A massive open online course (MOOC) entitled “Shaping the Future of Work” (offered through MITx, the Massachusetts Institute of Technology's online learning division) has been the context for a multiparty simulation designed to produce classroom negotiation results that will have social impacts. After running the course in the MOOC context three times and in face‐to‐face settings eight times, we noticed that key themes emerged. Participants have brought their own workforce perspectives to their simulation roles as employers, worker representatives, elected officials, and educators. They have called for reciprocal agreements centered on fair treatment and representation in the workplace, improved organizational performance, investments in skills and capabilities, aligned rewards and benefits for workers, and work–life balance in communities. We continue to use the simulation in the classroom and are exploring ways to expand its use. In the meantime, in this article, we discuss how the insights gleaned from this simulation could be used to crystallize and advance a new social contract at a time when the public policies, institutions, and organizational practices governing employment relations have not kept up with the dramatic changes taking place in the workforce, nature of work, and overall economy.  相似文献

Over the last four decades, the field of negotiation has become a fully recognized academic discipline around the world and negotiation courses and competitions have become increasingly popular. Although it is believed that negotiators may be trained and that negotiation is a skill that can be taught and evaluated, the question of how to assess negotiation performance systematically and comprehensively remains largely unanswered. This article proposes a negotiation competency model for evaluating negotiation performance. The model includes a set of selected negotiation competencies together with proficiency levels and their behavioral indicators. Our goal is to help scholars design more effective negotiation courses and fairer negotiation competitions, improve negotiation pedagogy, and train negotiators who are well prepared to handle conflicts in our increasingly complex society.  相似文献

New technology has expanded the opportunities for energy companies within the United States, often bringing them into populated communities and requiring them to negotiate deals with landowners. This case study focuses on how one group of landowners in northeastern Pennsylvania creatively reimagined the process of negotiating in a natural gas deal. They used collective bargaining for leverage, and the Internet and social media to level the informational playing field. These techniques allowed them to develop trust within the group and ultimately with one company, as they sought to protect their environment and enhance their financial gain.  相似文献

With the increasing environmental risks, the limitations of legislative regulation, negative judicial regulation and weak administrative regulation make it difficult to regulate the exercise of the discretion of environmental administrative punishment, which also increases the difficulty of the implementation of environmental administrative penalty decisions. The government, enterprises and the public three-dimensional main body structure constructed by the modern environmental governance system provides a new framework for the discretionary regulation of environmental administrative punishment. Based on the traditional theories of administrative Law, three regulation mechanisms can be formed,which include administrative self-control, negotiation regulation, and the social regulation. These three regulatory mechanisms working together in the whole process of environmental administration would regulate and restrict the exerting of discretion of environmental administrative punishment.  相似文献

人质解救属于高难度的战术,光靠武力难以成功,与犯罪人谈判是在所难免的。而我国警方现在极其缺乏专业谈判人员,各地纷纷采取措施培养谈判专家,这可能只是"头痛医头,脚痛医脚"的短视行为。必须树立以谈判专家为中心的人质解救理念,从制定科学的培训计划、应急预案、现场指挥体系和现场处置策略等方面着手,以此才能架构起长效的危机处理机制。  相似文献
