论票据抗辩中的欠缺行为能力抗辩

依现有票据抗辩理论,欠缺行为能力的抗辩被视为对物抗辩的一种类型,属于不受限制的抗辩。本文认为,不论是从民法理论的角度,还是从票据法理论的角度来看,欠缺行为能力的抗辩都应是一种可限制的抗辩。在此基础上,本文着重讨论了限制的具体情形及效力问题。     

基于消费者视角的食品质量安全生产可行性探析

通过构建质量安全成本函数，定性研究了提高质量安全水平对生产者收入的影响。比较了不同条件下提高食品质量安全水平对生产行为影响的差异性。初步认为质量安全水平的提高，对生产者来说有其经济上的可行性。一是长期的质量安全成本会趋于下降，存在利润增加的空间；二是可以寻求到最大化的利润点。     

ON THE RELATIONSHIP BETWEEN FAMILY STRUCTURE AND ANTISOCIAL BEHAVIOR: PARENTAL COHABITATION AND BLENDED HOUSEHOLDS*

In the last several decades, the American family has undergone considerable change, with less than half of all adolescents residing with two married biological parents. Using the National Longitudinal Survey of Youth 1997, we construct an elaborate measure of family structure and find considerable heterogeneity in the risk of antisocial and delinquent behavior among groups of youth who reside in what are traditionally dichotomized as intact and nonintact families. In particular, we find that youth in “intact” families differ in important ways depending on whether the two biological parents are married or cohabiting and on whether they have children from a previous relationship. In addition, we find that youth who reside with a single biological parent who cohabits with a nonbiological partner exhibit an unusually high rate of antisocial behavior, especially if the custodial parent is the biological father.     

犯罪实行行为及其判断标准

社会相当性理论作为社会行为论的一种，既是解决犯罪化与非犯罪化依据的理论武器，也是犯罪实行行为判断标准的理论依据。社会相当性理论不仅考量行为所造成的结果的恶，同时更侧重行为本身的恶。因此，相对于单纯的法益侵害说和规范违反说，在解释实行行为的刑法意义上更有说服力。     

行政契约的司法救济

随着经济的进一步发展,行政管理理念的转变,行政契约发挥着越来越巨大的作用。但行政契约的救济制度一直都不甚完善。这导致行政相对人对行政契约的参与性、民主性的信心下降,进而影响行政契约制度的进一步发展。这一方面是由于我国学者对行政契约理论的认识还不统一,它徘徊于民事契约和行政契约之间。另一方面,行政契约的双方性使我国行政诉讼法的受案范围限制了其进入诉讼途径的可能。理论上为行政契约找一个合理的且与现行体制不相冲突的诉讼途径是十分必要的。     

论情谊行为及其法律后果

情谊行为是指当事人为增进私人友谊或基于善良风俗实施的欠缺效果意思及其相应法律后果的双方行为。情谊行为引发的纠纷,近年来日益增多。但由于情谊行为制度理论研究的贫乏,最终导致类似行为的不同定性或不同裁判。应当运用综合因素判断法认定情谊行为,并明确情谊行为非契约上的法律后果及其侵权责任的减轻依据。     

我国刑法应增设交通肇事逃逸罪

当下,交通肇事后肇事者逃逸现场的现象有增无减,这给人们的生命、安全造成极大威胁。德国、日本、加拿大等国家的刑法典对交通肇事后的逃逸行为进行独立的刑法评价,成立驾驶交通工具肇事逃逸罪。我国刑法典将逃逸行为依附于交通肇事罪,然而,交通肇事逃逸行为有自己独立的罪质,理应对其独立犯罪化。我国刑法应借鉴其他国家的做法,使逃逸行为脱离交通肇事罪,增设交通肇事逃逸罪。     

行政行为概念的反思与重构

在大陆法系国家,行政行为一直是行政法学和行政法的核心概念,但对它的定位却大异其趣。行政行为概念的明晰,不仅是构筑科学的行政行为法理论体系的逻辑前提,而且更是行政执法和司法审查实践的迫切需要。本文的研究旨趣也正在于此。     

What judges maximize:toward an economic psychology of the judicial utility function

Posner proposes that federal appellate judges' income from judicial work and moonlighting is maximized within the constraint of time spent on leisure: he argues that judges' voting behavior be conceptualized as consumption, and that judges avoid the hard work and hassle involved in writing opinions. I propose that the terms entering the judicial utility function be simplified to judicial and non-judicial income, and consumption, some of which is enjoyed during leisure time but a proportion of which is enjoyed in working time (voting, reputation, avoidance of criticism, etc.) Moreover, the extent to which a judge experiences judicial work as laborious and hassling depends upon his cognitive style: adaptors and innovators are expected to conceptualize and experience the detailed work of opinion writing in different ways and thus to have distinct preferences for competing sources of utility.
