我国犯罪构成理论逻辑缺陷及其完善

我国犯罪构成理论存在致命缺陷,具备犯罪构成所有构成要件的行为可能并不构成犯罪。我国的犯罪构成理论源于大陆法系国家,但大陆法系国家的犯罪构成理论不存在这个问题。其根本原因在于我国的犯罪客体没有起到其本源实质违法性概念的出罪功能。我国刑法理论界应该对犯罪客体的概念和功能进行反思,恢复其所对应的实质违法性的含义,起到相应的功能,使我国犯罪构成的理论体系彻底完善起来。     

我国刑法犯罪构成体系的选择适用——从三阶层与四要件犯罪构成论的比较说起

通过对三阶层递进式犯罪论与传统四要件犯罪构成论的比较分析,发现其明显优于传统四要件犯罪构成论。对三阶层递进式犯罪论,不能完全照搬,而是要吸收其优势——阶层式犯罪构成理论,有关三阶层递进式犯罪构成理论的具体内容还有待我国刑法学界的进一步研究和完善,以适合我国的刑法体系。     

论犯罪构成理论的双层结构

我国现存的犯罪构成理论经历了半个多世纪的发展,引起了越来越多的质疑和探讨,需要在结构上更加完善.为了将排除犯罪性事由纳入犯罪构成理论中,应该采用犯罪构成理论的双重结构.     

我国犯罪构成理论重构

犯罪构成是指犯罪成立的条件,因而又称为犯罪构成要件。我国的犯罪构成理论来源于前苏联的理论模式,时至今日,仍然残留着很多前苏联理论模式的痕迹,改变甚微。现行的犯罪构成理论不仅制约了刑法学的发展,并且窒息了犯罪构成的犯罪识别功能。因此,必须重新构建我国的犯罪构成理论。     

刍议我国犯罪构成理论的缺陷

传统犯罪构成要件说将犯罪主体作为判断罪与非罪的要件,在定义上存在着逻辑错误,对行为是否成立犯罪的评定顺序上存在着逻辑混乱;犯罪客体理论导致了定罪过程中的逻辑顺序混乱。此外,我国传统犯罪构成理论还存在与犯罪成立消极因素之间的逻辑矛盾,静态体系与动态过程之间的矛盾。     

论金融诈骗犯罪的构成模式及其立法选择

随着我国金融体制改革的深化和金融市场的放开,金融领域的各种犯罪现象日益突出.我国现行金融诈骗犯罪的构成模式属于传统诈骗犯罪的立法模式,即结果犯模式.这种立法模式不利于打击金融活动中的各种虚假欺诈性犯罪,我国刑法有必要建构结果犯加行为犯的金融欺诈犯罪构成模式,以维护金融秩序和安全.
