ABSTRACT

Copyright is inherently intertwined with the development of technology and none more so than the advent of the Internet and sharing technologies. More recently, social media platforms have become the latest challenge for copyright law and policy. This article builds on the literature that recognises the underlying conflict between copyright and social networking sites (SNSs); namely that the basic implication of copyright is the restriction of copying, whereas the ethos of social networking is the promotion of sharing. In particular, this article focuses on the disparity between the restricted acts of copying and communication to the public under copyright law and the encouragement of sharing on SNS Instagram. In doing so, it contextualises the debate surrounding copyright and social media and provides an understanding of the legal implications of using Instagram. As such this paper analyses (1) the infringement of copyright protected work on Instagram, and (2) the user-agreement and licensing of copyright material on Instagram. This study concludes that the disparity between the principles of copyright and social media lead to confusion and vulnerability of users. Therefore, it is suggested that Instagram should better inform its users of the implications of sharing third-party content as well as the terms of its user agreement. This could be done by implementing a copyright strategy, which includes a notice and takedown system as well as investing in producing educational content for users. Perhaps SNSs, such as Instagram might be more motivated to take steps to recognise intellectual property rights if they were considered Internet Services Provides such as YouTube.  相似文献

ABSTRACT

In public archives there are a number of hand-embroidered cloths worked by suffragettes incarcerated in Holloway Prison between 1911 and 1912. Denied political status, some of the embroiderers used the hunger strike as a political tool and were forcibly fed. In this paper the embroideries are reframed as material and discursive evidence of suffragette prison experiences. The material narratives of the embroidered cloths are traced, drawing on a dialogue between critical theory, material object enquiry, practice as research and the work of contemporary textile practitioners. Embroidering by suffragettes is explored as an embodied and situated ‘thread act’ that materialised the making of networks, the need for protection of the body and mind, the powers and dangers of boundary crossing, and proto-political thinking.  相似文献

Abstract

This article reports and discusses the results of a study that investigated photographic images of children in five online terrorist magazines to understand the roles of children in these groups. The analysis encompasses issues of Inspire, Dabiq, Jihad Recollections (JR), Azan, and Gaidi Mtanni (GM) from 2009 to 2016. The total number of images was ninety-four. A news value framework was applied that systematically investigated what values the images held that resulted in them being “newsworthy” enough to be published. This article discusses the key findings, which were that Dabiq distinguished different roles for boys and girls, portrayed fierce and prestigious boy child perpetrators, and children flourishing under the caliphate; Inspire and Azan focused on portraying children as victims of Western-backed warfare; GM portrayed children supporting the cause peacefully; and JR contained no re-occurring findings.  相似文献

Abstract

In a crisis, aid providers deliver humanitarian relief across a hierarchy of organisations where influence and capacity map to their scale of operations. On the front lines of crises, ‘citizen aid’ is what small, local and informal groups offer to fellow citizens. These citizen aid groups are well-networked in place and tend to work through longstanding personal relationships. In the Philippines, citizen aid groups frequently support their activities by documenting their work with photos of beneficiaries to solicit donations from within the country and around the world across social media platforms. This paper builds on recent debates on brokerage through a case study of citizen aid in the relief effort after Typhoon Haiyan (2013–2017). Using this case-study approach, we demonstrate how social media has produced novel forms of brokerage shaped by circulating images online. This new kind of brokerage involves a layered network of brokers that both shapes citizen aid efforts and creates new channels for localising aid, enhancing the control of citizen groups in the Global South over aid.  相似文献

This paper draws on recent research examining feminist and everyday geopolitics to focus on the relatively neglected domestic sphere as a space where geopolitical events like the Falklands/Malvinas war are learnt, (re)produced, remembered and contested by young people. It presents qualitative data drawn from interviews with young people from Argentina (Río Gallegos) and the Falkland Islands (Stanley), locations with intimate connections to the 1982 war. It argues that research in domestic environments that engages the familial relations, objects and practices that embody geopolitical pasts can help make sense of how young people (are able to) express geopolitical agency.  相似文献

This article considers the sentencing of two eighteenth centuryparricides, one committed by a daughter, the other by a son. In eachcase the sentencing remarks are first subject to generic analysis,derived from the work of Rukiya Hasan and Susan Urmston Philips. Withinthose thematic structures there is a traditional rhetorical analysis. Bycombining both types of analysis one can demonstrate the salientfeatures of each set of judicial remarks. The focus of the article thenshifts from these texts to their contexts, and reveals features in theiroffence narratives which have been omitted in these otherwise powerfulrhetorical utterances. There is widespread concern that higher education is being compromised by being turned into a ‘commodity’ to be ‘consumed’. This article represents an initial attempt to explore the trends in both the UK and US, and considers how the law has responded to them. It argues, however, that there is an important distinction to be drawn between ‘commodification’ and ‘consumerism’. Education has always been a commodity to be bought and sold; the true danger lies in the move to a ‘rights-based’ culture where students (and politicians) see education merely as something to be ‘consumed’ rather than as an activity in which to participate. Whilst the law seems thus far to have been something of a bulwark against this movement, it remains an open question as to whether this will continue to be the case if HEIs do not themselves act more proactively in challenging this damaging view of higher education.  相似文献
