This paper argues that transitional justice needs to adopt a participatory approach to achieve longer-term sustainability, shifting away from the top-down 'one-size-fits-all' approach to allow 'voices from below' to be heard and heeded. It critiques dominant interpretations of key transitional justice concepts, and links them to the difficulties of post-conflict transitional justice in a range of violently divided societies. Popular participation and local agency, it is argued, is necessary to achieve ends identified in much transitional justice discourse, and to embed mechanisms for the creation of sustainable peace. A Northern Ireland initiative (the Ardoyne Commemoration Project) will be explored in-depth, illustrating how a bottom-up 'truth-telling' process can make a significant contribution to transitional justice and casting doubt on the validity of the deference to legal dominance in current policy and practice. Notwithstanding the Chancellor of the Exchequer's announcement in the 2006 Budget that, after the 2008 Research Assessment Exercise ('RAE 2008'), it is the government's firm presumption that the system for assessing research quality and allocating quality-related funding to United Kingdom universities will be mainly metrics based, RAE 2008 is vitually certain to proceed and to have considerable significance for legal research in the United Kingdom. We are adding reconstructed replication competent forms of the 1918 pandemic influenza virus containing any portion of the coding regions of all eight gene segments to the list of HHS select agents and toxins. We are taking this action for several reasons. First the pandemic influenza virus of 1918-19 killed up to 50 million people worldwide, including an estimated 675,000 deaths in the United States. Also, the complete coding sequence for the 1918 pandemic influenza A H1N1 virus was recently identified, which will make it possible for those with knowledge of reverse genetics to reconstruct this virus. In addition, the first published study on a reconstructed 1918 pandemic influenza virus demonstrated the high virulence of this virus in cell culture, embryonated eggs, and in mice relative to other human influenza viruses. The concept of emotional labour describes the management of emotions as part of everyday work performance. Much of the research in this field has been in relation to jobs in the service sector where (mostly female) employees are required to shape their own feelings in order to make customers or clients feel at ease, comfortable or happy. There has been relatively little attention paid to the importance of emotional labour in professional occupations. This paper examines the emotional labour of magistrates in court. Magistrates must often regulate their own emotions and those of some court users, many of whom are not legally represented and who express a variety of emotions, including anger and distress, and experience social problems that may elicit emotions or emotional responses from the magistrate. The paper reports findings from interviews with over 40 magistrates throughout Australia and begins to address the significance of emotional labour for this branch of the judiciary. 相似文献

<正> 立法的直接目的是要使法得到实施,最终目的则是调整、规范社会关系,使社会健康、有序、快速地发展。这既取决于法适应社会需要的程度,又取决于法的体系内部是否和谐。 由于立法的不周延以及立法侵权等原因,直接造成了法的体系内部不和谐,其突出表现是:法律、行政法规、地方性法规、部委规章等相互之间不协调一致。由此便带来了法的实施困难重重:要么无所适从,要么各取所需,妨碍了法的统一实施,并且在一定程度上助长了日益盛行的地方保护主义与部门保护主义。本文拟结合实例分析我国立法中存在的几个问题。 一、立法权限问题 在立法实践中存在着严重的侵权现象,出现了一定程度的混乱。有人称之为“立法无序”。表现在: (1)全国人大及其常委会的情况。一方面,存在着立法混乱,本该由全国人大制定的《民事诉讼法》,却是由其常委会制定,直到1991年4月9日第七届全国人大四次会议才修改通过。《村民委员会组织法》是先由全国 相似文献
