涉罪未成年人社会调查的价值根基及在社会调查报告中的体现——以未成年人刑事司法目标为视角的讨论

未成年人社会调查制度一定要满足未成年人刑事司法工作目标的需要,契合司法机关和司法人员履行末成年人刑事案件办理司法工作职责的需要.只有深入到未成年人刑事司法价值目标的层面才能洞悉涉罪未成年人社会调查制度存在的价值根基,才能结合不同的价值目标明确社会调查报告应着力反映的主要内容.     

FORENSIC Autopsy of People Having Committed Suicide in 2002 and in 2012: Comparison of Epidemiological and Sociological Data

This work compares epidemiological and sociological data on persons having committed suicide in 2002 and in 2012 through a retrospective study of every suicide case having led to an autopsy at the Institute for Forensic Medicine of Lyon in 2002 and in 2012. The study included sociodemographic data, medical data, and toxicological data. A total of 486 cases were included (242 cases in 2002 and 244 cases in 2012). People committing suicide were on average older in 2012 than in 2002 with a larger proportion of over 55. There was also an increase in the proportion of psychiatric antecedents (p < 0.001). Whatever the date of death by suicide, the most affected age range is the 45–54. The results highlight the necessity of bolstering the prevention plans, in particular for people over 45.     

To Behave Like a Liar: Nonverbal Cues to Deception in an Asian Sample

The detection of deception is an essential yet challenging component of investigative interviewing. Behavioural cues to deception in particular, have long been used in investigative interviewing contexts to determine decisions of suspect veracity and deceit. Nevertheless, deception research amongst non-American or European populations has yet to fully explore the effectiveness of such non-verbal observations. This study may be the first to examine truth-lie behaviours involving South-East Asian participants. In this study conducted in Singapore, 68 participants completed either a mock criminal task or a non-criminal task, before encountering an investigative interviewing scenario in which they had to lie or tell the truth to the interviewer. The results showed that liars displayed significantly more head movements and less hand/finger movements, as well as reported more feelings of guilt, than truth-tellers. Implications for investigator training and criminal investigative procedures are discussed.

刑事诉讼证人证言在诉讼证明中的地位十分重要,但长期以来,在这种证据的运用和审查判断中存在着一些怪圈。本次《刑事诉讼法》的修改对于证人证言现存问题的解决意义重大,但是,欲走出刑事诉讼证人证言的怪圈,还需要更多的努力。

The most common haplotype (DYS19-15, DYS389I-13, DYS389II-30, DYS390-21, DYS391-10, DYS392-11, DYS393-13, DYS385I/II-15,17) was shared by 5.5% of individuals. In the Bantu population in Central Africa, the haplotype diversity and the discrimination capacity of Y-STR may be estimated at 99.14% and 0.5333, respectively.

以新军事变革理念为指南,对军事司法若干理论问题作了探讨:(1)确定军事司法的概念是研究军事司法理论的重要基础;(2)军事司法具有一定的特殊性;(3)军事司法权是国家司法权的重要组成部分,并非寓于军事统帅权;(4)从军事司法权得以存在和对社会所产生的作用来认识其构成要素和功能;(5)军事司法的特有原则是国家司法活动基本原则下位的具体原则,是指导军事司法这一特殊领域的活动准则;(6)军事司法的基本理念是决定军事司法改革基本目标的价值准则。
