证明标准与刑事政策

作为关涉治理的学问,法学从来就不是纯粹哲学的绝妙搭档,毋宁说昨日主要是政治学的密友,今又与社会学颇有亲缘。左、周二君在本文,力图诠释作为刑事司法规则的证明标准及其变化之蕴涵,对此可谓心领意会,他们既未固执于本体论的玄宏叙事,亦不满足于“人权保障功能”的简体抒情,而是从司法权术这一向度来审视之,对于证明标准由绝对真实论向相对真实论(或曰经验性证明标准)的这一转向,就其之所以被现代社会合法化、有效化,进行了一次细致、缠绵的知识社会学意味的“解密”。他们认为,经验性证明标准本身作为一种可能性艺术和审慎的实践智慧,是不断追求社会控制的有效性的权力程序的政治回应,因此与多面向的刑事政策互为纠缠,并深陷于刑事网络双重化,即在犯罪/刑罚这一对范畴之外再加上危险性/安全措施这一对范畴的情境中。作者附带盘查了中国刑事司法的有关问题,比如强调客观真实、缺乏证据生成机制等,总体上而言缺乏对案件区分处理的平衡技术;之所以造成这种状况,除了意识形态之苛求外,欠缺必要的社会技术条件也是主要原因,例如程序控制、有效组织的法纪社会等。     

IDENTIFYING THE PSYCHOLOGICAL FACTORS THAT MEDIATE THE ASSOCIATION BETWEEN PARENTING PRACTICES AND DELINQUENCY*

Past research has largely ignored the developmental changes within the child that account for the association between parenting and risk for delinquency. We used structural equation modeling and data from a longitudinal study of several hundred African‐American families to test the contentions of various theories regarding the sociocognitive and emotional factors that mediate the impact of parental behavior on a youth's risk for delinquency. Our findings largely supported the theories. The impact of monitoring/discipline was indirect through low self‐control and acceptance of deviant norms, whereas the effect of hostility/ rejection was indirect through low self‐control, hostile view of relationships, and acceptance of deviant norms. These two dimensions of parenting were no longer related either to affiliation with deviant peers or to conduct problems once the effects of these psychological characteristics were taken into account; the impact of these parenting practices was completely mediated by these four cognitive/affective variables. Contrary to expectation, however, these psychological factors did not mediate any of the relationship between caretaker involvement in antisocial behavior and child conduct problems.     

泥土中植物花粉的提取与检验

目的建立泥土中植物花粉的提取和检验方法。方法用去二甲苯、18%盐酸溶液处理提取泥土中的花粉 ,然后用扫描电镜进行检验。结果从不同的泥土中检出不同花粉。结论本方法能有效分离提取泥土中花粉。对其它混合物中花粉的提取有参考价值。本文介绍一种泥土中花粉提取的简捷方法 ,以及利用扫描电镜 /能谱仪对提取的植物花粉进行检验的方法。     

SPLIT IDENTITY AND CHILDREN OF DIVORCE

Divorce, although a statistical norm, is a developmental trauma to the children involved. This article looks at the two-camp emotional environment of a divorcing family and its effect on the formation of a child's identity. By examining developmental ages, chosen according to divorce research, the author attempts to show how the interspouse emotional cathexes negatively affect a child's sense of self in ways specific to the child's age at the divorce.     

国际环境争端解决机制研究

解决和避免国际环境争端已成为近年来备受关注的论题。无论是在1992年联合国环境与发展大会期间还是新近多边环境协定的谈判和实施过程中,国际环境法的遵守问题都引起了各国政府和国际法学者的关注。多边环境条约、联合国海洋法公约以及WTO规则,是国际环境争端解决机制的主要法律渊源。在一定范围内,这些多边条约和条约体系相互影响、相互推动,又相互矛盾和冲突,呈现出国际环境争端解决机制的独特发展形态。     

Effect of carcass size on rate of decomposition and arthropod succession patterns.

Decomposition studies were conducted using two carcasses of domestic pigs, Sus scrofa L., 8.4 kg and 15.1 kg in weight, to determine the effects of carcass size on the rate of decomposition, composition of the arthropod fauna, and succession patterns. A total of 46 arthropod taxa were recovered during this study. No size-related differences were observed between carcasses with respect to composition of the arthropod fauna or patterns of succession. A greater number of arthropods were observed attracted to the 15.1-kg carcass, and the rate of decomposition observed was more rapid for the 15.1-kg carcass than for the 8.4-kg carcass. Internal temperatures of the 8.4-kg carcass were more directly related to external ambient temperatures during the fresh and bloated stages of decomposition. During the decay stage, both carcasses generated internal temperatures significantly above ambient temperatures. Following this stage, internal temperatures fell to approximate ambient temperatures during the postdecay and remains stages.     

NGOs and Ethnic Conflict: Lessons from the Work of the Project on Ethnic Relations in the Balkans

This article examines the impact of nongovernmental organization-sponsored contact and communication on fostering peaceful solutions to ethnic conflict via case studies of the activities of the Project on Ethnic Relations (PER) in Romania, Macedonia, Montenegro, Kosovo, and Serbia. It explores five operational principles that guide PER activity: creating credible, neutral forums for dialogue; maintaining momentum; working within political realities; encouraging indigenous solutions from within existing processes; and acting with the backing of powerful states. These principles explain PER's success as a "weak mediator" of ethnic conflicts. According to this analysis, PER also exhibits organizational characteristics that contribute to success, including nonpartisanship, area expertise and extensive networks of local contacts, and an ability to secure the trust of local actors.
A significant indicator of the success of PER activities is the establishment by conflicting parties of institutionalized mechanisms for addressing their differences. Contrary to the view that electoral competition contributes to conflict, this study finds that the possibility of achieving an electoral advantage by participating cooperatively in conflict resolution activities creates incentives for local actors to recognize opportunities offered by PER activities and leads local actors to heed PER's advice. Finally, the article offers a cautionary observation. While PER's perceived influence with major international actors may contribute to its local successes, once a state actor with the power to impose a solution has committed itself to ending a conflict, its preferences outweigh any local interests in determining the outcome and renders the efforts of a "weak mediator" such as PER irrelevant.
