俄罗斯与欧盟的经济关系

在当今的国际关系格局中,俄罗斯与欧盟的关系占据着重要的地位,其中双方的经济关系由于发展迅速更是备受世人关注。俄罗斯独立以来,特别是进入21世纪以后,出于各自的需要,俄欧双方积极展开了在贸易、投资和能源等经济领域的全面合作,并取得了相当大的成效。短期内,俄欧经济关系仍将维持以能源合作为主,其他合作为辅的基本格局,长期来看,俄欧经济关系能否取得突破主要还是取决于俄罗斯能否逐步完善市场经济体制的改革,改变畸形的经济结构并尽快恢复和扩大加工工业产品的出口。     

中国（上海）自贸区刑法个罪的修正适用

中国（上海）自贸区的设立无疑将会产生巨大的经济冲力，同时也会对《刑法》的普遍适用产生强烈影响。在自贸区制度创新过程中，刑法相关个罪或将产生新的内涵。此外，由于奉行支持创新、倡导自由的理念，自贸区还将出现大量刑法特殊适用的情形。如何在自贸区刑法普遍适用和特殊适用之间找准法律与经济的平衡点，成为摆在刑法理论与实务界面前的共同课题。因此，在不偏离自贸区改革创新轨道的前提下，寻求《刑法》在自贸区的修正适用，才是自贸区刑法革新的应有之义。     

Information Asymmetry and the Financial Consumer Protection Policy

As complex structure of financial products severely limits consumers' understanding and causes an information asymmetry, the need to protect financial consumers has been a target of heated debates. This study designs a game theory-based model and presents that the reason behind an inadequate advisory service by financial institutions is a combination of consumers' poor financial literacy and sellers' abuse of such weakness to pursue their own profits. Our model shows that when there is information asymmetry on both product characteristics and investment preference of financial consumers, having competing companies that offer substitute products is not enough to ensure a proper advisory service. Two measures may be considered to address this issue. The first measure would be voluntary market efforts to strengthen financial consumer's literacy and self-regulatory mechanism. The second measure would be to step up administrative regulations on financial product sellers in both ex-ante and ex-post mechanisms.     

粤港澳大湾区养老服务业协同发展研究

养老服务业协同发展有利于粤港澳大湾区深层次融合,保障老年人养老权益的实现和促进经济社会全面发展。大湾区养老服务业在资源禀赋方面存在互补关系,且三地政府也注重在养老服务领域开展合作。但当前的合作中存在着发展水平较低、制度间协调不足和专门合作机制缺位等问题。在协同发展理论指导下,粤港澳大湾区养老服务业合作的重点是打破发展过程中的体制、机制障碍。对此建议制定协同发展规划、创新协同治理机制、提升养老服务法治化水平和加强新兴养老服务领域合作。     

“We feel that our strength is on the factory floor”: Dualism,shop-floor power,and labor law reform in late apartheid South Africa

ABSTRACT

This article explores the transformation of South African labor relations during the 1980s. In 1979, prompted by new shop-floor militancy, the Wiehahn Commission recommended that black workers, previously excluded from state labor machinery, be permitted to join recognized trade unions. Most discussions of this shift in apartheid labor relations focus on the ensuing debate within the black unions, torn between preserving their independence or securing state legitimation. This article looks instead at the related debate about ‘levels of bargaining’: should emergent black unions demand to negotiate at the factory level, where they had secured shop-floor strength through organizing and democratic practice, or pursue the benefits of the corporatist bargaining structures that had long excluded them and had privileged white workers? The eventual drift towards corporatism, I argue, imprinted the character of the South African labor movement into the post-apartheid era. An understandable desire to wield influence at the level of the national political economy eroded the tradition of workers’ control, shop floor democracy, and struggle unionism that black unions had forged during the 1970s and 1980s.     

中国青年志愿服务的支持体系分析

志愿服务的支持体系由支持和保障志愿行动发展的政策、智力、资金、资源等组成,包括社会环境因素和组织内部因素。中国青年志愿服务经历了单一支持体系向拓展支持体系、多元支持体系、综合支持体系变化的过程;支持体系的结构包括党政支持体系、群团支持体系、社团支持体系、公众支持体系、专业支持体系和传播支持体系等;支持体系的要素包括政策、资金、人力、品牌等。在加快社会建设、创新社会治理的背景下,青年志愿服务支持体系建设要注重统筹协调、联盟合作、专业提升和国际发展。     

“被迫”与“自愿”：民办教育企业课程咨询员加班现象研究 —— 基于对 T 市 DN 公司的田野调查

随着经济的快速发展,白领群体因频繁加班导致的"过劳死""抑郁症"现象层出不穷,白领群体的"加班"已经成为当前职场中的常见现象。近些年又出现了"无薪加班""自愿加班"等一些新的加班现象,极大地影响了白领群体的生活质量甚至身体健康,因此受到了学术界的广泛关注。其中,"民办教育机构课程咨询员"的自愿加班不容忽视。调查发现,种种"自愿加班"背后其实隐藏着难言的"被迫手段"。研究选取T市一家大型民办IT教育机构的课程咨询员作为调研对象,利用布洛维的"赶工游戏理论"和戈夫曼的"拟剧理论",同时引入"关怀文化"的概念对加班的维持方式进行探索。研究得到三个结论:1.民营企业管理者在制定"游戏规则"时,"后台规则"是导致加班的根本原因;2."关怀文化"是缓解两种规则冲突的调和手段;3."自愿加班"现象虽然看似是员工极具奉献精神的体现,但实际上背后是由一整套制度逻辑所"推动"的。     

ROYAL WRIT AND BRITISH RESIDENCY IN THE SULTANATE OF BRUNEI: A FLUID PARTNERSHIP

The aim of the article is to explore and illustrate some “dynamics of transition” across some six decades of British protection of the Brunei Sultanate, 1906-1967, with particular reference to the interaction of traditional administration and the new system of governance of a Residency, especially in the part of Tutong district that was home to the Dusun/Bisaya ethnic minority.     

新公共管理语境下的服务型警务构建

新公共管理理论源于西方各国政府改革的实践，是一种新的公共行政理论和管理模式。其基本思想为：政府的管理职能是掌舵，应当以顾客为导向，引入市场竞争机制，适当分权，让公众参与管理，并且对政府管理行为进行绩效评价。这些理论对公安机关的警务工作具有一定适用性，以新公共管理理论为指导。构建服务型警务模式的路径选择有：科学定位职能，突显警务模式的服务性；构建参与式警务模式，实现警民共治；借鉴“3E”思想，强化绩效评估和成本效益；引入市场竞争机制，推进警务社会化：建立健全监督机制，推行阳光警务。
