In the 2009 case of R. v. Grant, the Supreme Court of Canada reformulated the exclusion of evidence framework in the context of Charter breaches. The case was something of a revolution for those who study evidence law and the Charter. Thus far, the case has been the subject of much debate and even empirical study. Few academic papers have explored the philosophical predilections of the Court in the decision. In this paper, the authors briefly review the history of the exclusion of evidence test, explain the new framework and discuss the academic and legal responses to the case. The authors place the reasoning of the Court in a broader socio-legal context arguing that the test articulated by the Court is informed by a type of populism that combined with recent Charter cases in the police powers context allows for flexible potentials, ones that could, on occasion, encroach on due process protections. The authors call for scholars and activists to keep a close eye on the emerging jurisprudence in this critical area of Charter adjudication.  相似文献

Social distancing is an effective means of containing the spread of COVID-19, but only if we all participate. Who are the individuals who are least likely to adhere to social distancing recommendations, presently and in the long term? Such knowledge is important for policy makers looking to sustain the public's buy-in to social distancing. Using survey data from a sample of U.S. residents (n = 1,449), the authors show that some demographic factors (gender, age, race, political party) help predict intent to adhere to social distancing. Yet demographic factors are relatively poor predictors compared with individual attitudes and media diets. Public officials should make efforts to inform and persuade the public of the importance of social distancing, targeting media such as television and radio, where audiences are less likely to currently engage in social distancing or are less likely to envision themselves sustaining strict social distancing for several weeks or months.  相似文献

Refugee and labour immigration have placed the issue of immigrants’ access to welfare benefits high on the political agenda. This article explores how voter preferences for increases in the child benefit change when respondents are reminded about immigrants’ access to benefits. The survey experiment shows that information about newly arrived immigrants’ access to child benefit has only a small impact on support for increasing the child allowance. By contrast, information about labour migrants’ access to benefits for children living in another European Union country has a strong impact, and the observed sensitivity to this cue is not to the same extent confined to respondents who otherwise support welfare dualism.  相似文献

Using an empirical assessment of the use of enforcement undertakings by the Environment Agency and the engagement of the courts with the recently enacted sentencing guidelines for environmental offences, this article argues that the enforcement of environmental law is undergoing significant change. This change manifests itself in an increased reliance on written negotiated agreements in the form of enforcement undertakings by the Enivironment Agency and the willingness of the courts to hand down significant fines in cases against certain types of polluters. These new dynamics suggest that negotiation continues to play an important role in the enforcement of environmental law, albeit in a contractualized form. The application of the sentencing guidelines conversely suggests that environmental offences are no longer trivialized by the courts. Taken together, these emerging dynamics not only create specific incentives between agencies and offenders but also call into question established understandings and perceptions of regulatory enforcement.  相似文献

The purpose of the present study was to examine the direct and indirect effects (through peer contacts) of parental knowledge on adolescents’ delinquent and aggressive problem behavior, using latent growth curve modeling. A sample of 457 13- to 14-year old adolescents at first measurement wave (M=13.27; SD=0.45 years) filled out questionnaires about their parents, peers, and problem behavior three times with 1-year intervals in between. Regarding initial levels of behavior, both direct and indirect effects of parental knowledge were found on aggressive as well as on delinquent behavior. When the rate of change in behaviors was considered, only direct effects were found for both types of problem behavior, whereas indirect effects were absent. Gender differences were also found, with stronger effects of parenting on both aggressive and delinquent problem behavior for boys and stronger effects of peer contacts on aggressive behavior for girls. The present study shows that different behaviors of the externalizing spectrum have different trajectories and diverse relations with parenting and should not be treated as identical.

Is it possible to imagine New Public Management without marketization? In Denmark the present liberal-conservative Government has, throughout its 10 years in power, designed and implemented more than 15 major management reforms in the public sector. Although most of the reforms are rhetorically firmly rooted in neo-liberal ideologies they have, in practice, promoted tools and mechanisms of the “traditional,” or Old, Public Management. Based on an empirical study of the reforms, we suggest that the notion of “pragmatic” New Public Management is introduced to enhance the current understanding of New Public Management in the Western industrialized societies.  相似文献

This article makes an assessment of the recent international expansion of Indian companies by contrasting it to the earlier – much more modest – wave of investments abroad. It also traces the evolution of the Indian government's policy towards outwards investments and makes the claim that an important reason for the rise of investments abroad is the gradual relaxation of the Indian government's restrictions on capital outflow after the economic reforms of the 1990s. The new Indian investments abroad are characterised by being dispersed over a very large number of countries and economic sectors and – most remarkable – Indian companies are now also targeting the markets in Europe and the USA through acquisitions of local companies. At the same time, Indian companies have continued to expand their presence in other developing countries, where their activities may contribute to both economic progress and a reduction of economic dependence on relations with developed countries.  相似文献

Abstract

The nearly 60-year-long fight by Burma's ethnic minorities for autonomy and ethnic rights lies at the root of the country's broader political and humanitarian crisis. Yet, in the outside world, this issue is often subsumed under the better-known struggle for democracy, led by Aung San Suu Kyi and the National League for Democracy. The present article seeks to redress this imbalance by directing attention to the numerous groups representing ethnic minority interests, the grievances and aspirations that motivate their struggle, and their own strategies for peace. It argues that in Burma's deeply divided society peace and democracy are two distinct challenges, even if in the long term they must go together, and it calls for the international community to help the country's ethnic groups prepare for future peace negotiations and overcome the debilitating legacy of war.  相似文献

What parties want – policy, office or votes – affects how they represent their voters, make strategic decisions and respond to external changes in society. What parties strive to accomplish is crucially important for what they do. Moreover, our knowledge of what parties want affects what we expect them to do. For instance, coalition theory assumes that parties have homogeneous goals, and hence are equally likely to join coalitions given the same circumstances. However, this article investigates this basic assumption of party goal homogeneity and finds that party goals do indeed diverge. The article demonstrates that party goals are influenced by party-specific factors such as party size, policy position and intra-party politics. It therefore suggests, further, that intra-party politics should be included more systematically in future studies of party behaviour.  相似文献
