It is widely acknowledged that political parties in European democracies have become increasingly dependent on state resources, most notably direct state funding. Yet cross-national studies on parties' usage of state resources that are not earmarked for partisan purposes, which require the assessment of informal, intra-organisational practices, are still rare. This article looks at one such practice across 33 parties in five European democracies: namely the ‘taxing’ of national MPs' salaries. Under this practice, candidates who enter elected office on a party ticket are obliged regularly to donate a fixed share of their public salaries to party coffers. The empirical analysis shows that the presence of a taxing rule is more likely in parties with a strong extra-parliamentary organisation, while a leftist ideology facilitates the collection of high salary shares from parliamentarians. Moreover, where party entanglement with the state is particularly pronounced, the partisan usage of parliamentary salaries is easier irrespective of their organisational dispositions. Finally, while in unitary systems national headquarters are usually able to monopolise control over national MPs' contributions, in federal systems regional party executives are able to insist on their share of these payments.  相似文献

Which parties represented in the European Parliament (EP) are able to extract regular donations from their MEPs' salaries and, if they extract donations, how great are they? In the literature on party finances, there has been a lack of attention paid to the use of salaries of elected representatives as a source of funding. This is surprising given that the national headquarters of many parties in Europe regularly collect ‘party taxes’: a fixed (and often significant) share of their elected representatives' salaries. In filling this gap, this article theoretically specifies two sets of party characteristics that account for the presence of a taxing rule and the level of the tax, respectively. The presence of a tax depends on the basic ‘acceptability’ of such an internal obligation that rests on a mutually beneficial financial exchange between parties' campaign finance contributions to their MEPs and MEPs' salary donations to their parties. The level of the tax, in contrast, depends on the level of intra‐organisational compliance costs and parties' capacity to cope with these costs. Three factors are relevant to this second stage: MEPs' ideological position, the size of the parliamentary group and party control over candidate nomination. The framework is tested through a selection model applied to a unique dataset covering the taxing practices in parties across the European Union Member States.  相似文献

This is the first study of unwanted sexual experiences in the collegiate "hooking-up" culture. In a representative sample of 178 students at a small liberal arts university. Twenty-three percent of women and 7% of men surveyed reported one or more experiences of unwanted sexual intercourse. Seventy-eight percent of unwanted vaginal, anal, and oral incidents took place while--"hooking up,"--whereas 78% of unwanted fondling incidents occurred at parties or bars. The most frequently endorsed reason for unwanted sexual intercourse was impaired judgment due to alcohol. The most frequently endorsed reason for unwanted fondling was that it happened before the perpetrator could be stopped. Of those affected by unwanted sexual intercourse or unwanted fondling, 46.7% and 19.2% reported unwanted memories, 50% and 32.7% reported avoidance and numbing responses, and 30% and 26.9% reported hyperarousal responses, respectively. A preliminary model of unwanted sex and collegiate social dynamics is proposed to provide a heuristic for further research.  相似文献

Recent court challenges have highlighted the need for statistical research on fingerprint identification. This paper proposes a model for computing likelihood ratios (LRs) to assess the evidential value of comparisons with any number of minutiae. The model considers minutiae type, direction and relative spatial relationships. It expands on previous work on three minutiae by adopting a spatial modeling using radial triangulation and a probabilistic distortion model for assessing the numerator of the LR. The model has been tested on a sample of 686 ulnar loops and 204 arches. Features vectors used for statistical analysis have been obtained following a preprocessing step based on Gabor filtering and image processing to extract minutiae data. The metric used to assess similarity between two feature vectors is based on an Euclidean distance measure. Tippett plots and rates of misleading evidence have been used as performance indicators of the model. The model has shown encouraging behavior with low rates of misleading evidence and a LR power of the model increasing significantly with the number of minutiae. The LRs that it provides are highly indicative of identity of source on a significant proportion of cases, even when considering configurations with few minutiae. In contrast with previous research, the model, in addition to minutia type and direction, incorporates spatial relationships of minutiae without introducing probabilistic independence assumptions. The model also accounts for finger distortion.  相似文献

