侵权行为地这一传统属地管辖依据能否适用于以及该如何适用于网络侵权案件,是具有理论和实践双重意义的重要问题。该依据虽然受到网络的冲击,但仍能适用于此类案件。然而,我们必须基于网络侵权行为的特殊性对其加以发展。“被告侵权设备所在地”作为被告侵权行为实施地管辖依据,具有确定性和合理性,应作为网络侵权案件的主要管辖依据。“原告发现侵权信息的计算机终端设备所在地”一般不能作为管辖依据。只有当被告侵权行为实施地难以确定时,它才可作为侵权结果发生地管辖依据而得以适用,成为网络侵权案件的辅助管辖依据。  相似文献

Based on the limited effectiveness of state laws, and lack of harmonization at international level a number of states started to introduce policies to block access to Internet content and websites deemed illegal which are situated outside their legal jurisdiction. However, blocking policies are not always subject to due process principles, decisions are not necessarily taken by the courts of law, and often administrative bodies or Internet hotlines run by the private sector decide which content or website should be subject to blocking. Therefore, increasingly, the compatibility of blocking action is questioned with regards to the fundamental right of freedom of expression. This article assesses significant developments at the pan-European level with regards to the development, and implementation of Internet content blocking policies. Adaptation of content blocking policies from certain member states of both the European Union and the Council of Europe will be used to assess the nature and implementation of access blocking policies. It will be argued that there could be a breach of Article 10 of the European Convention on Human Rights if blocking measures or filtering tools are used at state level to silence politically motivated speech on the Internet.  相似文献

随着互联网科技的不断发展,人们日常生活对网络的依赖有增无减。人们在享受网络带给生活的巨大便利的同时,也倍受各种网络侵权行为的干扰。《侵权责任法》第36条为解决网络侵权问题找到了出口,但除了该条第2款中明确规定的被侵权人享有向网络服务提供者发出通知的权利之外,侵权网络用户也享有向网络服务提供者发出反通知的权利。这样才能平衡网络侵权中以网络服务提供者为中心的被侵权人、侵权网络用户和其他网络用户之间的利益。  相似文献

Since the late 1990s, the music industry has been undergoing a period of significant and crisis-ridden changes, which was initiated and forced by a new set of technologies: digitalization, data compression and the internet. This paper analyzes the repercussions of this new technological constellation on the socioeconomic structures and institutions of this sector. The reconstruction of this technology-based sectoral transformation shows that the constitutive impulses for restructuring came from the fringes of the sector and from external actors. The established companies in the music business were hesitant in accepting the new technological challenges. They initially reacted with blockades and containment strategies and only defined a strategical repositioning upon massive and indisputable pressure to change. The paper argues that the low ability to anticipate and adapt to these technological, organizational and institutional challenges is due to the interplay of several factors. Among these are (1.) general difficulties to anticipate the socioeconomic impact of fundamentally new technological opportunities, (2.) complex and time-consuming processes of establishing a new techno-institutional match, (3.) the technological conservatism and (4.) the oligopolistic structure of the sector as well as (5.) the hierarchically structured core companies. Together these factors obstructed a controlled sectoral transformation led by the established core players.  相似文献

Probation and parole officers are assigned the responsibility of supervising convicted criminals in a community setting in such a way that the competing goals of punishment, public safety, offender rehabilitation, and deterrence are achieved. All the while, these tasks are accomplished within the confines of shrinking budgets, large case loads, increasingly high-risk offenders, low occupational prestige, and considerable political and public scrutiny. These competing demands often result in especially high levels of work-related stress. The point of this research is to consider the divergence in occupational stress among probation/parole officers and whether or not they felt educationally prepared for their job. The data for this study were collected during a two-month study period which began on March 15, 2005. Data were collected non-randomly through a national Internet based survey of active probation/parole officers. This study considers a sub-sample of 2, 364 officers from fifteen states. The results show probation/parole officers who feel educationally under-prepared are likely to experience higher levels of occupational stress and more likely to have negative manifestations of stress than those officers who feel well-prepared.  相似文献

The Internet of Things as an emerging global, Internet-based information service architecture facilitating the exchange of goods in global supply chain networks is developing on the technical basis of the present Domain Name System; drivers are private actors. Learning from the experiences with the “traditional” Internet governance it is important to tackle the relevant issues of a regulatory framework from the beginning; in particular, the implementation of an independently managed decentralized multiple-root system and the establishment of basic governance principles (such as transparency and accountability, legitimacy of institutional bodies, inclusion of civil society) are to be envisaged.  相似文献
