚性与刑法体系外的需罚性。从理论上,需罚性就是从刑事政策或宪法上判断有无刑罚处罚的必要性,是以预防的必要性为理论根据架设起刑事政策或宪法与刑法体系之间的桥梁,具有兼顾体系正义与个案正义的合目的性。同时,将需罚性导入我国犯罪论体系具有立法与司法基础,与我国实定法之间具有融贯性。我国应当建构应罚性与需罚性并重的犯罪论体系。  相似文献

This article constitutes an attempt to describe the nature of IT-related crime and how it is likely to evolve in the future. By means of a number of empirical studies, the authors have attempted to estimate the prevalence of a number of different IT-related incidents and offences in Sweden during the period 1997-1998. The article shows that IT-related crime consists to a large extent of less serious offences. One might say that everyday crime has expanded into a new technological environment. Parts of the study nonetheless indicate that there are more serious IT-related offences being committed. In this regard the authors' focus is on offences related to the most valuable commodity in modern society, information. On the basis of the empirical studies, two different developmental patterns are identified; the first of these involves everything carrying on much the same as before, with no real evidence of any radical shift taking place; the second involves society going through a period of relatively comprehensive structural and technological change, which in turn is creating new and dangerous opportunity structures for crime.  相似文献

Spatial variation in crime rates generally has been attributed to differences in culture, economic status, and the social organization of communities. Rarely have policies and practices of criminal justice professionals been examined as causes of this variation. If these policies and practices do place citizens at a higher risk of victimization, a sense of fairness requires that all communities in a region share equally in this increase. This article examines the spatial justice resulting from sentencing practices in Pennsylvania. It demonstrates that certain locations in Philadelphia bear an unequal burden because of these practices. The relatively high crime rates of these areas are due partly to decisions made by criminal justice professionals.  相似文献

In this introduction to this special issue of the Asian Journal of Criminology, we pay special attention to public participation and involvement in the criminal justice system in Asia. Public support, participation, and involvement in various forms are crucial to normal functioning and effectiveness of the criminal justice system. Given the centralized and often non-democratic nature of the legal system in many Asian nations, studies in this field have lagged behind their Western counterparts. Based on empirical and theoretical studies from China, India, Japan, Macao, and South Korea, papers in this special issue address several key aspects of public participation and involvement in these Asian nations and regions, including the public’s role in crime reduction and prevention, the public’s fear of crime, the public’s involvement with the police in dealing with juvenile delinquencies, the police’s perception of civilian oversight of police work, public opinion on criminal trial procedures, and a comprehensive crime prevention strategy.  相似文献

ABSTRACT

This paper addresses criminal justice responses that came on the heels of a traumatic sexual assault in public space in India. The incident referred to as “Nirbhaya,” drew attention to the nation as well as the world the violence against women who on the one hand find themselves in public spaces designed for all denizens in this globalised world, yet, subject to sexploitation and devoid of safeguards and equal protection. In this paper we catalogue modifications to Indian criminal justice as a result of the Nirbhaya case to illustrate how extreme events help drive changes to the system in a large democracy, yet an economically developing one. More specifically, we address changes that have been incorporated in criminal laws, police procedures, and crime prevention efforts, as well as assess the degree to which these efforts have been effective.  相似文献

Macao has the world’s largest casino industry and represents a unique political, social, and cultural system that differs significantly from Western societies. The overall crime rate in Macao is relatively low. Scholarly knowledge about crime and crime prevention in Macao, however, is very limited. This paper first reviews crime prevention theories, typologies, and various strategies in Western societies, followed by an introduction and discussion of crime prevention practices in Macao. Crime prevention strategies in Macao may be characterized as a tripod structure with three major supporting legs: traditional criminal justice practices, social prevention beyond the criminal justice system, and situational crime prevention measures. The paper then discusses the factors that may contribute to the low level of crime in Macao and points out the direction for future research in Macao.  相似文献

The purpose of the study is to evaluate and compare the efficiency of crime control and crime prevention programs. The focus on efficiency adds knowledge about quality of performance in criminal justice programs. The case study covers twelve-year implementation process of two juvenile justice programs in a local law enforcement agency. A Truancy Reduction Program (TRP) represents the crime control approach. A School Resource Officer Program (SROP) represents the crime prevention approach. The evaluation shows that the SROP produced far more efficient results than the TRP. The SROP demonstrates gradual improvement and efficient implementation. The TRP appears inefficient and, therefore, should have been revised in the midst of the implementation period. The study draws policy implications for designing more efficient crime control and crime prevention programs. The implications can be useful for law enforcement agencies that contemplate or implement such programs  相似文献

Three interacting factors appear to significantly affect our treatment of youths and thus our juvenile justice policy: ideology, the media, and politics. As a result of these factors, although juvenile violent crime is decreasing, legislatures still advocate a harsh, punitive stance toward youthful offenders. Legislative initiatives have resulted in determinate sentencing for juveniles, more youths handled by the adult criminal court, and more youths sentenced to adult institutions. Recent evidence suggests that the public supports more prevention and early intervention strategies for youths and favors rehabilitation rather than punishment. These conflicting trends suggest that we are at a crossroads: the juvenile justice system can continue its harsh, reactive stance, or it can choose a more proactive approach. The members of the Academy of Criminal Justice Sciences have an opportunity to play an active role in the development of criminal justice policy.  相似文献
