Electronic evidence: A proposal to reform the presumption of reliability and hearsay

There is a general concern amongst judges, lawyers and legal scholars that evidence in digital format is not to be trusted, given that it can be altered and manipulated with ease. Some jurists have called for a UN Convention on matters relating to the authentication and admissibility of electronic evidence. It is debatable whether such a Convention is necessary, but guidance of an international nature might be welcome, providing that any such guidance remains guidance, and does not ossify into legal requirements that fail to take into account the dynamic and constantly developing changes in information technology. In any event, the accuracy of the presumption in England & Wales that a computer is in order at the material time is highly debatable, and it is suggested that this presumption ought to be reformed.     

Longitudinal Associations of Alcohol Involvement with Subjective Well-Being in Adolescence and Prediction to Alcohol Problems in Early Adulthood

Adolescent alcohol involvement is associated with numerous negative outcomes, but also appears to have positive correlates, including subjective well-being. Additional research is needed to understand these paradoxical findings. The current study examines alcohol use, adverse alcohol-related (and other substance-related) consequences, and subjective well being in adolescence, and prediction to problem alcohol use in early adulthood. Participants in this longitudinal study, which extended from age 11 to age 21, were 208 rural teens (109 girls) and their families. Covariates included early substance use, early conduct problems, early depressed mood, gender, and parent educational attainment. Structural equation modeling showed that subjective well-being at age 16 positively predicted increased alcohol use at age 18. Alcohol use was not a significant predictor of subjective well-being; however, alcohol use at age 18 positively predicted alcohol problems at age 21, even while controlling for earlier adverse consequences and other predictors. Results help to further elucidate both the negative and positive correlates of underage drinking, and support the value of delaying alcohol initiation.     

Remembering the family home: emotions,belonging, and migrant men in multicultural Australia

Abstract

The article opens a space in which to discuss migrant men's emotions and their engagement with family life. It focuses on Australia's Goan community to explore the fluidity of ethnic identity and its relation to remembered family and childhood. The article suggests a “family” that is not only a domestic home but is constituted across both time and space. The men's memories of their childhood and family life prior to arrival in Australia are central to their constitution of self within Australia. These memories provide the men with the emotional means to contest their positioning in Australia's multicultural framework. The men's memories of childhood are experienced beyond domestic and multicultural spaces, making remembered families an important part of their work lives and sense of success in Australia.     

Nanotechnology,Nanomaterials, and the Potential for Regulatory Action by USEPA

The U.S. Environmental Protection Agency (USEPA) has recently taken steps toward directly regulating the potential environmental, health, and safety risks associated with the manufacture and use of nanomaterials, and indications are that it is considering additional regulatory action. More particularly, the agency appears ready to start relying more on the exercise of its existing statutory authorities—including the Toxic Substances Control Act and the Federal Insecticide, Fungicide and Rodenticide Act—than on voluntary industry efforts to address these potential risks. As a result, companies that work with nanomaterials should pay close attention to USEPA's activities in this arena.     

Alaska public health law reform

The Turning Point Model State Public Health Act (Turning Point Act), published in September 2003, provides a comprehensive template for states seeking public health law modernization. This case study examines the political and policy efforts undertaken in Alaska following the development of the Turning Point Act. It is the first in a series of case studies to assess states' consideration of the Turning Point Act for the purpose of public health law reform. Through a comparative analysis of these case studies and ongoing legislative tracking in all fifty states, researchers can assess (1) how states codify the Turning Point Act into state law and (2) how these modernized state laws influence or change public health practice, leading to improved health outcomes.

Technology transfer: A shortcut in danger of short circuit

At cocktail parties, in board rooms, at workstations, in classrooms, and in government offices, “technology transfer” is bandied about as if it were some natural phenomenon, a technological tsunami overwhelming everything in its path. Technology transfer, it is sometimes suggested, is an El Niño in business, government, industry, and even education decision-making, and for some it has meant disruption, dislocation, and danger. For others, technology transfer has been the vanguard of progress and an inexhaustible fountain of productivity, empowerment, and convenience. For all, “technology transfer” today is too often a personal shortcut in our communication that points to unintended meanings or implications. Just whatis “technology transfer,” anyway? To move beyond knee-jerk advocacy or damnation of technology transfer on the questionable basis of faith, and to lay out a new dimension to the definition, understanding, and acceptance of technology transfer that is clear and understandable to any layman, is the purpose of this paper. It is based on a selective yet careful web search, since the Internet World Wide Web is a principal source for information in the growing debate about public policy issues.
