我国私人参与履行警察任务法制的现状与课题

我国严峻的治安形势与有限的警察力量之间的强烈反差，倒逼出私人力量对警察任务的参与。无论是充满争议的治安承包、辅助警察、拍违有奖和警方线人改革尝试，还是具有明确法律依据的合作戒毒和社区矫正，都真实地反映了转型中国警察任务民营化跌宕起伏的图景。从警察任务民营化改革的时机选择、法制依赖和监督加强上看，私人参与履行警察任务在我国行政法上依旧是一个未竞的前沿课题。     

以科学发展观为统领不断推进工会工作创新发展

中关村科技园区海淀园是中国第一个高新技术产业开发区，汇聚了15000多家高新技术企业。目前园区基层工会组织多是小而分散，工会会员呈高学历、高素质、高收入群体特点。工会工作按照传统的组织体系和工作方式难以有效运作。因此，园区各级工会必须适应形势，在基层建设和工作领域方面走向社会化、网络化和开放化，从实际出发，建立健全工会组织体系，以科学发展观为统领，以维权为重点，围绕园区的稳定和发展，发挥工会组织的积极作用。     

Writing,Space and Authority: Producing and Critiquing Settler Jurisdiction in Western Australia

On the edge of Stirling Gardens in central Perth, Western Australia, five large, old-fashioned pen nibs stand in a curved line, their tips in the ground. Anne Neil’s sculpture, Memory Markers, commemorates the history of this site, which includes the Supreme Court. Taking this sculpture as an emblem of writing, which in the context of its setting highlights the relationship between literature and law, this article explores the image of the pen in the ground. As a symbol of literacy, it evokes the powerful network of discourses—particularly law, science and religion—that underwrote the imperial project. It signals, in Michele Grossman’s terms, “the event of literacy [that] radically interrupts and disrupts—but never eliminates—pre-existing Aboriginal epistemologies”. The article goes on to explore the sculpture as a symbol of the assertion of jurisdiction, the speaking of law in and over colonised space. It analyses a group of written texts associated with this site, from colonial legal assertions of jurisdiction over Aboriginal people in Edward Landor’s The Bushman (1847), through a proclamation under the Aborigines Act 1905 (WA), to Stephen Kinnane’s Indigenous family memoir of life under that act, Shadow Lines (2004).     

论“中小企业”的立法界定标准——从 比 较 法 的 视 角

西方各国对“中小企业”的立法界定标准差异显著，在其本国内每一部政府扶持立法通常都规定了自己的“中小企业”定义。我国对“中小企业”的立法界定标准先后进行过几次大调整，但目前的立法仍存在诸多缺陷，需要进一步加以完善。立法界定“中小企业”，应以“小”的本质涵义为起点，以“相对随意性”为指导理论。     

日本民间非营利组织的发展现状、法律环境及社会贡献

自20世纪90年代中期以来,随着日本政治和社会环境的改变,日本政府以“小政府、大社会”为目标,转变了社会管理职能,将很多职能移交给民间非营利组织,使这些组织进入快速发展阶段.尤其1998年《日本特定非营利活动促进法(NPO法)》的制定及颁布,从法律层面上规范了民间非营利组织的运行环境,使非营利组织所关注的社会领域不断拓宽,其社会贡献越来越重要.那些活跃在国外的民间非营利组织通过民间外交及社会教育活动提升了国际影响力,而在国内从事环境保护、社会福利的民间非营利组织则通过社会公益活动,增强了国民凝聚力.日本民间非营利组织的蓬勃发展越来越成为日本提升国家软实力的重要途径.     

新私塾教育的未来——从“失学儿童”救助制度谈起

新私塾教育所引发的＂失学而不失教＂的＂失学＂状态,相较于传统失学儿童案中单纯＂辍学＂状态有着本质的区别;同时,新私塾教育的存在及发展也引起了人们对体制内＂学校教育＂的质疑。为此,以维护＂体制内＂教育为最高宗旨的传统失学儿童救助制度,因无法解决私塾教育所带来的人们对教育个性化的＂合理＂要求所产生的＂合法性＂纠纷而丧失了当然的正当性。本文认为,加强对私塾教育规范化的管理而非一味地排斥私塾教育才是解决问题的关键。     

用新一代信息技术设计防火管理专业（工程技术方向）课程体系

新一代信息技术的发展会加快消防系统智能化的实现,尤其是物联网技术的应用将更加为防火管理与灾难发生插上可预知的翅膀。本文力求基于新一代信息技术给出防火管理专业（工程技术方向）课程体系结构,以此探讨在信息产业高速发展的时代,信息技术与高职课程体系的关系。     

国有企业经营者薪酬的法律规制——一个程序视角的分析

管理者薪酬,不仅在于给什么,而且在于如何给,此即国有企业经营者薪酬的实体与程序规制两个面向。由于缺乏自治性与适应性,实体规制面临诸多困境甚至＂失灵＂,为此,转换视角,引入和完善薪酬程序规制殊为必要,亦即基于正当程序原理完善程序规制立法以及救济与责任机制,保障程序规制得以实施。     

Sensory speculations:Visual discourse and the vision of visuality

It is now commonplace within the discipline of art history and visual culture to speak to theories of vision and visuality. Recent questions concerning the subject of vision, sexed positionalities and discourses of viewing are indebted to theories of visuality, which now occupy a privileged place within the study of visual culture. Theories of visuality have revealed both the terms of cultural visibilities and significantly the how of what we see. And yet despite this engagement of the opacity and duplicity of the visual, recent work into visuality has been plagued by a re‐occurring myopia regarding the corporeal This oversight within the visibilites of visual discourse is the unchallenged idea of a ‘human vision’ within the social constructivist project. In this article I assess how this universal operates as the matter for theories of visuality and of the ramifications of this for the project of the critique of vision.     

Innovation and Alliances

Explanations for national success in science and technology typically focus on domestic institutions and policies. However, that line of research has yet to identify any particular set of institutions or policies that explain variation in national innovation rates across cases or over time. This article offers new evidence that the problem with domestic institutions approaches stems from their failure to consider international security factors. Specifically, this article finds a positive effect for U.S. security alliances on innovation. This finding is robust across different specifications and periods of analysis. While countries that ally militarily with the United States are found to realize benefits in economy‐wide, indigenous innovation, such an effect is not observed in military technologies. This suggests that alliances may substitute for being on the frontier in military technologies. Therefore, this article contributes not just to debates over S&T competitiveness, but also to alliance formation.
