中国—东盟服务贸易发展的现状及战略选择

在服务贸易的发展基础、产业结构、发展阶段和发展速度方面,中国与东盟国家存在较大的差异,双方的服务贸易存在较强的互补性,为双边服务贸易的发展壮大奠定了基础。为了进一步提高中国与东盟服务贸易的发展水平,双方需要立足比较优势,整合区内资源,促进服务贸易政策的调整与完善,并进一步提升服务业的开放水平。     

The Need for a Stronger Definition: Recognizing Abandonment as a form of Elder Abuse Across the United States

Elder abuse is a growing public health problem in the United States and statistics show that each year, hundreds of thousands of elders are abused in some manner. This Note discusses elder abuse while focusing specifically on the occurrence of elder abandonment and how the majority of states do not recognize elder abandonment as a form of elder abuse in their statutes. Moreover, this Note proposes a model statute to be adopted by every state in an effort for elder abandonment to become more widely reported. Elder abandonment is an unfortunate phenomenon and those who contribute to elder abandonment should face criminal liability similar to those abusers who engage in elder neglect or other types of elder abuse. Furthermore, this Note emphasizes that there should be a greater focus on how caregivers can seek assistance in order to prevent elder abuse in the United States.     

Holistic Representation: A Randomized Pilot Study of Wraparound Services for First‐Time Juvenile Offenders to Improve Functioning,Decrease Motions for Review,and Lower Recidivism

Mental health diagnoses, substance abuse issues, and school problems are often cited as contributors to adolescents’ involvement with the juvenile justice system. Yet, few youth receive assessment, evaluation, or intervention prior to their involvement with the juvenile courts. This pilot study evaluated whether providing a randomized trial of wraparound forensic social work services in addition to court‐appointed legal services would improve functioning, decrease motions for review, and lower recidivism for first‐time juvenile offenders. Findings indicate statistically significant improvement for youth receiving wraparound services on six out of eight measures. A case study example is provided and implications for service provision are explored.     

日本商业服务外包的发展模式研究及启示

本文从中间投入品商业服务外包和公司内部职能部门业务外包两方面探讨了日本商业服务外包发展模式的特点;分析了日本模式的商业服务外包对承接国的经济影响;并指出可以借鉴日本的成功模式,大力培育国内商业服务外包市场、规范国内关于商业服务外包产业发展的法律、法规,制定和实行支持国内商业服务外包产业发展的各项优惠政策,提升中国商业服务外包产业国际竞争力。     

国际金融服务贸易的多边法律框架——WTO与金融服务贸易有关的协议评析

就国际金融服务贸易而言 ,WTO的重要性在于将金融服务贸易首次纳入多边贸易体制 ,并制定了一系列与金融服务有关的协议 :GATS、《金融服务附件》、《关于金融服务承诺的谅解》、《金融服务协议》 ,从而构建了国际金融服务贸易的多边法律框架。其主要内容包括 :国际金融服务贸易自由化的规则和纪律 ,影响国际金融服务贸易的国内法规的协调、承认和实施 ,国际金融服务贸易争议的解决。此框架是2 0世纪以来国际金融法领域最重要的制度创新 ,它是具有约束力的国际协议 ,以效率为其基本价值取向。     

日本养老金危机与政党走势——以2003-2007年国会选举为视角

2003—2007年日本国会选举,在自民党与民主党两大保守政党的竞争态势下,养老金制度改革与危机成为影响日本政党走势的重要原因之一。一个深层次的问题是,政党支持结构已经由传统模式向业绩投票模式转换,可是,"中位投票者"偏好的政策构想,基本相同的养老金制度致使投票人无所适从;投票人希望候选人成为能确保投票人偏好的政策代理人,然而,5 000万份年金记录丢失,致使养老金危机转向政党危机。构筑让国民信赖的养老金制度是走出政党危机的路径。日本养老金危机对中国有重要借鉴意义。     

The Emergence of Crime Victims as a Target Group in the Swedish Social Services Act

This article examines the political motives behind the introduction of crime victim support provisions in the Swedish Social Services Act. The findings derive from a case study of the preparatory material that prefaced the legal changes that were adopted in 2001. The result shows that the explicit purpose of the provisions was to consider measures to improve the support to crime victims. To some degree the provisions can also be explained by symbolic factors. In fact, most actors in the law-making process indicate that their motives were communicative and symbolic. Support to crime victims was presumably a complicated issue for the social democratic government. Because of the economical crisis in the early 1990s, there was no scope for reforms that implied high increased costs. Yet expanding the crime victim's rights in relation to the offender, such as toughening the penal law and promoting victim impact statements, was not in line with social democratic ideology. By enacting the provisions in the Social Services Act the government demonstrated that support to crime victims was an important area of concern. At the same time, the provisions did not involve any increased costs or strengthen the crime victim's rights in relation to the offender. In this way, the provisions became a mediator that solved a difficult political dilemma for the government.     

主权财富基金与海合会金融合作

海合会作为区域一体化组织,一方面推进区域货币和金融一体化,另一方面又是主权财富基金的发源地和分布最密集的区域。海合会成员国主权财富基金在区域内的投资呈现出促进区域金融合作的潜能,它不仅投资广泛,而且出现了合资主权财富基金。但是,这种促进作用也面临诸多挑战,比如产业结构趋同导致投资品种单一、区域大国的影响,以及政治发展的障碍等。
