从立法比较谈我国担保法的完善

我国《担保法》等相关立法对担保法律制度的规定 ,与世界上的通行作法相比 ,存在不够完善之处。适应我国加入WTO新形势 ,应进一步完善担保立法。连带责任保证应当遵循契约约定原则 ,赋予保证人代位权和免责请求权 ,以充分保护保证人的利益 ,最大限度地给予保证人救济 ;不动产抵押登记及其适用的登记效力原则要统一、规范 ,以维护担保物登记制度的权威性 ;建立质权的善意取得制度 ,有利于维护动产占有的公信力和充分实现质权的社会功能     

家兔玻璃体液微量取样与一次取样的比较

目的比较微量取样与一次取样的优劣。方法36只家兔分为4组(每组9只),于死后12h取样:I组于一次取出所有VH;II组微量取样50μl,连续取15次;III组左眼一次取样。右眼微量重复取样。IV组双眼第1次微量取样,剩余一次取出。检测Ca2 、Cl-、K 、Na 和P等含量,数据统计分析。结果III组左右眼、(IV)组先后两次取样配对t检验无差异(P>0.05),各组微量取样样本的变异系数、双眼差较小。结论微量取样的操作影响较小、稳定性和重复性好,更适合法医学研究和应用。     

An evaluation of the reagent NBD chloride for the production of luminescent fingerprints on paper: II. A comparison with ninhydrin

The effectiveness of the fluorogenic reagent NBD chloride has been compared with the popular colour reagent ninhydrin for the development of fingerprints on paper. NBD chloride was found to be more sensitive than ninhydrin for moderately old fingerprints (3–9 months) and never inferior to ninhydrin in all other cases. A qualitative evaluation technique was used to establish the relative efficiency of each method. This is based on the number of points of identification, assessed on a 1–4 scale, where 4 represents a courtworthy print (> 12 points) and 1 represents a print containing no identification points.

青年政策是公共政策的重要组成部分。比较中韩两国的青年政策,对于促进我国青年政策的完善与发展具有重要借鉴意义。中韩两国青年政策的相同之处主要表现为:非常重视青年政策的制定和完善;青年政策走向大体趋于一致;在青年政策执行过程中更加关注青年主体利益。不同点主要表现在:青年政策形式不同;青年政策运行机制不同;青年政策侧重点和方式不同。     

A comparative study on sanction system of cyber aider from perspectives of German and Chinese criminal law

In the context of the global information age, cases concerning the provision of technical assistance to commit cybercrimes are growing in leaps and bounds and a brand-new crime-as-a-service industry is beginning to take shape. German criminal law addresses this issue in the context of joint commission theory and individual incrimination as complementary, whereas the Chinese model, by contrast, has made marked progress in the fight against cyber aiding by introducing new criminal provisions. The change of cyber-aiding indeed represents a significant challenge to current criminal legislation and consideration of its criminal countermeasures is indispensably significant.     

The Comparison Question Test: Does It Work and If So How?

In a mock crime study of the comparison question test (CQT), 35 subjects decided to participate as guilty and 30 as innocent. Two conditions were varied: Explaining the comparison questions in the pretest interview and re-discussing comparison questions between charts. Higher identification rates (approximately 90% for guilty and innocent participants) were achieved in groups with explanation of comparison questions than in groups without explanation. Re-discussing comparison questions had no effect on identification rates. Ratings of subjective stress due to relevant and comparison questions were also obtained and can be seen as indicators of the significance of the questions. The significance of comparison questions was hardly affected by the different testing conditions. When effects are detectable at all, they contradict theoretical expectations in their direction. Results are discussed in terms of the significance of comparison questions used in polygraph testing.     

中美证券发行制度比较研究

证券发行制度是一国资本市场的准入制度。由于中美经济背景和历史条件的影响、证券市场结构和发展阶段的不同,中美证券发行制度存在较多差异。我国目前证券发行制度的完善应在强化自律组织的自主权,增加发行审阅过程的透明度,完善股票上市制度、信息披露制度上下功夫。在相关法律上明确规范证券发行等方面借鉴美国的经验,以促进我国证券业的发展。
