We investigate the associations among physical appearance, threat perceptions, and criminal punishment. Psychological ideas about impression formation are integrated with criminological perspectives on sentencing to generate and test unique hypotheses about the associations among defendant facial characteristics, subjective evaluations of threatening appearance, and judicial imprisonment decisions. We analyze newly collected data that link booking photos, criminal histories, and sentencing information for more than 1,100 convicted felony defendants. Our findings indicate that Black defendants are perceived to be more threatening in appearance. Other facial characteristics, such as physical attractiveness, baby‐faced appearance, facial scars, and visible tattoos, also influence perceptions of threat, as do criminal history scores. Furthermore, some physical appearance characteristics are significantly related to imprisonment decisions, even after controlling for other relevant case characteristics. These and other findings are discussed as they relate to psychological research on impression formation, criminological theories of court actor decision‐making, and sociological work on race and punishment.  相似文献

This article examines the effect that the spatial location of conference committees relative to the parent bodies has on congressional policy outcomes. The article presents a theoretical model proposing that conferees choose policies that maximize their policy utility subject to the constraint of gaining House and Senate majorities on the conference report. I tested the model using conferences on bills associated with votes that generated liberal‐conservative divisions. The results confirm that, under specified conditions, conferees pull outcomes away from the parent bodies toward conferee preferences.  相似文献

Much attention has been paid to government ‘blunders’ and ‘policy disasters’. National political and administrative systems have been frequently blamed for being disproportionately prone to generating mishaps. However, little systematic evidence exists on the record of failures of policies and major public projects in other political systems. Based on a comparative perspective on blunders in government, this article suggests that constitutional features do not play a prominent role. In order to establish this finding, this article (a) develops theory‐driven expectations as to the factors that are said to encourage blunders, (b) devises a systematic framework for the assessment of policy processes and outcomes, and (c) uses fuzzy‐set qualitative comparative analysis to identify sets of causal conditions associated with particular outcomes (i.e., blunders). The article applies this novel approach to a set of particular policy domains, finding that constitutional features are not a contributory factor to blunders in contrast to instrument choice, administrative capacity and hyper‐excited politics.  相似文献

We consider two interpretations of the role of external inspection in the public services in the UK in the context of publicly funded, work‐based training programmes for young people. The first is that inspection provides substantive information to buyers concerning training quality, thereby improving efficiency in the ‘training market'. The second is that it provides procedurally oriented reassurance concerning service quality to government and the public, irrespective of substantive quality. Evidence is drawn from the inspection procedures and reports of the Adult Learning Inspectorate between 2001 and 2005. The inspectors rated training providers on various attributes, some clearly procedural, others potentially substantive. We find that while inspectors took both procedural and substantive dimensions of training into account in judging the quality of a provider's services, they attached considerably more weight to procedural than to substantive attributes. In particular, they undervalued the trainee completion rate, despite its potential association with the substantive quality of training and the priority the government attaches to raising it. These results are interpreted as evidence of limited validity in inspection findings, which do little to resolve information asymmetries in the UK training market.  相似文献

The impact of childhood trauma can be substantial and long term. Prevention of additional trauma should be the guiding principle for all professionals working with children in the child welfare and juvenile court systems. This article addresses ways these two systems can protect and support children before they enter the courtroom. This is accomplished by obtaining, sharing, and utilizing a complete trauma history on the child, as well as putting measures in place to protect against system‐generated trauma. It will also address how to reduce the trauma associated with testifying using psycho‐educational programs, and involving a caring, sensitive judge.  相似文献

Peer delinquency is a robust correlate of delinquent and criminal behavior. However, debate continues to surround the proper measurement of peer delinquency. Recent research suggests that some respondents are likely to misrepresent their peers’ involvement in delinquency when asked in survey questionnaires, drawing into question the traditional (i.e., perceptual) measurement of peer delinquency. Research also has shown that direct measures of peer delinquency (e.g., measures obtained via networking methods such as Add Health), as compared with perceptual measures, differentially correlate with key theoretical variables (e.g., respondent delinquency and respondent self‐control), raising the question of whether misperception of peer delinquency is systematic and can be predicted. Almost no research, however, has focused on this issue. This study, therefore, provides detailed information on respondents’ misperceptions of peer behavior and investigates whether individual characteristics, the amount of time spent with peers, and peer network properties predict these misperceptions. Findings indicated that 1) some individuals—to varying degrees—misperceived the delinquent behavior of their peers; 2) self‐control and self‐reported delinquency predicted misperception; 3) respondents occupying densely populated peer networks were less likely to misperceive their peers’ delinquent involvement; and 4) peers who occupy networks in which individuals spend a lot of time together were more likely to misperceive peer delinquency. Parties value unity, yet members of parliament have incentives to deviate from the party line. This article examines how members of the European Parliament (EP) respond to competing demands from national parties and European party groups. We examine ideological shifts within a single parliamentary term to assess how election proximity affects party group cohesion. Our formal model of legislative behavior suggests that when EP elections are proximate, national party delegations shift toward national party positions, thus weakening EP party group cohesion. Our Bayesian item‐response analysis of roll calls in the 5th EP supports our theoretical predictions.  相似文献
