三农问题背景中的村民自治

三农问题的解决,需要宏观上的努力,更需要微观上的努力。村民自治,是中国村民自主解决农村公共问题,进行公共管理,提供良好公共服务的重要制度安排。要发展良好的村民自治,关键之一是需要有一个良好的法律安排。因此,系统分析村民委员会组织法的具体规定,着眼于如何完善村民自治,分析其存在的缺陷,提出修改思路,是在制度上解决三农问题的微观保障。     

Competition@eCommerce.eu: An Appropriate European Approach to the Anticompetitive Implications in the Online World

The economic landscape of Europe has undoubtedly been revolutionised over the last few years with the introduction of new technology into business practices. But along with the inevitable benefits a series of antitrust issues have surfaced, which have often disrupted the application of European Competition Law. This article will analyse and discuss the existing legal framework and recent case law with respect to its capacity to pave the way for enterprises to embrace innovation, and argue that – although the current legal system might be satisfactory to a certain extent – the European Commission should make adjustments and promote the idea of self-regulation, if the EU is to be at the forefront of the online world. While latency issues have always existed in IT systems, it is only in recent years that latency has become a significant focal point for both IT suppliers and customers. This paper will provide an overview as to how latency arises in IT systems, why latency is becoming important across a variety of business sectors and then explores some of the prominent legal issues inherent in contracting for low-latency solutions.     

论商会组织的跨法人运作

本文分析了商会跨法人运作的基本形式及主要目的。认为商会跨法人运作会带来商会运作营利化、损害法人人格及公共资源不合理使用等问题;提出了商会跨法人运作的监管对策,应禁止商会成立和控制其它社团;允许商会成立民办非企业单位,但禁止商会形成对民办非企业单位的控制;允许商会跨法人经营企业,但应给予更细致的规范。     

论吉林省农村法律服务体系的构建

在我国城乡一体化进程中,法律服务需求日益增大,农村法律服务体系的构建和完善迫在眉睫.自改革开放以来,吉林省农村虽建立了一些法律服务所,但没有形成完整的体系,仍存在着很多亟待解决的问题.因此,政府应充分发挥建设农村公益法律服务体系的主导作用,发展壮大农村法律服务队伍,建立有经费保障的、公益的农村法律服务体系.     

近代中越关系史研究新论——读王志强著《李鸿章与越南问题(1881~1886)》

王志强博士的新作《李鸿章与越南问题(1881~1886)》选题新颖、视角独特;资料丰富翔实、多国多语种史料交叉分析;观点独到而可信。虽然在近代中越关系史的架构、概念及史料分析方面存在不足,但仍不失为近代中越关系史研究值得关注的一部新作。     

现象·动因·治理:“微腐败”问题研究综述

随着全面从严治党向纵深发展,“微腐败”的治理成为腐败治理的焦点,“微腐败”研究也成为学界研究的热点。就整体现状而言,论文数量可观,成果丰硕;从研究角度来看,主要论题聚焦于“微腐败”的概念、表现形式、形成原因、社会影响和治理措施等方面;就研究趋势而言,“微腐败”的研究呈现出多样性、针对性、系统性等研究态势。尽管“微腐败”研究还存在理论深度不足、实证研究较少、比较研究欠缺等问题,但是,研究的主题、问题、方法、成果等为腐败治理研究拓展了内容和形式,为反腐倡廉建设提供了指导和启示,具有重要的理论和实践意义。     

PTV gap: A new measure of party identification yielding monotonic partisan attitudes and supporting comparative analysis

Despite the cornerstone role of party identification for analyzing voting behavior in the United States, its measurement (in terms of the classic American National Electoral Studies – ANES – seven-point scale) is affected by a systematic problem of non-monotonicity, and it proved impossible to be directly applied outside the United States. We introduce a novel, complementary measurement approach aimed at addressing both problems. We test on US data (an expressly collected computer-assisted web interviewing survey dataset) a new, seven-point scale of partisanship constructed from PTV (propensity-to-vote) items, acting as projective devices for capturing partisan preferences, and routinely employed in multi-party systems. We show that a PTV-based (suitable for comparative analysis) seven-point scale of partisanship outperforms the classic ANES scale. Groups identified by the new scale show monotonic partisan attitudes, and the comparison of multivariate models of political attitudes testify significantly larger effects for the new scale, as well as an equal or higher predictive ability on a range of political attitudes.
