农村职务犯罪的综合防控——以冠县人民检察院2005年以来查办的涉农案件为视角

当前,农村职务犯罪总体上呈现主体特定化、领域集中化、人数集团化、手段多样化的趋势,直接侵害了农民的切身利益,严重腐蚀了国家机体,成为新农村建设道路上的一颗毒瘤。农村职务犯罪是宏观环境因素和微观个体因素综合作用的结果,应当构建使村干部不敢为,不能为,不必为,不想为的职务犯罪综合防控机制。     

网络舆论的传播规律研究

随着互联网技术的快速发展和普及,网络在新闻传播和舆论形成中已经无可争议地赢得了主导地位,改变了传统的舆论格局。在网络舆论传播过程中呈现出快速性、冲突性、情绪性、群体性、复杂性等特点,因此,只有分析其传播过程中呈现的规律,才能有计划、有步骤、有针对性地对网络舆论进行引导。     

Realizing the Responsibility to Protect

Written prior to the release of the UN Secretary-General's report on implementing the Responsibility to Protect (R2P), this article examines the effort to translate the principle from words into deeds. It begins by noting a post-2005 "revolt" against the principle in which a number of states expressed skepticism about the principle and its use in different settings. This revolt, the article contends, was largely a product of the continuing association between R2P and humanitarian intervention. This association was, in turn, caused by a combination of misplaced commentary and the International Commission on Intervention and State Sovereignty's focus on the intervention question. This article maintains that building consensus on the R2P requires a shift in emphasis and proposes three avenues: clarifying the nature of prevention, developing practical measures, and proposing modest proposals for institutional reform.     

Sexual offending as a public health problem: A north american perspective

Abstract

This paper argues that we should cease treating sexual offending as a problem best dealt with by psychology, medicine, or law. Sexual offending, like mental illness, alcoholism, or drug addiction, is a public health problem, one that is everyone's business. The paper first considers the traditional levels of prevention in public health: primary, secondary, and tertiary. The argument is made that most of our efforts have been directed to the tertiary level where they are least likely to be effective. Applications of the general public health model to sexual violence are considered. These include epidemiology, risk factor research, program evaluation, and dissemination of information on what works. Various methods for informing and educating the public about sexual violence are proposed. The paper concludes with suggestions on how harm can be minimised through the use of a public health approach.

我国地方政府融资平台大部分是运用财务杠杆负债经营,蕴藏着巨大的偿债风险,地方财政收入的不确定性及其他因素都加剧了融资平台的偿债风险.本文探讨了地方政府融资平台基于财政方面的支持,分析了其带来的风险,并给出相应的风险防范的政策建议.     

A Response to Yang,Burrola, and Bryan: Suicide Ideation among Participants in an After-School Program: A Convenience Sample

The exploratory study conducted by Yang, Burrola, and Bryan (2009) provides an excellent platform for calling attention to the issue of suicide risk among elementary and middle school youth. Using their study as a catalyst, with this commentary I consider the finding that 12% of the young people surveyed acknowledged that they had “seriously considered suicide during the past year.” I offer an alternative interpretation that focuses more explicitly on youth resilience and discuss how youth organizations can become more intentional and proactive in their overall suicide prevention aims.     

规范与进路：预防本位下刑法禁止令之定性

刑法禁止令已在我国《刑法》第38条和第72条中得以规定,但禁止令的性质并未在立法层面上进行准确界定,司法实践和学界对禁止令性质的认定也存在着较大的争议.从规范和本体的维度考察,刑法禁止令有别于刑罚、保安处分、行政制裁措施和人身安全保护裁定.根据刑法禁止令制度创设的目的和刑法解释的内在逻辑,对刑法禁止令性质的界定应回归到犯罪预防本位,并在预防本位下将其界定为一种限制性的犯罪矫治和预防措施.在预防本位下,人权保障机能、必要性审查、假释中的适用是刑法禁止令的应有内涵.     

和谐社会构建下老年人犯罪预防

随着社会的发展，一些国家相继步入“老龄化”社会，中国也不例外。目前，我国60岁以上的老人有1．85亿人，占全国总人口的13．7％。并且我国的“老龄化”社会还具有“未富先老”的特征。长期以来．理论和实务界对青壮年犯罪给予了比较多的关注，但对老年人犯罪关注甚少。但现实中由老年人引发的犯罪却屡见不鲜，并有逐步增长的趋势。老年人作为一个特殊群体，其生存状态与目前提出的“诚信友爱、安定有序”和谐社会的建设休戚相关。因此，以老年人犯罪为切入点，探寻预防老年人犯罪的对策。有助于促进和谐社会的构建。     

新生代农民工的特征及其市民化问题探析

出生于20世纪80年代以后的新生代农民工正逐渐成为农民工的主体,他们所表现出来的基本特征呈现出明显的市民化倾向。为提升我国城市化水平,满足社会和谐稳定发展的需要,必须深化户籍制度改革,建立符合新生代农民工特点的社会保障制度,提高他们的素质,培育他们的＂新市民意识＂,为他们的市民化创造良好的条件。     

论汽车租赁合同诈骗案件及侦防对策

随着汽车租赁业在我国的兴起与发展,以签订租赁合同的方式来骗取汽车的案件呈现高发态势。这类案件往往涉案金额大、追赃难,给被害人造成巨大的经济损失,直接影响到整个行业的健康有序发展。公安经侦部门应认真分析研判发案的原因、规律、特点,采取各种侦查措施,开展打击该类犯罪的专项斗争,同时指导租赁公司采取各种防范措施,从源头上降低发案率。
