协同视角下高校工会服务青年教师发展探析

高校青年教师所面临的科研、教学、生活心理等各方面发展问题是高校工会服务青年教师工作措施的主要着力点。在促进青年教师发展的各类关系中,学校、校工会、学院分工会和各职能部门密不可分,共同服务青年教师发展。为解决青年教师发展中遇到的问题,高校工会应该创新工会协同服务理念,建立服务青年教师发展的学习型组织,丰富实践活动载体,形成定期工作核查和纠正制度等。     

美国农业合作社的形态法定化及其启示

在美国,农业合作社是农场主为了满足自身生存发展的需要,在借鉴欧洲合作社尤其是罗虚代尔公平先锋社先进经验的基础上,探索和创造出来的一种组织形态;这种组织形态最初并未体现于法律中。及至20世纪初期以后,在寻求农业合作社反垄断豁免及税收优惠的过程中,经由制定法和判例法的合力,农业合作社逐步实现了形态法定化,并在法律的助推下得以进一步勃兴。美国农业合作社形态法定化的实践给我们提供了如下启示:应重视并充分运用法律手段来提升农民合作经济组织的绩效;农民合作经济组织法律制度的确立应积极回应实践中的制度创新;我国农业反垄断豁免的主体界定可借鉴美国的成功经验。

公共服务领域内政府与社会组织的关系构建——基于博弈论研究的视角

国家与社会的现实关系在很大程度上反映着一个国家的治理水平。在公共服务领域,政府与社会组织之间的关系构建是一个重要的研究内容。在我国社会快速转型和变迁的背景下,构建中国式的政府与社会组织之间的关系显得更加迫切。文章运用博弈的视角,梳理了政府与社会组织关系的理论发展脉络,提出了变和博弈理念下我国政府与社会组织的关系——竞争与合作的关系,是中国式政府与社会关系发展的必然。最后,文章总结,在公共服务领域内,竞争与合作的关系模式必须通过构建政府与社会组织之间的信任机制、合作机制,同时,通过一系列制度化的发展才能够得以实现,最终发挥政府与社会组织在公共服务领域内的重要作用。     

Sam Fisher and the “war on terror”: an analysis of Splinter Cell in a post-9/11 context

This article examines the values and attitudes present within the 2002 video game Tom Clancy’s Splinter Cell, and the methods employed to convey them. It compares the game’s message with the rhetoric contained in the Bush administration’s post-9/11 “war on terror” narrative. A qualitative content analysis of a Splinter Cell “game movie” and gameplay sessions is undertaken to examine the messages communicated through elements of simulation and representation. This article finds that Splinter Cell and the “war on terror” narrative express similar perspectives of terrorism and counterterrorism. First, both exaggerate the physical and normative threat of terrorism, and portray it as overwhelmingly powerful. Second, both sources justify violent counterterrorism action through claims of necessity, urgency and self-defence. Third, violence is consistently portrayed as effective for achieving the desired objective. Finally, violence and military action are represented as simple solutions that ultimately lead to victory over terrorism. The parallels between the messages within Splinter Cell and the “war on terror” rhetoric indicate that the game was shaped by the post-9/11 culture in which it was developed. More significantly, however, Splinter Cell perpetuates and legitimises the “war on terror” narrative by conveying its message through an immersive interactive environment.

The use of technology and leadership in enhancing strategic cooperative policing within the SADC region

ABSTRACT

The globalisation processes driving development and the transnational nature of crime require the collaboration of police within regions using sophisticated technology to combat crime. This article examines the role of technology and leadership in enhancing cooperative policing. Following a successful safety strategy during the 2010 Federation of International Football Association (FIFA) Soccer World Cup (SWC) tournament in South Africa, the aim of the article is to demonstrate how technology and strategic leadership contributed to the success of this event. The research conducted consisted of an extensive review of existing research publications on the state of policing in southern Africa; and a conference presentation by Lieutenant-General Pruis about policing the SWC from which key policing lessons have been extracted. The literature survey revealed the challenges of police forces and policing in the Southern African Development Community (SADC) as being primarily resource constraints, and socio-political environments that are not always conducive to effective policing. Conclusions drawn are that some of the lessons from the SWC, such as planning, budgeting, strategic leadership, regional and international cooperation of security personnel, community involvement, an informed media strategy and the use of technology to support these processes, can be replicated in regional policing operations.     

两岸合作开发南海渔业资源法律机制构建

南海自古以来便是中国渔民的重要作业渔场。两岸合作开发南海渔业资源,是解决南海争端的重要着手点和突破口。两岸南海渔业合作符合双方共同利益,但这一合作必定面临诸多内外因素阻碍。内部因素是两岸主权共识缺失、互信基础薄弱、沟通渠道有限;外部因素是南海周边国家的分化和美国的阻扰。然而,南海渔业资源北衰南兴的现状与外来侵渔的紧迫形势决定了两岸加紧合作共同维护南海渔业资源主权权利是必要的。目前两岸在政策、法律和技术层面的一致性、默契性和互补性也决定了双方南海渔业合作是可行的。两岸可基于《海峡两岸经济合作框架协议》已搭建的制度化平台,由两岸经济合作委员会成立南海渔业工作小组,通过签订协议的方式构建南海渔业资源合作开发法律机制。     

以博弈论视角探究侦查讯问中供述的自愿性

新《刑事诉讼法》已经颁布实施,其中规定的“不得强迫任何人证实自己有罪”被许多学者认为具有里程碑的意义。但是出于追诉犯罪的需要,侦查机关不可能在讯问中放弃获取犯罪嫌疑人供述的努力,而犯罪嫌疑人出于自身利益的考虑,也不可能毫无阻抗的供述自己的犯罪行为,在这样一对矛盾体中,如何在不违反法律规定的情况下获取犯罪嫌疑人的供述就成为侦查机关在讯问中首要关心的问题。     

农民合作行为中的惩罚机制及其实践基础研究

本文引入类型化的视角,对农民合作行为中惩罚机制进行研究与探讨,并考察合作行为中惩罚机制形态、处罚实施主体、惩罚手段以及惩罚机制发生的社会基础。研究发现,在社会关联度较高的村庄之中,村民多群体性地运用软性惩罚的方式对合作行为中的搭便车者进行惩罚;在社会关联度中等的村庄,村庄社区内可能以群体也可能通过单个强互惠者以情、面子来对搭便车者进行惩罚,但由于村庄内规范的约束力降低,其效果往往不及前者;在社会关联度较低的村庄则只能够以个人为单位,或以牺牲自己利益或引入混混来惩罚搭便车者,这种刚性的惩罚方式对合作行为中的搭便车者进行处罚,虽然可能有效,但其惩罚需要支付高昂的成本与代价。
