涉企业数据竞争行为的法律规制

企业数据在既有法律框架下无法获得充分保护,作为一种财产性利益,企业数据与一般条款具有耦合性。但是,一般条款的裁判思路依赖于传统侵权模式,最高人民法院在"海带配额案"中创设的三个构成要件,使一般条款陷入困境,无法应对行为规制法的本质要求,无法与《民法典》相衔接。企业数据涉及个体经济利益、行业利益及公共利益,"全有全无"构成要件式的侵权判断,不能应对复杂多变的涉企业数据竞争行为的法律规制。动态系统论以"或多或少"的思路考量各要素的数量和强度的协作,按照价值位阶和顺序,考虑企业数据本身的合法性、行为人主观过错、行为影响,根据具体场景综合权衡损害与收益,可以为涉企业数据竞争行为的正当性判断提供正确的裁判思路和理论支持。

‘Get Brexit Done’: The New Political Divides of England and Wales at the 2019 Election

This article analyses the successful Conservative election campaign of 2019 and how it took advantage of a fractured political and economic landscape. It reviews the unique circumstances around the 2019 election and the ‘surprising death’ of a no-deal Brexit. We then analyse the divergent political communication strategies in the 2017 and 2019 Conservative campaigns showing how the latter was much more coherent and politically unorthodox. Drawing on socioeconomic, demographic and British Election Study data, we argue that Boris Johnson’s messaging was carefully tailored towards the demands of voters in the ‘red wall’ seats. Conservative success was built around an appeal to voters in these economically depressed ‘geographies of discontent’. But while tremendously successful, the coalition this created is potentially fragile. An unconventional, ‘leftish’ Conservative campaign built a new, diverse bloc of voters. It includes a number of left-wingers expecting change alongside traditional Conservative supporters, and will be hard to keep together given the economic turbulence ahead.     

Competition and switching in public service markets: Can they reduce inequalities?

Regulatory reforms to public infrastructure services across European Union (EU) countries were aimed at increasing consumer welfare by introducing competition and choice into service markets. However, empirical evaluations have questioned whether these reforms have benefitted all consumers, suggesting that vulnerable groups of service users (especially those with lower levels of formal education), might be locked into poorly performing services. We assess the relationship between the level of competition in electricity and fixed telephony markets in EU countries and evaluate the affordability of these services for different socio‐educational layers. Our findings show that – although in countries where there is a relatively high frequency of switching, inequalities between socio‐educational groups are smaller and eventually disappear – competition as such does not play a part. These results suggest that demand‐side regulation that successfully enables consumer switching has the potential to equalize social welfare, thereby reflecting a possible convergence of regulatory instruments and the central aims of the welfare state in this context.     

Evaluating the Effectiveness of Adopting Open Educational Resources in an Introductory American Government Course

In this article, we present findings from a grant-funded initiative to replace traditional, proprietary textbooks with an open content textbook under a Creative Commons license in the introductory American government course (POLS 1101) at Middle Georgia State University. We find that the use of an open content textbook led to somewhat negative effects on student learning outcomes and student course satisfaction, although the associated lower textbook cost increased textbook accessibility to students. We conclude with some suggestions to those adopting textbooks in this course and to the wider discipline regarding measures that may lead to more unequivocally positive outcomes than those experienced in this study.

社会主义价值观体系是一个庞大而复杂的思想观念系统，主要包括位于基础层次的社会主义基本价值观、列在中间层次的社会主义一般价值观和居于最高层次的社会主义核心价值观三个层级的内容。社会主义基本价值观发轫于空想社会主义，集成于科学社会主义，突破于中国特色社会主义。社会主义一般价值观源于社会主义实践及其发展的需要，是特定时代场景下社会全体成员的共同理想和价值愿望。社会主义核心价值观尚需进一步凝练。探讨社会主义价值观体系的结构分层，是培育和践行社会主义核心价值观的重要前提。     

美国无救助义务规则的修正

无救助义务是美国传统侵权法上的一项重要规则。由于社会组织结构的精细化使人与人之间的关系更加紧密了,容易出现牵一发而动全身的局面,如果还任由人们对他人的困境无动于衷可能会造成无法挽回的严重后果,加之作为与不作为的区分越来越小,故美国选择了一条侵权过失责任的改良道路,主张不作为不应该成为被告承担过失责任的障碍。而美国的司法判例和立法经验也告诉我们,一般无救助义务规则正经受两方面的侵蚀:一是扩大特殊救助义务的范围;二是通过制定法律承认一般救助义务。

合同一般法定解除条件探微

违反从给付义务必须达到相对人的合同目的因此而落空的程度才允许解除合同。不可抗力致使不能实现合同目的作为合同解除的条件,尚无废除的必要。不能实现合同目的可被解释为严重影响订立合同所期望的经济利益。在金钱给付作为合同标的场合,付款迟延情况下的解除合同必须从严把握。
