论社会和谐与冲突的法律控制

冲突是人类社会的基本构成事实。冲突是无法消除的,只能谋求恰当的控制。在多种社会冲突控制机制中,法律控制在理论和实践层面都获得了主导地位。法律控制机制的三要素:法官控制、理性法律控制、国家强制控制都面临正当性的重新证成问题。因此,多元社会冲突控制模式即成了冲突控制机制的发展方向。
