Law is the fundamental method of governance and the rule of law symbolizes modern civilization. The socialist rule of law is the rule of law rooted in the Chinese tradition, and designed and led by the Communist Party of China(CPC). It is not only a tool for government, but also a driver of social progress. Meanwhile, the Chinese human rights system is also designed by the CPC. Both concepts—the socialist rule of law and the human rights system——are different from the West in terms of theory, path and systems. Human rights are the fundamental values of and the ultimate goal pursued by the rule of law; and the rule of law is the recognition of and guarantee for human rights. Efforts must be made to advance legislative, administrative and judicial protection of human rights.  相似文献

Ⅰ. Getting help from lawyers and its realization according to international standards The right to defense for a person involving in a law suit is a universal human right. Article 11 of the Universal Declaration of Human Rights provides: "Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence." In 1944, 23 years after the establishment of the Communist Party of China, Mao Zedong made a speech with a title that would live on in Chinese history for ever: "Serving the People Wholeheartedly." In 1949, with the founding of the People's Republic of China, these four simple words became the governing principle for the Party and a pivotal slogan for an entire nation struggling against a colonial/feudal past and an uncertain future. Through the next 50-odd years, the Party went from strength to strength, correcting the mistakes of the Cultural Revolution and establishing a socialist market economy around its new governing principle of "scientific and democratic rule, and rule in accordance with law."
