ABSTRACT

Corruption risk assessment of draft laws and other normative acts is a relatively new instrument in the anti-corruption strategies implemented by developed nations, countries in transition, and the developing world. In connection with this, any practical experience accumulated in this area presents obvious interest. The analysis of such experience may allow to identify what works and what does not work in introducing the practices of anti-corruption screening of draft laws and other normative acts in various environments and settings, as well as contribute to dissemination of best practices in the countries of the region and elsewhere.

This article seeks to analyze and demonstrate the extent of practical implementation of corruption risk assessment of draft and enacted legislation in three post-communist countries, the problems encountered and solutions identified. Proceeding from this analysis, certain recommendations for practitioners in this field are formulated.  相似文献

Social Stability Risk Assessment (SSRA) sponsored by the local administration is perceived as a socially defined risk-coping initiative since it became mandatory in China. This article observes and unravels SSRA practices by selecting Xuzhou municipality as a sample case. Findings show that local SSRA is operated by the tridimensional mechanism and antecedents of its effectiveness in enforcement are linked with multiple elements of administrative supports. The findings contribute to a full understanding of SSRA in mainland China where there is no electoral democratic regime, and provide implications for developing countries alike. Some recommendations are proposed as a potential driver of these results.  相似文献

ABSTRACT

Procedural justice theory plays a central role in understanding police–citizen relationships. To test the universality of procedural justice theory, researchers have tended to assess the relative impacts of normative and instrumental models of policing in different geopolitical contexts. Building on Reisig and Lloyd’s study in Jamaica, we test in the current study the relative impacts of procedural justice (a normative factor) and police effectiveness and risk of sanctioning (instrumental factors) on Jamaicans’ obligation to obey the police and willingness to cooperate with police. We found that procedural justice predicted both obligation to obey and cooperation, although obligation did not predict cooperation. And while effectiveness predicted obligation, it was not significantly related to cooperation. Lastly, older citizens were more willing to cooperate with police. The study’s implications for policy and future research are discussed.  相似文献

We know that half of the population in Norway is female, and we know that females represent 6% of the white-collar crime prison population. In the stage model overview, we derive percentages from the literature into the gender model to explain stepwise reduction from 50% to 6%. In our empirical research, we asked two groups of business school students to come up with their own estimates for the stages in the model for female criminals. While estimates from executive students resulted in 3% women in prison, bachelor students’ estimates resulted in 10% women in prison. The most obvious discrepancy between the research literature and our two survey groups is related to relative convictions. Based on the literature, we suggested that female defendants receive more serious convictions because they may perceive and feel more guilt for a crime, for example in terms of regret, shame and depression. Thus women may have a tendency to confess more easily. Both executive students and bachelor students disagree with this estimate of 140%, as they suggest 62% and 69% respectively. One reason for their suggestion of less serious convictions for female white-collar criminals – sometimes labelled pink-collar criminals – might be that family situation and other elements are taken into account before a verdict is passed on a woman. Another substantial discrepancy is related to detection risk. The literature suggests a low detection risk for women, but may be not as low as we estimated at 30%. Both executive and bachelor students believe that the gender difference in detection likelihood is not that formidable, as they suggest 75% and 65% respectively.  相似文献

This study focuses on dental surgery from the perspective of practicing dentists through a nationwide survey among practicing dentists in Germany. Subjects were surveyed with respect to patient care and their training in dental surgery. With respect to surgical activity, this survey confirms male dominance in the field and that female dentists may be inclined grade surgical interventions as ‘complicated and risky’. Male dentists appear to be willing to take the same risks with greater self-confidence, whereas female dentists appear to overrate their personal uncertainty by underestimating their real technical capabilities. Though dental treatment in general is increasingly dominated by women, surgery is still dominated by male dentists. This can be viewed through observed gender differences with respect to risk perception and we advocate additional professional training of risk competence as mandatory for the future.  相似文献

Many adolescents living in contexts characterized by adversity achieve positive outcomes. We adopt a protection–risk conceptual framework to examine resilience (academic achievement, civic participation, and avoidance of risk behaviors) among 1,722 never-married 12–19 year olds living in two Kenyan urban slums. We find stronger associations between explanatory factors and resilience among older (15–19 years) than younger (12–14 years) adolescents. Models for prosocial behavior and models for antisocial behavior emerge as key predictors of resilience. Further accumulation of evidence on risk and protective factors is needed to inform interventions to promote positive outcomes among youth situated in an ecology of adversity.  相似文献

This paper discusses business continuity management (BCM) and its role in contemporary financial institutions. BCM is a nascent disaster preparedness and recovery strategy that seeks to protect vital business operations from disruptions. The paper traces contemporary BCM back to Cold War continuity of government planning, and shows how BCM came to comprehend security as continuity of processes rather than integrity of goods. BCM is prominent in finance because it promises to mitigate operational risks, and it focuses on risks stemming from interdependencies in financial infrastructures. By engaging with two events that triggered continuity management in banks, Hurricane Sandy in New York City and the ‘Blockupy’ demonstrations in Frankfurt, the paper highlights how BCM is challenged by large-scale disasters as well as acts of public criticism.  相似文献

China implements license management for AMC and strictly controls the license in limited quantities. Under the influence of the declining economy, non-performing assets increase sharply, which causes an oversupply of non-performing assets in the transaction market. If commercial banks directly transferred the assets to AMC, the price is relatively low,which may result in great losses to banks. To relieve the dilemma, commercial banks should work out methods for treating the non-performing assets. By fully utilizing the structured financing model and the bank’s own financing advantages to broaden the actual purchaser of non-performing assets, transfer incomes should be raised and direct capital losses should be reduced. Structured transfer of non-performing assets as a new mode of disposing non-performing assets to ordinary investors or the bank’s own investment funds via all kinds of AMCs, trusts, funds, brokerages, SPV (such as LP)and other institutions contains four business risks, including channel operation risk, pricing risk, recovery risk and tax risk and three legal risks, such as regulatory compliance risk, the ambiguous orientation of bank legal subject and the ambiguous orientation of return rights. These risks require in-depth study into their causes for proper prevention.  相似文献

Open governance requirements are designed to improve accountability, which implies that transparent governments are more trustworthy stewards of their publicly invested power. However, transparency may also reduce institutional effectiveness and inhibit political compromise, diminishing the capacity to manage resources responsibly. We assess empirical support for these competing perspectives in the context of American state legislatures, many of which have become exempt from state sunshine laws in recent decades. We leverage variation in the timing of these legislative exemptions to identify the effect of removing transparency in a crucial governing institution on investors’ risk perceptions of states’ general obligation bonds. Our analysis of these data during the period 1995–2010 suggests that removing legislative transparency reduces state credit risk. We conclude that while openness in government may be normatively desirable, shielding legislative proceedings from public view may actually be better for states’ debt repayment capacity, improving their overall fiscal health.  相似文献
