Corporate Governance in Spain (with an Application of the Power Indices Approach)

This paper describes the governance system of Spanish listed firms in the early 1990's. Although the institutional setting of the Spanish Stock Exchanges differs little from other European national markets, we found important differences in several aspects of corporate governance. In particular, some of the standard mechanisms of control (e.g. boards and institutional shareholders) do not play an active role, whereas ownership is relatively concentrated. Moreover, power indices suggest that controlling blocs of large shareholders are very likely to form. We thus conclude that the ownership of shares is a pivotal mechanism in the governance of Spanish corporations.     

ENTER THE DRAGON: INSIDE CHINESE HUMAN SMUGGLING ORGANIZATIONS*

This paper examines the inner workings of Chinese human smuggling organizations. Contrary to widely held conceptions about Chinese organized crime, most alien smugglers are otherwise ordinary citizens whose familial networks and fortuitous social contacts have enabled them to pool resources to transport human cargoes around the world. They come from diverse backgrounds and form temporary alliances to carry out smuggling operations. With the exception of a shared commitment to making money, little holds them together. The smuggling organizations mostly resemble ad hoc task forces and are assembled for specific operations. These organizations have clear divisions of labor with limited hierarchical structures. We discuss the theoretical implications of their unique organizational characteristics.     

The ADA on the Road: Disability Rights in Germany

This paper examines the impact of a "disability rights model" on the emerging disability rights movement in Germany. Traditional German disability politics and activism are based on the expansion of welfare and special needs provisions rather than on equal rights and integration. Inspired by the 1990 Americans with Disability Act, German activists adopted a disability rights model and successfully worked toward the passage of a constitutional equality amendment in 1994 and ant-discrimination legislation in 2002. Using the literature on rights mobilization, this paper argues that German disability activists use rights talk to both support and contest culturally specific approaches to disability rights, equal treatment, and the role of the state in guaranteeing welfare rights. The globalization of disability rights should not be viewed as an imposition of American norms but as a more complex process of adaptation and cultural transformation that involves constructing locally legitimate approaches to disability rights with an American import.     

Identification based on medical findings

1. The indications such as the place of finding, the identification of clothes or other personal items, represent only the first step towards the identification of a corpse. 2. An identification based on medical data, other than dental, is often possible, more often than it is believed. 3. The forensic pathologist plays a double role in the case of such an identification: a) in the phase of the inquiry, he must contact the investigators and the families to explain his wishes and the different possibilities of identification. b) he must use the gathered information in the appropriate way. 4. It would be desirable to compose some statistical tables of the various medical elements useful for the identification (mutilations, surgical operations, etc...). We present six cases of identification in our practice.     

Predicting patrol officer performance from a psychological assessment battery: A predictive validity study

The psychological assessment battery is an integral part of the selection process used to select patrol officer applicants. Unlike all other procedures used in the selection process, the psychological assessment has not been adequately validated. The purpose of this study was an attempt to provide validation data for a psychological assessment battery. The battery consisted of the Nelson-Denny, Shipley-Hartford, MMPI, and the Motivational Analysis Test (MAT). Performance measures included various measures of training academy performance and field training performance. A stepwise regression and MANOVA/Discriminant Analysis indicated that the psychological tests did predict performance, although an exact predictive equation could not be developed due to the high intercorrelations between predictor variables. Authoritarianism,creativity, and other aspects of a prison organization

Conclusion This analysis shows that no simple explanation will do when trying to understand a prison. The authoritarian aspects were very negative to me as a professional working there. I did not like being blamed for things I did not do, or being sent to numerous required training programs, almost all of which were worthless for me, telling me thing 1 already knew or could not use. However, there were positive sides to the prison, especially in the treatment aspect. In 1972 Messinger wrote “I must take the position that prisons and custodial mental hospitals should be abolished” (Messinger, 1972, P. 6). His position was that these institutions are so inhumane that society would be better served by their abolition. We probably need more analyses like the present one, and other studies which rely more heavily on more gathering of quantitative data in order to understand what prisons are really like. Only then can we make informed choices, without depending on stereotypes.     

The use of phosphate buffered saline for the recovery of cells and spermatozoa from swabs.

In the forensic science laboratory, the recovery of spermatozoa from vaginal swabs, or vaginal cells from penile swabs, can help determine if sexual intercourse may have taken place. There are several methods used to recover spermatozoa and cells from the swabs before visualisation on a microscope slide and most of these methods use water. Phosphate buffered saline (PBS) is a non-toxic solution used in many biological laboratories. Unlike water, PBS prevents cells rupturing or shrivelling up due to osmosis. This study demonstrates that PBS can be used for the extraction of spermatozoa and cells from swabs and that PBS does not affect subsequent DNA profiling.     

Participation in Transition: Mobilizing Ugandans in Constitution Making

Can participatory programs in transitioning countries increase the involvement of citizens beyond the level expected from individual-level characteristics, such as demographic traits, socioeconomic resources, and civic orientations? To answer this question, I examine the causes of participation in the Ugandan constitution-making process. Statistical analysis of a random sample survey of 820 citizens demonstrates that although individual-level factors play a role, many Ugandans participated because mobilizing agents pulled them into the process. I argue that programs to encourage active and equal participation will be most successful if they supplement weak indigenous institutions of mobilization and help all types of citizens to participate early on in the transition to democracy.
