The professional and legal regulation of assisted reproductive technologies (ART) in Australia is a vast maze of intersecting laws and guidelines which place restrictions on the provision of services such as infertility treatment, surrogacy, sex selection for social reasons, donor insemination, pre-implantation diagnosis and human embryo research. This study investigated the application of these restrictions on clinical practice in New South Wales, a relatively unregulated State, and Victoria, a relatively highly regulated State. The results of the survey indicate that the range of ART services in Victorian clinics was far more limited than in New South Wales clinics. The Victorian clinics uniformly restricted access of single and lesbian women and did not offer social sex selection procedures. The New South Wales clinics adopted different polices regarding these services. It was found that restrictive laws governing "social" issues have a significant impact on the availability of ART services and some respondents seemed unclear about the nature of restrictions and laws relevant to their work. It was also found that "reproductive tourism" is prevalent and restrictions were circumnavigated by patients with assistance from clinics. It was concluded that more evidence is required to evaluate regulation in this field of medicine.  相似文献

Some aspects of determining what proportion of defendants to release before trial are discussed using cost and other data obtained from judges, prosecutors, defense attorneys, and bail project directors in twenty-three cities. Various holding costs, releasing costs, and percentages of defendants held are used. Smooth curves are fitted to the data points to determine at what percentage of defendants held the total cost curve bottoms out. The effects of varying the costs and the cities, the causal implications of why the optimum percentage differs substantially from the actual percentage, and the policy implications of using the analysis in pretrial release policy and in reducing the total costs are shown. Ways in which the model can be expanded to obtain insights into the optimum level of various kinds of due process and law enforcement are also indicated.  相似文献

The authors argue that some integrationists are seriously underestimating the degree to which the university is embedded in the overall social structure, a role which has not developed accidentally, and which is not likely to change without concurrent major changes in other institutions. Although it is understandable why integrationist strategies have developed and why some projects may be useful, it is also important to think about how they may undermine the radical goals of feminist scholarship and our ties to the community.  相似文献

This research addresses two separate but related questions. First, to what extent are sociological theories proposed to explain legal behavior in Western societies applicable to non‐Western contexts? And second, to what degree is Black's theory of law generalizable, as he contends, “across time and space?” Our research merges these questions by exploring the applicability of Black's theory in a Latin American context. Data collected from a nationally representative survey in Brazil suggest support for Black's propositions regarding the impact of vertical, horizontal, cultural, and normative status on the likelihood of mobilizing the law, as well as the feasibility of using his framework for understanding legal behavior in non‐Western settings. Our discussion considers implications and directions for future analyses in both the Brazilian and cross‐cultural contexts.  相似文献

The 2001 anthrax letter cases brought into focus the need to establish the most effective environmental sampling procedures. Results are presented from two studies aimed at establishing the best procedures for everyday surfaces likely to be contaminated after the release of environmentally stable bioaggressive agents, as exemplified by anthrax spores and ricin. With anthrax spores, contact plates, with mean retrieval rates of 28-54%, performed better than other methods by a wide margin for flat nonporous, nonabsorbent surfaces. They also proved best on flat porous, absorbent materials, although recoveries were low (<7%). For both agents, dry devices (swabs, wipes, Trace Evidence Collection Filters) had universally poor retrieval efficiencies with no significant differences between them. Among moistened devices (wipes, swabs, and Sample Collection and Recovery Devices), wipes were generally best, albeit with considerable cross-over among individual readings (highest mean recoveries for anthrax spores and ricin 5.5% and 2.5%, respectively, off plastic).  相似文献

Francis Bacon’s famous metaphor that knowledge is power has been the intellectual springboard for many scholars to offer misleading observations about the inordinate authority and power of knowledge. Among the important implications that Bacon derives from his metaphor is the assertion that individuals provided with experimental skills and practical knowledge are those most entitled to hold executive office, rather than the aristocracy of blood. This article describes the political style and practice of the Australian National Council of Women (ANCW) as it developed up to 1975. The historical significance of this lies in the fact that, during the first three quarters of the last century, the ANCW was effectively the peak body representing the great majority of women's groups in this country: groups whose activities focused on politics, religion, morality, health, education, the media, philanthropy and also peace, women's economic and political rights, child welfare and legal reform. The Council spoke on behalf of these constituents to all levels of government, and internationally through the International Council of Women. It generally did not represent women associated with trade unions and the Australian Labor Party, and the politically active women amongst its leaders tended to be members of the Liberal Party. The conduct of the Council avoided party politics; its leaders co-operated with trade unionists on issues of women's rights such as equal pay, and worked as willingly with Labor governments as with non-Labor ones. An assessment of the effectiveness of the Council's political activities is therefore an assessment of the political practice and achievements of mainstream Australian feminism before the advent of radical feminism in the 1970s.  相似文献

Some scholars have suggested that institutionalisation and professionalisation of women's movement organisations leads to ‘feminist fading’. This article examines whether such propositions hold true for the Australian women's movement. It maps changes in the women's movement that had emerged by the 1990s, including increased diversity and increased national and international networking as well as increased institutionalisation. It finds that loss of political influence has less to do with institutionalisation than with a changed discursive environment that constructed the welfare state and women's reliance on it as a problem. Nonetheless, women's movement institutions have continued to sustain feminist values and engage in differently organised but effective campaigns. A case study of the women's health movement in Victoria shows how it succeeded in having abortion removed from the criminal code in 2008. Repertoire had changed since the 1970s but the goal remained the same.  相似文献
