Abstract: This article is about building metropolitan governance capacity. Based on the case study of the Communauté métropolitaine de Montréal (the Montreal Metropolitan Community), the authors seek to understand how this new metropolitan institution develops its capacity to manage metropolitan issues. What factors influence metropolitan governance capacity? What are the impacts of actor behaviour, incentive structures, and political leadership on that capacity? Specifically, results focus on two of the CMM's areas of responsibility: land‐use planning, and social and affordable housing. Based on the analysis of official documents of the CMM (its act of incorporation, activity reports, budget, etc.) and thirteen interviews with elected municipal officials and public servants, the authors show that the building of metropolitan governance capacity is influenced by the interactions between those three factors, as well as by other elements specific to each context.  相似文献

This paper deals with the particularities of vagueness in law. Thereby the question of the law’s capacity for vagueness is closely related to the question of the impact of vagueness in law, since exaggerated vagueness combined with the elasticity of legal interpretation methodology may affect the constitutional principles of legal certainty, the division of powers, and the binding force of statute. To represent vagueness and the instability of legal concepts and rules, a Hyperbola of Meaning is introduced, opposing Heck’s metaphor of a core and a periphery of meaning. Furthermore, evidence is provided that the use of vague legal concepts and the capability of legal methodology to affect the specific meaning of those concepts, may give rise to astonishing and irrational changes of meaning of the law. Finally the paper sets out in search of an added value of vagueness in law, and weighs several stated pros and contras of vagueness. The work of a small and unusual activist group in the north Indian state of Rajasthan has raised a series of practical and theoretical issues concerning the best means for combating specific instances of corruption, and for promoting accountability more generally. The Mazdoor Kisan Shakti Sangathan (MKSS)-literally-:Workers' and Farmers' Power Organisation-has waged a campaign to secure the right of ordinary people to gain access to information held by government officials. In the process of experimenting with methods of compiling, sharing and verifying expenditure data at very local levels-thus far, in the absence of a statutory entitlement to such informationthe MKSS has developed a radical interpretation of the notion that citizens have a right both to know how they are governed and to participate actively in the process of auditing their representatives. This article examines the process by which this campaign emerged and the means by which it pursues its goals. It then analyses the implications of the MKSS experience, and the larger movement it has spawned, for contemporary debates in three areas: human rights, participatory development and, of course, anti-corruption.  相似文献

German feminist scholars have recently come to argue that female involvement in right‐extremist causes is grounded in gender‐specific motives. They have also begun to uncover a troubling link between new patterns of female political engagement (ranging from electoral mobilisation to violent streetfighting) and their own efforts to promote an independent women's consciousness since the 1960s. This article develops a typology of New Right women, characterised here as Femi‐Nazis, evincing different levels of sympathy for, identification with, and participation in radical and extremist movements. It then explores five issue orientations distinguishing New Right women of the 1990s from the Old and New Right men of the 1940s and 1990s, suggesting that these women have developed an independent, self‐assertive political consciousness without internalising feminism's broader aims of diversity and inclusion. The article concludes with reflections on the interplay of ‘feminist’ consciousness and ultra‐nationalist qua xenophobic attitudes, and on the dilemmas Femi‐Nazi thinking poses for feminist identity in united Germany.  相似文献
