积极推进禁吸戒毒“外转内”工作努力实现社会面上无吸毒人员的目标

处在全国禁毒前沿的云南公安机关在总结 10多年来禁吸戒毒工作经验中由基层首创、并进行试点的基础上 ,走出了一条“外循环”转“内循环” ,实行劳动康复管理模式的禁吸戒毒工作新路子。自 2 0 0 1年全省推行对吸毒人员的收戒方式“外转内”以来 ,实践证明 :工作开展好的地方 ,通过全员收戒吸毒人员 ,实现社会面上无吸毒人员的目标 ,就能够遏制社会面上的毒品需求 ,有利于逐年减少吸毒人员 ,为创建“无毒县市”、“无毒乡镇”、“无毒社区”奠定良好的基础 ,促进整个禁毒斗争的顺利开展。     

虚报注册资本罪探微

虚报注册资本、骗取公司登记的问题比较严重。本文在犯罪构成理论的基础上,主要从司法实务中可能遇到的情况出发,探讨在司法中认定“虚报注册资本罪”中应注意的几个问题,以求公正司法。     

我国对外资银行金融监管体制的设计与创新

我国对外资银行主要实行市场准入、业务经营、资本金、税收方面的监管,但存在的问题不少,主要是监管目标的错位,导致不正当竞争,监管法律不完善等。问题的原因在于监管法治化水平不足、监管目标混乱、体制不合理。解决办法有两方面：一是宏观模式的选择,二是微观规制的创新     

Public Service Motivation,Organizational Social Capital,and Knowledge Sharing in the Korean Public Sector

This article investigates whether public service motivation (PSM) and organizational social capital predict knowledge sharing in the public sector. The hypothesized relationships in the proposed model are verified with the online survey data of 506 public employees in Korea. The test results show that the two dimensions of PSM (attraction to public service and commitment to public values) and the trust component of organizational social capital are both positively related to knowledge sharing in the Korean public sector, and that the associability component of organizational social capital is indirectly associated with knowledge sharing through its influence on PSM. The article discusses the ways that PSM and organizational social capital may contribute to overcome the social dilemma of knowledge sharing in public organizations. It also suggests that there is need for further research on the individual dimensions of the PSM construct.     

Patriarchal unions = weaker unions? Industrial relations in the Asian garment industry

This paper explores how gender ideologies shape industrial relations in the Asian garment industry. Drawing on ethnographic research, it illustrates how widespread norm perceptions of acquiescent women and assertive men reinforce patriarchal, authoritarian unions. Even if privately critical, women may be reluctant to protest if they anticipate social disapproval. Such beliefs reinforce patriarchal unions, curbing women workers’ collective analysis, engagement, and activism. This weakens the collective power of labour to push for better working conditions. Tackling norm perceptions and building more inclusive unions may help strengthen the labour movement.     

社会资本视角下的农民市民化水平实证研究——“上楼农民”与“居村农民”的比较

社会资本在农民市民化进程中发挥着不可替代的作用。因此,社会资本层面的市民化是当前农民市民化问题研究的重点所在。通过对上楼农民和居村农民在户籍类型、地位差异、劳动与休假、社会交往和政治参与等社会资本层面市民化水平的比较,得出的结论是:从社会资本层面来看,上楼农民的市民化水平高于居村农民。为了有效提高居村农民在社会资本层面的市民化水平,必须要结合自下而上的民间自发型积累和自上而下的政府推动型培育两种方式,有效发挥政府和民众的积极性。     

REASSESSING RACE DISPARITIES IN MARYLAND CAPITAL CASES*

A generation of research studies that were conducted in multiple states and covered different time periods has found evidence that individuals who kill white victims encounter a greater risk of facing the death penalty than killers of black victims. More recently, research has also examined the likelihood of death penalty processing for black defendants who kill white victims in comparison with other defendant–victim race groups. In particular, a study in Maryland conducted by Paternoster et al. (2003) found evidence that offenders in black defendant–white victim cases were more likely to be death noticed by prosecutors and to receive a death sentence than other offenders. A recent analysis by Berk, Li, and Hickman (2005) raised questions about some of these findings. In this article, we conduct new analyses and conclude that black defendants who kill white victims face a greater risk of adverse treatment than other types of defendants.     

新旧《公司法》最低资本额制度之比较

我国旧《公司法》对公司最低出资额的规定较为严格，不仅公司设立的门槛，不利于经济的发展，而且不能有效地保护债权人的利益。新《公司法》对有限责任公司最低资本额制度作了较大的修改。此次修改顺应了我国目前经济发展形势，适应了国际竞争的环境。新《公司法》最低资本额制度对我国经济发展具有积极的作用。
