论税收优先权与无担保债权的竞合

税收债权与无担保债权竞合时,基于税收债权的公益性质,以及其保障现代国家正常运作的作用,赋予其优先权有着必要.税收债权以优先无担保债权为原则,但不能以"公益"之名义,肆意侵犯无担保债权人,尤其是处于弱势地位的劳动者的利益.将体现保障劳动者利益的,出于人道主义考虑的无担保债权置于税收债权之前受偿是例外.税收优先权的立法规定既适用于破产案件,也可适于非破产情形.     

税收优先权与担保物权的效力冲突分析

税收优先权是保障国家财政收入的一项重要制度,担保物权则重点保护债权人利益,关注交易安全。当一项财产同时成为税收优先权和担保物权的行使对象时,二者孰先便会产生冲突。通过对这两项权利的理论基础等进行对比分析可得出以下结论:首先,在我国现有的法律基础上,税收优先权与抵押权、质押权的冲突应通过实证研究来判断谁更优先,同时应进一步完善我国的欠税公告制度;其次,税收优先权与留置权产生冲突时,留置权的行使应先于税收优先权。

第一章总则第一条根据《中华人民共和国税收征收管理法》(以下简称税收征管法)的规定,制定本细则。第二条凡依法由税务机关征收的各种税收的征收管理,均适用税收征管法及本细则;税收征管法及本细则没有规定的,依照其他有关税收法律、行政法规的规定执行。第三条任何部门、单位和个人作出的与税收法律、行政法规相抵触的决定一律无效,税务机关不得执行,并应当向上级税务机关报告。

国际税收竞争对我国税收优惠制度选择的影响
