公共服务型政府与公共服务的有效供给

我国公共服务型政府是指在遵从宪政民主秩序大框架下,以公民本位、社会本位理念为指导,通过法定程序,按照公民意志组建起来,以为公民服务为宗旨,实现着规制与服务功能的政府。有效公共服务供给的十二大模式为:政府服务、政府出售、政府间协议、特许经营、政府合同外包、政府内部市场、补助、凭单、用者付费制、自由市场、志愿服务、自我服务。实现有效公共服务供给的六大前提是:宪政、行政区划重构、利益集团的培育、独立的司法体系、完善的产权保护制度、取消户籍制度。     

“金三角”地区的社会治安

本文从工作实际出发,概括了“金三角”地区社会治安的特点、难点,提出了五个方面的治理对策,以期有效地增强“金三角”地区的治安防控能力。     

“I WANT MY MOMMIES”: THE CRY FOR MINI‐DOMAS TO RECOGNIZE THE BEST INTERESTS OF THE CHILDREN OF SAME‐SEX COUPLES*

In child custody cases, courts will look to the best interests of a child to maintain visitation/custody rights only with the child's biological parent, not third parties. However, with a same‐sex couple, it is inevitable that one parent will not be the biological parent. Thus, when that parent is in a mini‐DOMA state, where same‐sex couples from non‐mini‐DOMA states do not have to be recognized, that parent will be viewed as a third party and lose all visitation/custody rights if the couple separates. This note advocates that mini‐DOMAs allow both the biological and nonbiological parents of a same‐sex couple to have visitation/custody rights of their children if it would be in the best interest of the children to do so.     

确立与完善我国的刑事缺席审判制度

近年来,我国发生了许多犯罪分子犯罪后携巨款潜逃国外的案件,但苦于法律没有规定缺席审判制度,人民法院无法作出有效判决,并依据《联合国反腐败公约》追回流失的资产。针对这种情况,我国应借鉴国外成功的立法经验确立缺席审判制度,以适应世界法治发展的潮流。     

对我国控辩平等的检视与思考

控辩平等原则在我国法律制度和司法实践中还只是雏形,其与国际公约和司法准则对控辩平等的要求依然存在较大差距,甚至在某些方面尚未达到控辩平等之最低标准要求.在我国刑事诉讼法之再修改中,应当以控辩平等原则为基本原则,重构我国控辩关系及其相关体系,厘清控辩平等与刑事诉讼本质及其基础理论的关系,解读控辩平等的现代内涵,建立合理的刑事诉讼权力结构,扩张被指控人的辩护权,培养执法者正确的司法理念与适格的职业素养,研究决策者与社会公众在控辩平等原则构建方面的互动机制,为立法和司法实务提供参考.     

Defense Spending and Economic Growth around the Globe: The Direct and Indirect Link

In this study, we combine both demand- and supply-side models to investigate the direct and indirect link between defense spending and economic growth. With data from 161 states for 1990–2012, we conduct a comprehensive examination of the defense-growth nexus in the post-Cold War world. Our findings suggest that at the global level, military spending significantly dampens private investment but somewhat reduces unemployment. However, the direct economic effects of defense spending on growth are minimal at best.     

Team Characteristics and Team Member Knowledge,Skills, and Ability Relationships to the Effectiveness of Cross‐Functional Teams in the Public Sector

Abstract

This study examines members of cross‐functional teams in the public sector for the necessary knowledge, skills, and ability (KSA) to be effective team members. It was determined that members of cross‐functional teams in the public sector possess the necessary KSA to perform effectively. The following characteristics are statistically significant factors: (1) years of professional work experience; (2) frequency of team participation; (3) the type of team training, i.e., collaboration and performance management; and (4) situational entry to team assignments (volunteered, assigned, requested), specifically volunteer and requested. The findings are significant in that managers within the government have some guidelines on team formation. They now know who should be team members, team members should be volunteers, and management should ensure that the team members have specific training in the areas of team collaboration and performance management. The findings are significant for employees as well. To acquire experience, employees should be interested in participating in a team environment (i.e., volunteering for the assignment). They should participate on numerous teams, so that they can become more effective as team members. Employees should acquire training in specific team skills (i.e., collaboration and performance management) to help them better understand how to work within the team and the team members and get results.     

人民币汇率变动对中美贸易结构收支的影响——基于SITC分类标准的实证分析

人民币汇率变动能否解决中美双边贸易失衡问题一直是国内外学者研究与争论的焦点。实证分析表明,人民币汇率的水平变动无法起到调节中美两国贸易收支的作用,但适度增加汇率波动弹性有助于缓解贸易失衡。因此,只有消除对人民币升值的预期、进行经济结构调整以及改善外商直接投资的流向,才能从根本上恢复中美之间的贸易平衡。     

Cyber Weapons Convention

World leaders are beginning to look beyond temporary fixes to the challenge of securing the Internet. One possible solution may be an international arms control treaty for cyberspace. The 1997 Chemical Weapons Convention (CWC) provides national security planners with a useful model. CWC has been ratified by 98% of the world’s governments, and encompasses 95% of the world’s population. It compels signatories not to produce or to use chemical weapons (CW), and they must destroy existing CW stockpiles. As a means and method of war, CW have now almost completely lost their legitimacy. This article examines the aspects of CWC that could help to contain conflict in cyberspace. It also explores the characteristics of cyber warfare that seem to defy traditional threat mitigation.     

国防科技安全的法律保障

国防科技是武器装备发展的前提和基石,是军队战斗力的物质基础和军事实力的重要组成部分。国防科技安全是科技安全在国防领域的体现,维护国防科技安全,保护国防科技成果,是国家安全的重要内容之一。建立健全国防科技安全的法律保障机制,在各国法律建设中的地位尤为重要,随着国防科技工业的不断发展,我国国防科技安全保障机制在一些立法和制度上的问题有待进一步研究和解决。