Recent challenges and errors in fingerprint identification have highlighted the need for assessing the information content of a papillary pattern in a systematic way. In particular, estimation of the statistical uncertainty associated with this type of evidence is more and more called upon. The approach used in the present study is based on the assessment of likelihood ratios (LRs). This evaluative tool weighs the likelihood of evidence given two mutually exclusive hypotheses. The computation of likelihood ratios on a database of marks of known sources (matching the unknown and non-matching the unknown mark) allows an estimation of the evidential contribution of fingerprint evidence. LRs are computed taking advantage of the scores obtained from an automated fingerprint identification system and hence are based exclusively on level II features (minutiae). The AFIS system attributes a score to any comparison (fingerprint to fingerprint, mark to mark and mark to fingerprint), used here as a proximity measure between the respective arrangements of minutiae. The numerator of the LR addresses the within finger variability and is obtained by comparing the same configurations of minutiae coming from the same source. Only comparisons where the same minutiae are visible both on the mark and on the print are therefore taken into account. The denominator of the LR is obtained by cross-comparison with a database of prints originating from non-matching sources. The estimation of the numerator of the LR is much more complex in terms of specific data requirements than the estimation of the denominator of the LR (that requires only a large database of prints from an non-associated population). Hence this paper addresses specific issues associated with the numerator or within finger variability. This study aims at answering the following questions: (1) how a database for modelling within finger variability should be acquired; (2) whether or not the visualisation technique or the choice of different minutiae arrangements may influence that modelling and (3) what is the magnitude of LRs that can be expected from such a model. Results show that within finger variability is affected by the visualisation technique used on the mark, the number of minutiae and the minutiae configuration. They also show that the rates of misleading evidence in the likelihood ratios obtained for one of the configurations examined are low.  相似文献

Numerous organizations touch the lives of children and their families following incidents of maltreatment, including family/dependency courts, child welfare agencies, foster parent associations, foster care agencies or substitute care facilities, mental health agencies, and others. The way these organizations work together is critically important. They have the potential to promote child safety and reduce the harmful impact of maltreatment on children, but also, unfortunately, at times their actions may worsen the traumatic experience for children and their families. The National Child Traumatic Stress Network conducted a survey of 53 child‐serving organizations in 10 states, to assess the ways the organizations gather and share trauma‐related information and the basic training about child trauma their staffs receive. The goal was to determine how the various service systems, including the courts, communicate with each other about trauma and the extent to which, alone or in combination, they promote children's healing following traumatic events. The survey results point to a need to improve collaboration on issues associated with child maltreatment and trauma. Judges can be important leaders in bringing about necessary changes. Recommendations for judges and courts are included.  相似文献

Agnew's (1992) general strain theory (GST) had been tested across a wide range of populations and on numerous criminal and analogous behaviors. The ability of GST to predict white-collar offending, however, had yet to be explored. Using data from convicted white-collar offenders, this research examined the ability of GST to explain white-collar offenses. The results revealed that GST was useful for predicting a select group of white-collar offenses, but might not be generalizable to individuals committing corporate-type crimes. Additionally, the findings suggested that the types of strain and negative emotion at work for white-collar offenders might vary from those found in other criminal populations. Implications for white-collar crime studies are discussed and ideas for future research are presented.  相似文献

The way in which political parties use state resources indirectly (e.g., parliamentary expenses) receives substantial attention in public debate, particularly when surrounded by perceptions of misuse. However, scholarly studies of resources indirectly available to parties through their functions in the state, how they are used and regulated, are rare. This article presents an analytical framework that identifies and categorizes the range of indirect resources linked to parties' institutional roles. It locates these resources within a four‐fold matrix of regulation, distinguishing regimes that vary in their detail and whether compliance is externally monitored. Undertaking comparative case studies of parliamentary resource use in the United Kingdom and Australia, we argue that the blurring of party‐political and parliamentary roles can impede the effectiveness of regulatory regimes that democracies adopt, regardless of detail and external enforcement. These findings have important implications for regulatory reforms that seek to constrain parties' behavior to depoliticize democratic governance.  相似文献

The delivery of forensic science evidence in a clear and understandable manner is an important aspect of a forensic scientist's role during expert witness delivery in a courtroom trial. This article describes an Integrated Evidence Platform (IEP) system based on spherical photography which allows the audience to view the crime scene via a virtual tour and view the forensic scientist's evidence and results in context. Equipment and software programmes used in the creation of the IEP include a Nikon DSLR camera, a Seitz Roundshot VR Drive, PTGui Pro, and Tourweaver Professional Edition. The IEP enables a clear visualization of the crime scene, with embedded information such as photographs of items of interest, complex forensic evidence, the results of laboratory analyses, and scientific opinion evidence presented in context. The IEP has resulted in significant improvements to the pretrial disclosure of forensic results, enhanced the delivery of evidence in court, and improved the jury's understanding of the spatial relationship between results.  相似文献
