ABSTRACTHow do actors come to contest previously uncontested background ideas? This is a difficult question to ask. On the one hand, deep backgrounds seem to be too foundational for actors to transform. Their political efficacy appears to end where ideas constitute their efficacy in the first place. On the other hand, ideas must not be reified. Even deeply taken-for-granted ideas do not always stay the same, and agents have a lot to do with these changes. In order to answer this question, we draw from social theory and rhetorical studies. We conceptualize the deep background as nomos, and the more easily accessible background as endoxa. We then proceed to identify three sets of conditions that make nomic change possible. These relate to opportunity, message, and messenger. Nomic change becomes possible when the need for something new has become widely established and a supply of new nomic ideas is easily available (opportunity); new nomic ideas are ‘smuggled’ into more orthodox and widely resonating arguments (message) as well as rhetorical encounters in which these arguments are made; and advocates are widely recognized as interlocutors (messenger). A plausibility probe of nomic contestation about nuclear governance provides evidence for this framework. 相似文献

ABSTRACTDuring the Eurozone crisis, the so-called ‘Merkozy duumvirate’ emerged as an informal, but highly visible EU policy-making pattern. This article asks why such forms of decentralized bargaining emerge and what this implies for the theory of EU institutions. According to an approach based on negotiation theory, the article argues that Merkozy is a strategic tool used by Germany to realize its preferences on EU crisis management. Based on an incomplete contracts theory of EU institutions, instead, the article analyses Merkozy as an informal institution created by France and Germany to avoid being discriminated by supranational institutions. This paper draws on new institutionalist theories to consider how we might characterise the process and outcomes of change occurring in English local government as a result of the UK’s austerity policies. It uses national and local empirical data to argue that changes are best understood as multi-layer processes, whereby radical ‘punctuated’ shifts in national funding can be mitigated to incremental adjustments in service delivery at a local level. However, the paper also suggests that the incremental appearance of change may be temporary, and that diminishing institutional resilience and emergent discursive shifts potentially prefigure a paradigm change in local governance. 相似文献

This article identifies and estimates economic drought vulnerability indicators among communal farmers in South Africa, using an economic vulnerability index based on a household survey of 121 communal farmers. The results show that lack of resources, unemployment, price sensitivity, market access, the level of farm debt, output, on- and off-farm diversification, management, and financial safety nets were the main economic vulnerability variables. Farm debt and financial safety provide the bulk of the vulnerability index. The study’s findings suggest that government should reconsider priorities in the implementation of appropriate policy measures in response to drought. 相似文献

Great changes are underway in how climate and agricultural risks are managed in Vietnam. Uncertainties are emerging regarding the role of the state in managing these risks and what this implies for assumptions regarding hoped-for climate change transformations. Local government control is waning in relation to the expanding roles of the private sector and the growing autonomy of farmers themselves. 强调当事人自我责任的辩论主义是19世纪自由主义思潮在民事诉讼中的反映。辩论主义提供的只是关于民事诉讼基本构造的指导性法理,而不是彻底否定法院职权探知的理由。在辩论主义的百年变迁中,始终伴随着对其内涵的全面限制及法院协助当事人提供事实与证据义务的普遍强化。我国《民事诉讼法》在确立辩论主义原则时,应重视在诉讼资料收集层面当事人与法院的协作,强化法院的实体性诉讼指挥义务并赋予辩论主义新的内涵。 相似文献

Recent interest in the construct of motivation to change among male perpetrators of intimate partner violence (IPV) has led
to development of two self-report measures of this construct: the University of Rhode Island Change Assessment for Domestic
Violence (URICA-DV; Levesque et al. 2000) and the Safe at Home Inventory (SAH; Begun et al. 2003). We examined the internal
structure of these instruments using confirmatory and exploratory factor analyses in a sample of 199 male IPV perpetrators
waiting to begin court-mandated batterer intervention programs. Results indicated that the scales had adequate internal consistency.
However, using confirmatory factor analyses, the hypothesized structural models of each instrument fit the data poorly. Subsequent
models suggested by a series of exploratory factor analyses failed to improve model fit substantially for both scales. For
the URICA-DV, a 3-factor model including items from the Precontemplation, Contemplation, and Action subscales fit the data
adequately. No acceptable model fit could be found for the SAH. Intercorrelations among similar subscales across the two inventories
suggested only a modest degree of intercorrelation (r’s = 0.16–0.52), and a factor structure more dependent on scale of origin than item latent content, suggesting that the scales
assess different facets of the readiness to change construct. These results suggest that before the stages of change construct
can be fully applied to the IPV area, more research and evaluation are needed on how to accurately assess abuser readiness
