La protección de los derechos fundamentales del deportista en la lucha contra el dopaje. Una visión desde el ordenamiento jurídico español

Doping is addressed in this paper from two different scopes: on one hand, the legal regulations for prevention and repression are studied; on the other hand, the clash between the anti-doping control mechanism and a fundamental right such as the athlete's privacy is noted. We start from the irrefutable fact that “awareness against doping” is practically universal. The enactment of this law was a milestone in the history of the fight against doping in the Spanish regulation. However, the problem arises when the anti-doping legislation worldwide and in Spain, which enables some healthcare professionals and other people involved, to carry out several anti-doping operations that may conflict with the athlete's fundamental right to privacy, all of this in a context of strong media and social impact. For this reason, it is pertinent to raise the issue if one of these operations, such as the duty of permanent localization, is sufficiently justified in terms of protecting the sportsperson's health.     

新冠疫情防控常态化下加强创新集体协商工作的思考

由于国外新冠肺炎疫情的快速蔓延以及国内疫情的起伏,使得我国新冠疫情防控呈现出常态化和长期化的趋势。后疫情时期,构建和谐的企业劳动关系,助力企业复工复产和健康发展是工会组织的当务之急。集体协商制度是市场经济国家构建和谐企业劳动关系的根本制度和主要手段,工会组织要积极引导劳动关系双方在集体协商制度框架下主张各自的权利和寻求平衡点。     

Resurgent authoritarianism: the case of Russia's new NGO legislation

Following the protest demonstrations of the 2011–2012 electoral cycle, tensions between the limited modernization efforts of Medvedev and the resurgent authoritarianism of Putin have become increasingly manifest. These are seen not only in the relationship between society and the state, but also in the “para-constitutional” institutions of the dual state. This article argues that whereas Medvedev created an arena for liberalization within these para-constitutional structures, Putin has firmly rejected these policies, among other things by revising the 1995 law on NGOs amended in 2006. Using the perspective of the dual state, the article argues that with the introduction of the Law on Foreign Agents (2012), the original law draft On Public Control (2014), a key element in Medvedev's modernization program, was delayed and substantially altered. Together, these amendments create precarious conditions for NGOs, pressuring their independence by threats of dissolution and reducing the quality of civil control over state organs.

论物权的本质

传统的物权本质理论存在认识上的缺陷,该理论只注意到了物权与债权的本质区别,却没有注意到物权与所有权、他物权的联系与区别。民法上的物如同商品一样也具有价值(交换价值)和使用价值两个因素,而且这两个因素是物权的权利主体获得利益的根本。物权实质上是权利主体在法律规定的范围内,控制特定物质财产的交换价值,或自主地控制特定物质财产的使用价值,或全面、自主地控制特定物质财产的使用价值和交换价值的权利。     

气-质联用法（EI．PCI．NCI）在系统毒物分析中的应用

本文应用电子轰击质谱(EI),正、负化学电离质谱(PCI.NCI)技术,建立了315种常见毒,药物的气一质联用系统分析方法。并建立了 EIMS、PCIMS、NCIMS 质谱图谱库。司法鉴定实践表明使用气相保留指数,特征碎片和 EI、PCI、NCI 图谱库检索等多指标的系统分析方法,是未知物鉴定的强有力的工具。     

浅谈目前交通事故处理中的困惑和解决思路

道路交通事故是目前越来越引起公众关注的社会问题。许多国家通过制定交通法规来规范交通参与人的行为,保障交通安全。但在实际执法实践中,由于各方面的原因,公安交通管理部门对法规的实施出现了一些困惑。法定保障原则应考虑保障部门的利益问题,进一步完善通行规则和量化过错行为的划分依据,损害赔偿应当建立起赔偿与相应过错行为相对公平的赔偿体系。     

管控与疏导：群体性事件化解中的视角互换

如何应对群体性事件业已成为理论界关注的热点、焦点和政府工作的一个重点、难点,地方政府在长期的群体性事件处置过程中,已经建立了以维护社会稳定为导向,注重对群体性事件管控的工作模式,其重心在于＂堵＂与＂控＂。此种工作模式在处置群体性事件,维护社会稳定方面取得了一定的成效,但也存在实施成本很高、缺乏可持续性的弊病。由此,各级政府对于群体性事件的处置,既要看到其影响地区稳定等消极面,又要将群体性事件所隐含的积极因素挖掘出来,树立以管控与疏导适时互换为导向的工作理念,通过建立健全一系列相互关联的社会矛盾化解机制,将其转化为促进社会发展的要素,从而实现社会可持续发展。     

关于加强中国国家软实力建设的几点思考

10月18日中共十七届六中全会在北京落幕,会议审议通过了《中共中央关于深化文化体制改革、推动社会主义文化大发展大繁荣若干重大问题的决定》,国家文化建设作为软实力塑造的重要组成部分,将人们的视线再次拉回到传统文化建设上来。自从20世纪90年代初美国著名学者约瑟夫·奈提出“软实力”概念以来,它就开始成为世界各国关注的焦点。纵观近现代世界一流强国崛起的历史,可以看出“软实力”建设在其崛起的过程中发挥了重要作用。中国在和平发展过程中如何提高自身的国际影响力,如何通过软实力来塑造中国良好的国际形象,掌控能力、战略信誉以及表现能力非常重要。
