Most American jurisdictions follow either asubjective or anobjective approach to the entrapment defense. In order to test some of the differences between the two approaches, student jurors viewed a videotaped cocaine trial and were presented with either subjective test or objective test instructions. The admission of prior conviction evidence was also varied. The jurors deliberated, returned a verdict, and then completed a questionnaire that measured their understanding of the instructions and trial facts. Results show that, first, juror comprehension of the principal features of the objective test is very poor. It is suggested that an effort be made to simplify instructions describing the objective test. Should simplification not improve comprehension, it is argued that the judge, not the jury, should decide the entrapment defense when the objective test is used. Second, admission of a prior conviction has a significant impact on verdicts in the subjective test condition, but not in the objective test condition. This finding suggests that the subjective test instructions are effective in encouraging jurors to use prior convictions as evidence of guilt. The content of the objective test instruction may also account for part of the difference in impact. Jurors in the objective test condition were instructed not to take the defendant's predisposition into account, and a substantial minority of the jurors under-stood this aspect of the instruction.  相似文献

This study describes the Supervised Access Pilot Project, implemented in 14 locations in Ontario, from the perspective of those offering the service and community organizations whose members use the service. Two services were offered: visits and exchanges. The average cost of a visit varied considerably across centers (range $15 to $309), a result that is partly attributable to economies of scale. Centers in large urban centers were more cost-efficient than those situated in small communities. Centers provided neutral and safe circumstances for visiting. Only 1.6 serious rule violations occurred during every 1,000 visits. It was estimated that about 3 out of every 10,000 persons used the service. Intake and safety procedures, essential to the smooth running of the centers, have been outlined. Staff fell that they would benefit from increased training in the areas of conflict resolution and the effects of divorce on family members.  相似文献

The possibility of regional cooperation in the Yellow Sea Rim (YSR) area has been discussed since the early 1980s. In recent years, Korean outbound foreign direct investment (FDI) has increased rapidly and it will be growing much further. In the new phase of the global economy and the post-cold war political environment, Korean firms consider the socialist countries, especially China, to be attractive new partners for trade and investment projects. Foreign investment contributed to economic growth in developing countries. In the early stage of industrialization in the 1970s, the share of foreign firms amounted to about one-tenth of the total manufacturing employment in Korea. Similarly, outbound Korean FDI could also play an important role in the industrialization of the LDCs in Southeast Asia and China. A case study of a Korean multinational corporation reveals that the direct employment effect of Korea’s FDI is extensive in terms of money invested. In spite of the complementarity in economic structure and the phase of development between Korea and China, the prospect of Korea’s outbound FDI is not all clear. However, one can safely assume that the unit scale of FDI projects will increase. Unlike in the past, the large Korean corporations are now preparing more than a few fair-sized projects in China. The positive impact of those FDI will be significant. The YSR cooperation, if successful, could create efficient economic cooperation based on complementarity between Korea and China. The Korean outbound FDI would pave a road to such regional cooperation. This article is the revised version of a paper prepared for the International Conference on Regional Development in the Yellow Sea Rimlands, held February 18–21, 1991. Age discrimination is a systemic problem of the American administrative state that undermines both the caliber and performance of the U.S. federal government workforce. A theory is proposed, anchored on discrimination against age-eligible employees (age 40 and over) representing a social identity group, to explain how status-group power differentials between supervisors and non-supervisors within U.S. federal agencies explain the organizational incidence of formal discrimination complaints. The theory predicts that the incidence of age discrimination formal complaints is declining in the share of supervisory personnel who are discrimination age-eligible while increasing in the share of non-supervisory personnel members who belong to this group. Evidence is obtained for these hypotheses using objective data on Equal Employment Opportunity Commission's age discrimination formal complaints about an unbalanced panel of 130 U.S. federal agencies between 2010 and 2019. The empirical evidence underscores the structural challenges to combatting ageism within the U.S. federal government workforce during an era of an intergenerational personnel change.  相似文献
