存车收费的法律性质是属于保管合同还是车位租赁合同在我国目前的立法上没有明确的规定。但随着社会经济的发展和私车拥有率的提高,这一问题的重要性日益突出。对这一法律关系的认定直接关系到司法实践中当事人责任和权利义务的划分。本文从这一法律关系的性质、特征、当事人的真实意思和约定的习惯等方面入手进行分析,并结合理论和司法实践中对此存在的争议。旗帜鲜明的提出了自己的观点和看法:“存车收费应定性为保管合同。”以期对司法实践中因这一问题的不确定所带来的混乱有所裨益。 相似文献

This paper investigates the complex security and economic dynamicsthat influence the lives and opportunities of self-settled refugeesliving in Uganda. It focuses on the opportunities and problemsfaced by self-settled refugees, and questions the assumptionthat Uganda's current local settlement policy is best suitedto the country's social, economic and political realities. Itsuggests that far from being passive victims, self-settled refugeesare taking control of their lives without any additional externalassistance and are planning for the day they can return to theirhomeland. In the following paper, I analyze the influence of advisers and domestic political factors on President Clinton's decision to use force against Slobodan Milosevic and the Serbs in Kosovo in March 1999. I present an analysis and examination of President Clinton's decision-making process, using press reports, personal speeches, etc. In other words, I attempt to trace the process by which Clinton came to the decision to use force in Yugoslavia. Specifically, using the poliheuristic theory, I argue that President Clinton's decision was influenced by noncompensatory domestic political calculations and the strong influence of his Secretary of State, Madeleine K. Albright. Examining how advisers interact with one another, their status in the advisory group, and the manner in which presidents solicit information from advisers will further our understanding of how, when, and under what conditions national security-level decision makers make decisions. 相似文献

This paper looks at the genesis of a discourse on urbanismo (city planning) in Brazil and Argentina between 1894 and 1945 using the ideas of Michel Foucault on discipline and his concept of bio–power. The demographic pattern of the major cities in both countries from 1890 onwards and the renewals of the centres of these cities are also discussed. Other sections are dedicated to the plans proposed for the same cities in the 1920s and to urban representations, such as ideas about social reform, the role of hygiene as a point of departure for planning, and the relationship of ideas on Taylorism (scientific management) and the city. The paper also discusses the planners opposition to elections, when they claimed that they were the only ones qualified to deal with urban problems and therefore they should be employed in the state apparatus.
Other concerns of the paper are the use of planning as an element of nation building and ideas defining eugenics (race 'betterment') as an important aspect of city planning. I conclude by arguing that, if implemented, city planning was a way of creating an industrial culture, disciplining society through the city, although the industrial proletariat has never made up the majority of the population in Brazil or Argentina. Even if many aspects of the plans proposed for both countries were not implemented, the discourse of planners can be seen as a will to discipline society through the city. Earlier research on the relation between school features and petty crime suggests that schools can intentionally influence the crime rate of the pupils. These findings were the starting point for a Dutch study at secondary schools of the same type in Dutch towns. The study focused on effects on the delinquency of third-year low-stream pupils (aged 15–17). For the study a control theory was formulated, a conditional control theory, which, in contrast to Hirschi's social control theory, recognizes possible delinquent influences of the pupils' network. In the study a strong statistical relation between integration of pupils in school and petty crime was found. However, I found almost no influence of the studied school features on integration and petty crime. These results led to the question whether the real important feature of schools had been neglected in the study. This seems not to be the case. A multilevel analysis shows that it is unlikely that there is major impact of schools on the integration of pupils, on delinquency, or on the relationship between integration and delinquency. This can be the result of special aspects of the Dutch school system and of the neglect of theory in earlier research. 相似文献
