主动型侦查包括监控型侦查和诱导型侦查两种形式,由于主动出击性质的行政措施在侦查中的使用以及犯罪情况的新变化,采用主动型侦查是正当的和合理的。当前对主动型侦查存在许多认识上的误区,因此,有必要在适用的案件范围、适用的实质要件、适用的对象范围等方面,制定主动型侦查合法性的认定标准。     

网络侵财犯罪数据驱动型侦查模式研究

网络的发展,在便利人们生活的同时,也为犯罪的滋生提供了土壤,网络犯罪以网络侵财犯罪为突出表现。网络侵财犯罪具有严重的社会危害性,刑事侦查工作亟需予以重视。从侦查模式的角度观之,则发现网络侵财犯罪在考验着侦查模式的适应性。网络侵财犯罪侦查工作中,传统侦查模式存在着侦查运行依赖人力投入、侦查决策倚重工作经验、侦查破案口供依赖性强这三个方面的局限。在大数据的时代背景下,侦查人员利用大数据积极寻求网络侵财犯罪侦查工作因应之道,则促使侦查模式演变为数据驱动型侦查模式。网络侵财犯罪数据驱动型侦查模式有着成熟的理论基础与迫切的现实需要。在网络侵财犯罪侦查工作中,数据驱动型侦查模式的适用表现为侦查思维指引下特定的侦查方法。     

认识“侦查事实”与证明“侦查事实”之甄别——“历史真相”隐喻对确立“回应型侦查模式”理论基址的启示

我国理论界有回应型侦查模式与主动型侦查模式的论断,但长期以来对两种模式的具体内涵,特别是其理论基址却鲜有研究。与历史调查中搜集史料证据以建构＂历史真相＂的路线相一致,回应型侦查的行为逻辑是认识与证明案件这一＂历史真相＂,它表征了＂侦查事实＂的向度、宽度、精度和容度。在回应型侦查活动中,认识＂侦查事实＂和证明＂侦查事实＂是一对既具有相合点、又具有不合点的问题,历史哲学的理论范式为辨析其中的不合点提供了一种方法和工具。研究回应型侦查模式的理论基址有助于侦查学理论本体性的重构。     

论数据思维在侦控网络传销犯罪中的应用

新型网络传销犯罪可以依据是否存在产品分为“新零售”和金融传销两种模式,并呈现出宣传联网、经营联网和发展会员联网三种特质,对传统侦查范式提出挑战。遵循数据思维的前置型、关联型、主动型、服务型的应用逻辑,有助于在网络传销案件中从强化数据共享、破除信息壁垒、公司定性分析和资金流转数据分析等四个方面展开数据思维的具体应用过程。     

职务犯罪侦查强制措施:功能调适与完善路径——以宽严相济刑事政策为视角

在宽严相济刑事司法政策视野中,正确理解和把握职务犯罪侦查强制措施,应当做到惩治犯罪与尊重和保障人权并重,遵循比例原则,做到区别对待,规范强制措施的适用,厘清强制措施与侦查手段的关系;应当有效调适强制措施的功能,实现诉讼保障和人权保护的有机统一,高度重视证据发现功能但警惕其异化,重视强制措施的犯罪预防功能。在新修订刑事诉讼法的适用过程中,应进一步转变执法观念,实现从打击犯罪向保护人权倾斜;保证适用强制措施从界限模糊转向严格适用;完善强制措施适用的层次体系;妥善协调强制措施与侦查手段的关系。     

关于诱惑侦查诸问题之探讨

诱惑侦查是指侦查人员及其他参与侦查活动的人员通过诱惑性方式诱使某人实施犯罪行为或促使犯罪行为暴露的一种侦查手段。诱惑侦查有多种分类方法 ,较为流行的是将其分为“机会提供型”和“犯罪诱发型”两类。诱惑侦查可以在合法的范围内使用 ,但也可能被违法地使用 ,因此 ,不宜笼统地将其视为非法而予以排斥 ,但要对其进行必要的规范和制约。将诱惑侦查限定在无被害人案件 ,似乎范围过窄。诱惑侦查只能针对已有犯罪意图并正在寻机作案或可能继续犯罪的人采用。由于诱惑侦查适用的案件类型较为多样 ,所以其策略方法也是灵活多样的。     

卧底侦查刍议

卧底侦查是一种内线侦查方法,其侦查对象为有组织犯罪集团(团伙)。该侦查方法便于侦查人员直接获取犯罪信息,在侦查策略和侦查模式上具有较高价值。在使用该侦查方法时,侦查机关应遵循相应的流程,并注意解决相关问题,保护卧底侦查人员的人身安全。     

论侦查的起点

在司法实践中,由于现行刑事诉讼法规定的立案条件过高,使得一些有线索的案件达不到立案的＂合法＂要求,这不仅限制了侦查主体在程序启动上的主动性,而且严重制约了对相当一部分犯罪的预防与打击。文章借鉴域外随机型侦查启动模式,提出了以＂犯罪线索＂为起点启动侦查的＂立线侦查＂模式,并对其必要性、可行性以及实施要旨进行了分析。
