我国患者近亲属参与医疗决定之法律研究

我国理论界关于患者近亲属参与医疗决定的利弊之争由来已久,实践中各部门和院方也表现出不同的态度和做法。然而,以往各学者的论证也只是将焦点放在患者单方的利益,而少有人关注患者近亲属的合法权益。他们把患者的医疗活动看得过于理想化、无涉他性,完全忽视了患者医疗权利的追求要受到其家庭利益和其近亲属利益的限制。权利的行使是有界限的,在关注患者自主权时,既要立足于我国国情,也要对患者近亲属的合法权益进行考量和保护。     

Teen Choices,an Online Stage-Based Program for Healthy,Nonviolent Relationships: Development and Feasibility Trial

This article describes the theoretical foundation, development, and feasibility testing of an online, evidence-based intervention for teen dating violence prevention designed for dissemination. Teen Choices, a program for healthy, nonviolent relationships, relies on the transtheoretical model of behavior change and expert system technology to deliver assessments and feedback matched to stage of change for using healthy relationship skills. The program also tailors feedback to dating status, risk level, and other key characteristics. Ninety-nine students from high schools in Tennessee and Rhode Island completed a Teen Choices session and 97 completed an 11-item acceptability evaluation. Of participants, 100% completed the intervention session as intended. Evaluations of the program were favorable: 88.7% agreed the program feedback was easy to understand, and 86.7% agreed that the program could help people develop healthier relationships. Findings provide encouraging evidence of the acceptability and feasibility of this approach to dating violence prevention.

Indigenous Peoples in Commonwealth Countries: The Legacy of the Past and Present-day Struggles for Self-determination

Abstract

Although the UK has no indigenous peoples as understood by the UN, its earlier colonial policies in Africa, the Americas, Asia and the Caribbean have had consequences for today’s first peoples Colonial policies that deprived the native populations of their lands, resources and self-determination were generally pursued by the independent states that came in their wake. Today the world’s indigenous peoples are looking to bring to an end their colonial-type situations and re-establish control over their lands and futures. After more than 20 years, the United Nations adopted a Declaration setting out the rights of indigenous peoples, but several Commonwealth countries were unrelenting opponents. This article looks at the colonial heritage as it affects indigenous peoples in the Commonwealth countries, some of the contemporary struggles and situations that have marked the last years, and tries to understand why countries such as Australia, Canada and New Zealand were the last to accept that indigenous peoples had a right to self-determination.     

Trapping Constituents or Winning Hearts and Minds? Rebel Strategies to Attain Constituent Support in Sri Lanka

Why do rebels choose violence over non-violent methods to attain the cooperation of their constituency in the war against the government? This article assesses the importance of rebels' dependency on constituent support through a case study of the LTTE in Sri Lanka. The empirical findings suggest that dependency largely results in non-violent measures. However, a multitude of passive coercion methods – broadly unaccounted for by existing theory – evolve over time in the form of territorial and social entrapments. This implies that rebels do not need the hearts and minds of their people to wage war at later stages of conflict. Time pressure, however, appears to result in violence.     

Aspects of childhood in rural Greece: Children in a mountain village (ca. 1900–1940)

This essay examines childhood in a mountain village in central mainland Greece during the early 20th century and the interwar period. It gives an overview of an analytical case study conducted by the author within the context of the project “Historical Archives of Greek Youth” at the Greek National Research Center. The article draws on various sources, although principally on oral evidence. After a brief survey of the general and local socioeconomic context, it looks at children's lives and socialization inside and outside the household, focusing on family economy and interfamilial relationships within the context of home, school, community, and play, and tracing the relations of these domains to family and household. It points to the existence of childhoods rather than childhood, defined by gender and the specific socioeconomic position of the family. It argues that rural mountain society in Greece did not see its future in agriculture and examines the extent to which school education of boys functioned as a means of family urbanization and social mobility. Children alternated between traditional social structures and urban living patterns.     

Victim–Offender Mediation in Cases of Intimate Relationship Violence—Ideals,Attitudes, and Practices in Finland

In Finland the first experimental mediation projects founded on the principles and ideals of restorative justice were started in the beginning of the 1980s. Before the Act on Mediation in Criminal and Certain Civil Cases (1015/2005) came into force in 2006, mediation services were provided by cities, municipalities, and non-governmental organizations. Victim–offender mediation (VOM) practices varied, and there was minimal guidance and supervision by state authorities. The Act (1015/2005) aimed to standardize mediation services and practices and enable evaluation of VOM in order to provide solutions to some of the issues raised regarding mediation in intimate relationship violence (IRV). The Act states that only police or prosecutors may initiate the process for referring a case that involves intimate relationship violence. Furthermore, mediators/facilitators who handle IRV cases are required to attain further training. This article examines the ideals, attitudes, and practices of VOM in relation to intimate relationship violence in Finland. The aims and ideals stipulated in the Act on Mediation are presented and later compared to actual practices of VOM which were obtained through the review of documented agreements. These were the end-results of VOM in cases of intimate relationship violence. The empirical data also included a questionnaire sent to mediators in three offices as well as a national questionnaire sent to prosecutors.

The Bush administration has been too quick to dismiss containment as an obsolete hangover of the Cold War. Appropriately modified to operate through international institutions and regional alliances, containment provides the most viable available basis for responding to terrorist threats emanating from rogue regimes and weak states.     

The Politics of the Minimum Wage in Hong Kong

This article provides an account of the recent introduction of a minimum wage in Hong Kong in 2011. Traditional welfare state theories had their origins in rich democracies. We refine the theoretical arguments in accordance with the semi-democratic nature of Hong Kong. We argue that the legislation was initiated reluctantly by the business-friendly government under unfavourable economic conditions. Any subsequent concessions to labour were not attributable to labour strength or political oppositions, which were very weak. Instead, multiple miscalculations by the politically dominant business side allowed the labour movement to gain limited grounds throughout the struggle. We also apply our arguments to the case of Singapore, illustrating how welfare state theories can be adapted to less democratic systems.
