Organisierte Zivilgesellschaft im EU-Verfassungsprozess: Partner des Regierens oder Konstituent politischer Ordnung?

A new role has been ascribed to civil society within the EU-constitutional process. It is not only regarded as a partner in governance but also as a constituent of the emerging EU-polity. Civil society appears in this process primarily as the structure of voice that is articulated in relation to EU-governance and that claims to represent European citizens. The article proposes an analytical framework and a methodology of how to analyze civil society in its role as constituency. The research agenda is linked to the intermediary and the representative function of organised civil society as a transmission belt of legitimatory discourse on the EU. In order to reconstruct how potential interests, identities and normative ideas relating to the legitimacy of a EU constitutional order are contested within national politics, our research draws on a survey of German civil society organisations in three sectors: a) consumer interest organisations, b) churches and religious organisations, and c) women and gender equality groups.     

Ethnic minorities,culture conflicts and crime

Since the mid-sixties debate among German criminologists has centered around the impact of cultural conflict on deviance and crime. Research in this area is restricted to individual level explanations of behavior. There is, however, another avenue provided by culture conflict theories. This paper describes the contemporary German situation and suggests that shared values and collective morals are no longer the nucleus of stability in modern industrial societies; they have been replaced by a material culture. When large proportions of the population are denied access to this material culture, the potential for a collective reaction increases. Violent behavior is then justified by the assertion that culture or national identities are being defended. Thus, collective reactions might lead to cultural conflicts between groups and go beyond individual violent acts or other types of deviance.     

The micro–macro link in deliberative polling: science or politics?

In this article, we critically examine the question of how to link the ‘micro’ of deliberative mini-publics with the ‘macro’ of the democratic system. To explore this puzzle, we relate to EuroPolis, a transnational deliberative experiment that took place one week ahead of the 2009 European Parliamentary elections. The main argument is that although the scientific design of deliberative polls is a necessary condition for the fulfilment of the criteria for equal participation and informed opinion-making of selected citizens (the micro-dimension), this does not necessarily translate into a democratically representative and legitimate proxy for the broader political constituency (the macro-dimension). This problem is potentially exacerbated in deliberative settings that cut across domestic political cultures and nationalized public spheres.

Carbon monoxide poisoning from indoor barbecues--incidents reported to the German-speaking Poison Information Centers and the German Federal Institute for Risk Assessment (BfR) in Berlin

From 2008 to the end of 2009 the Joint Poison Information Center (PIC) in Erfurt observed 7 incidents involving 17 persons (1 fatality) with signs of carbon monoxide poisoning from indoor barbecues (COFIB). To find out whether COFIB is a regional or a general phenomenon in Germany, Austria and Switzerland, all information about COFIBs recorded by the 11 German-speaking Poison Information Centers and the BfR Berlin were retrospectively analyzed for the period 2000 to 2009. In all, 60 COFIBs (accidental: 90.0 %, suicidal: 8.3%, reason unknown: 1.7%) involving 146 individuals were reported. The number of incidents increased from one case with 2 persons in 2000 to 18 cases involving 34 persons in 2009. The 146 victims (female 26.7%, male 27.4%, gender unknown 45.9%; adults 58.2%, children 24.7%, age unknown 17.1%) lived in 15 of the 16 federal states of Germany and in Switzerland. The highest number of victims was found in Bavaria (23), Brandenburg (18), and Baden-Wuerttemberg (18). The symptoms according to the Poisoning Severity Score were none to mild in 60.3%, moderate in 13.7%, severe in 11.6%, fatal in 6.9% and unratable in 7.5%. No clear correlation was found between the carboxyhemoglobin concentration and the severity of the symptoms. As a rising number of COFIBs often involving several individuals was observed from 2000 to 2009, the general public was informed about the risks of indoor barbecues.     

Von der politischen zur sozialen Konstitutionalisierung Europas. Verfassungsgebung als Katalysator europäischer Vergesellschaftung?

The constitutionalization of the European Union represents a simultaneous and interacting process of polity building and constituency building. The EU’s social constituency is referred to as a particular constellation of public voice and resonance in the media in relation to European constitution making. This article compares constitutional claims-making in quality newspapers in France and Germany during the ratification period. It analyzes who raised their voices, what kinds of concerns and demands were put forward, which attitudes towards the EU were expressed and how particular visions of the EU were justified. A politicized and domestically focused French media sphere is contrasted with the German media that took the position of an attentive but passive observer of debates in other member states.     

Unusual circumstances in a fourfold complex suicide

Complex suicides are defined as suicides using more than one method, which may sometimes suggest homicide. We present the case of a 27-year-old man who killed himself by using four different methods. The man was known as a loner and sufferd from bipolar psychosis. An eyewitness saw him afire and falling out of a window on the 4th floor of a hotel. He was wearing a judo dress with the belt wound twice around his neck. He died in a hospital about two hours later. The autopsy showed signs of neck compression typical of (self)-strangulation, several stab and cut wounds in the thoracic and abdominal region from sharp force, extensive first- to third-degree burns caused by the effect of heat, contusions of internal organs, serial rib fractures and several bone fractures of the extremities as signs of blunt force. The CO-Hb value in the blood amounted to 7%; the other toxicological tests were negative. Death was found to be due to exsanguination from a deep stab wound in the abdomen and multiple trauma caused by the fall from a great height in the course of a suicide. Homicide could be excluded due to the circumstances of the case, which demonstrated again that both the medical findings and the investigation results of the police are indispensable for the differentiation between suicide and homicide.
