内幕信息是指对证券、期货交易活动具有重大影响且尚未公开的信息。内幕信息的特征和认定标准应当是两个,即未公开性和重要性。未公开性的认定应当采取形式公开为主、实质公开为辅的标准,根据两高最新出台的相关司法解释中的内幕信息形成之时和内幕信息敏感期认定公开时间和公开方式。重要性的认定应当由完全的客观标准向主观标准为主、客观标准为辅的主客观结合认定模式转变。相关性和确定性不是内幕信息的特征和判断标准,它们内在地被消解、融汇在重要性判断中。依循权力分工、制衡的法治精神,行政权和司法权的界分决定了在行政犯(罪)领域,行政监管机关对内幕信息内容和性质认定的行政性判断应当从属于司法机关的司法性判断,司法机关的司法性判断应当具有独立性和终局性。  相似文献

There is a profound disconnect between the practice and scholarly study of security in Europe. The 2010 Internal Security Strategy added disasters such as forest fires, earthquakes, and floods to the list of European Union (EU) internal security concerns, expanding on the more traditional anxieties over militaries, border protection, and the effects of poverty. This article explores how evolving practices of disaster response, a policy area once separate from EU security discourse, have become part of the EU's wider security provision and with what implications. Based on interviews conducted at the Directorate-General (DG) for Humanitarian Aid and Civil Protection (ECHO), it provides a detailed study of three EU disaster response practices – monitoring, training, and information co-ordinating – and their circulation to the wider field of EU internal security provision. It uses this case to outline that new understandings of what it means to “voluntarily co-operate” in European security projects have been radically under-theorized.  相似文献

Existing studies on transnational migration in Southeast Asia tend to view it primarily from labor, human rights, or gender perspectives. Few of these studies have viewed labor migration as a security problem between the countries involved. This article attempts to close this gap in the literature by looking at the case study of labor migration from Indonesia and Malaysia from a security perspective and how it affects the relationship between migrants, citizens, and governments of these two countries. The article utilizes securitization theory introduced by the Copenhagen School to explain why, within the last two decades, Malaysian politicians have shifted their treatment of Indonesian migrants from a policy of toleration to one that considers them a security threat against Malaysian society.  相似文献

Abstract

Developing cultural economists’ concerns with the assembly of agency in financial markets, agency in sub-prime mortgage lending in the United States is shown to have been made up through calculative devices of risk. Credit reporting and scoring provided for the targeting, sorting, pricing and governing of customers in terms of risk. The securitization of mortgages into risk-structured financial instruments made possible extended lending. Interest-only adjustable rate mortgage products called up mortgagors who, as leveraged investors, embraced risk in a rising property market. The current sub-prime mortgage crisis is understood in critical terms as a moment when the contradictions of these risk devices and their incapacity to capture the uncertain future have come to the surface, and agency in sub-prime lending has been disassembled. Cultural economy is thus shown to make a distinctive contribution to the politicization of sub-prime that stresses the ambiguous politics of calculation.  相似文献

This paper reveals the limits to representing cyberspace as a threat. In contrast to more conventional threats, the suggestion is that the not-immediately-apparent consequences of a cyber-attack make it largely reliant on official practices of representation. Exploring the implications of this reliance, the paper outlines how attributing meaning and culpability – always contested practices – are amplified in the potential absence of a readily apparent attack. Given these limits, does the cyber-threat then require a different lexicon of danger to both educate and engender a sense of caution? Examining the discursive construction of the cyber-threat, the paper demonstrates how this threat draws upon an established economy of danger – likening it to warfare and terrorism – but also suggests a limit to these representations. Specifically, by engaging post-structuralist literature the paper illustrates that these limits are best understood through an appreciation of the performative and the constitutive ‘lack’ in signification. It thus concludes that the value of the cyber-threat is not determined by transparently representing a cyber-attack. Rather, it is drawn from processes of hyper-securitization and through the establishment of institutions like the NATO Center of Excellence in Cooperative Cyber Defense that retroactively bring into existence the very object it purports to defend against.  相似文献

对外援助是国际政治学与国际政治经济学研究中的重要议题。一方面,作为一种由援助国提供的特殊性国际公共物品,它是全球治理和国际发展领域的重要变量;另一方面,作为国家的一种对外政策工具,对外援助在国际竞争舞台上发挥着战略性功能。在国际政治中,有志于发展的对外援助都与安全问题息息相关。援助与安全之间的联结经历了从一般关联到深入互嵌再到\"安全化\"的演变历程,安全思维越来越多地影响对外援助过程,冲击着连接援助国和受援国的援助资源载体。面对嵌入对外援助过程的\"安全化\"趋势,通过聚焦援助与安全之间的复杂关系和发展趋势,试图诉诸安全视角来审视援助载体,并因此提出了\"援助安全\"概念框架。该框架致力于从国际结构转型、援助国和受援国关系及相关国家国内政治等不同角度探寻援助过程中财力资源、人力资源与制度资源分别面临的多元安全威胁和风险来源。援助安全可以从技术条件性、透明性、实施预算管理、提供援助安保人员训练和改革全球援助体系等举措得以保障。  相似文献
