《联合国反腐败公约》预防机制透视及其启示

《联合国反腐败公约》提出,治理腐败犯罪必须建立一套科学的、可行的、综合的社会预防机制。这一机制的提出,对于健全和完善我国反腐败机制,特别是对反商业贿赂犯罪机制的建立和完善具有一定的借鉴价值。

电信增值服务法律问题思考——以电信运营商的特殊义务为视角

电信增值服务具有信息化、虚拟化等特征,服务中涉及的问题较多,由此引发的纠纷呈上升趋势。目前,对其调整偏重于管制,一定程度上忽视了市场法则作用的发挥,效果不理想。因此,有必要从剖析电信增值服务合同、移动增值业务合作协议以及电信服务合同入手,理顺电信增值服务的法律关系,确立以市场规则为主的法律调整手段。针对电信增值服务关系的所具有的特殊性,论文从合同效力扩张的角度,阐述了电信运营商在电信增值服务关系中的特殊地位,建议让电信运营商承担起特定的义务。最后,笔者还就如何通过保障信息的充分性来维护用户的利益谈了自己的思路和建议。     

当前我国行政许可制度存在的问题及对策分析

行政许可作为行政机关管理社会政治、经济、文化等各方面事务的有效手段,目前存在一系列问题,这些问题不仅严重阻碍统一市场经济体制的建立,也影响了行政效率和政府形象,给公民、法人带来日益沉重的负担。为此,笔者在对我国行政许可制度存在的各种问题进行分析研究的基础上,提出了健全和完善我国行政许可制度的设想和建议。

如何处理《反垄断法》与行业性规制立法、反垄断机构与行业监管机构的关系是《反垄断法》起草中所需要解决的重要问题。参照其他国家(地区)的相关立法及在结合我国实际的基础上,本文提出了理解《反垄断法》和行业立法在反垄断规制问题上的“一般法”和“特殊法”关系的基本原则,及合理配置反垄断机构与行业监管机构管辖权的具体思路,并在上述分析借鉴的基础上提出了相应的立法建议。

Fiscal Decentralization,Flat Administrative Structure,and Local Government Size: Evidence and Lessons from China

This paper examines the effects of fiscal decentralization and flat administrative structure on local budget size and program outlays. We test three related theoretical hypotheses in China's adoption of province‐over‐county scheme of financial administration. We provide evidence that both decentralization of expenditure and decentralization of revenue increase the size of local budgets; that the impact of the former far outweighs that of the latter with local budgets on a rising trajectory; and that discretion grants localities more means to increase their budget. These results show that as China's reform deepens the proportion of local outlay on administration declines because of more local discretion from eliminating the prefecture bypass between the province and counties. But neither decentralization nor increased local discretion has allocated more local resources for education, and both contribute to increasing outlay on economic development. The paper formulates tentative policy recommendations that carry potential application for other countries. Copyright © 2016 John Wiley & Sons, Ltd.     

Molecular Pathology of Pulmonary Edema in Forensic Autopsy Cases with Special Regard to Fatal Methamphetamine Intoxication

Pulmonary edema is a common finding in fatal methamphetamine intoxication. However, the underlying mechanism remains poorly understood. This study investigated the molecular pathology of alveolar damage involving pulmonary edema in forensic autopsy cases. Seven candidate reference genes (RPL13A, YWHAZ, GUSB, SDHA, GAPDH, B2M, and ACTB) were evaluated in the lung by the geNorm module in qBase^plus software. RPL13A, YWHAZ, and GUSB were identified as the most stable reference genes. Using these validated reference genes, intrapulmonary mRNA expressions of matrix metalloproteinases (MMPs), intercellular adhesion molecule‐1 (ICAM‐1), claudin‐5 (CLDN‐5), and aquaporins (AQPs) were examined. Relative mRNA quantification using TaqMan real‐time PCR assay demonstrated higher expressions of all markers except for AQP‐5 in fatal METH intoxication cases. These findings suggested alveolar damage and compensatory response in fatal METH intoxication cases. Systematic analysis of gene expressions using real‐time qPCR is a useful tool in forensic death investigation.
