This article traces the creation and demise of the U.S. Advisory Commission on Intergovernmental Relations (ACIR) and assesses the prospects for restoring an ACIR‐like capability to the federal system. Recent initiatives by the National Academy of Public Administration, the Big 7 state and local government official associations, and Congress are summarized, and the facilitating and inhibiting factors associated with intergovernmental institutional development are examined. At least three ingredients in the formula that gave birth to the ACIR in 1959 will need to be present more than 50 years later: (1) support from congressional champions, the president, and public interest groups; (2) visibility and urgency of intergovernmental fiscal and management issues and the need for a permanent intergovernmental presence to address them; and (3) “homework and spadework” to enlist potential conservative and liberal interest group and think tank backers.  相似文献

Desgleichen haften den Regelungen über den Ersatz von Kosten verfassungsgerichtlicher und verwaltungsgerichtlicher Verfahren Defizite an. This paper presents a new concept in how some aspects of government policy can be delivered and the author is unaware of it having been utilised anywhere before. The author, whose field of competence is building regulation, has named it ‘Officially Compulsory Advice’ and he sees building legislation as a first possible arena for its use. This paper also explores the factors that may make it attractive in two other possible arenas and, therefore, Officially Compulsory Advice may be a useful technique in extending the efficacy of policy implementation. Specialists in other arenas may well discover further possible uses for the concept. Is Officially Compulsory Advice a tautology? Yes, no and maybe. The concept combines elements from these three words: Advice is something that the recipient is free to accept or reject; Compulsory means that the recipient is obliged to receive the advice; and Officially means that legislation has required certain defined classes of people to receive certain advice. This paper also demonstrates how these apparently disparate elements are combined to create a concept that is cohesive, viable, practical and potentially useful in the real world.  相似文献

In this paper, we focus on the institutional setting where Old Masters’Paintings (OMP) markets transactions are carried. We develop a preliminary attempt to embody legal provisions in econometric, hedonic pricing models. We consider a particular regulation applicable only in Italy, the “export veto” for art objects that are particularly relevant for the national cultural patrimony. We proxy such legal provision in order to include it in the statistical analysis and to check whether it affects the OMP price differentials between pre-auction estimated price and post-auction hammer price. Preliminary results show that the price differential is affected by the legal variable, therefore suggesting that the country’s institutional framework plays an important role in price dynamics.  相似文献

Deregulation and the combined threats of energy crises and global warming concern nations around the world, yet these issues continue to be addressed more directly by domestic regulatory systems than by international institutions. The present analyses of the integration of distributed sources of power generation (DG) into California’s electric utility system suggests that domestic environmental dilemmas with international repercussions provide an obvious entrée for global environmental policy specialists into the practice of environmental policy-making and law. Here I review current scholarship on policy networks that illuminates the contributions that technical and policy experts can make to such networks surrounding environmental issues. I then introduce the key members of California’s “clean DG” policy network that emphasizes the role of academic experts in this influential political system, and discuss how my own research has impacted the development of the state’s DG policy. I conclude that scholars are well positioned to observe and engage domestic and international environmental policy networks, and thereby also to influence environmental politics and law.  相似文献
