丝绸之路经济带建设中金融支持与保障研究

丝绸之路经济带建设坚持“政策沟通、道路联通、贸易畅通、货币流通、民心相通”的五通原则中,货币流通是基础和先导。开展金融合作不仅是经贸合作的基础,而且也是顺应金融市场全球化和金融监管国际化的内在要求。从微观、中观和宏观三个角度阐述金融在丝绸之路经济带建设中的支持作用,分析丝绸之路经济带建设中的金融支持面临的各种挑战,建议从开发性金融为先导引领区域金融支持;拓展人民币结算和扩大互换规模,推进区域性金融支持;推进国内金融机构的国际化水平;发展互联网金融,创新金融支持模式;建立丝路区域性国际金融中心;加强国际金融治理以及金融监管协调合作。     

新中国治安治理结构演进路径解析

新中国成立以来,我国治安治理结构经历了"磁斥结构-磁吸结构-耦合结构"的演进路径,在不同的时代背景之下,各治理结构呈现出其所特有的治理逻辑和基本特征。从认同性、社会自主性、公共性、参与性四个方面对三种治理结构进行比较分析来看,未来治安治理结构的发展规律,将在很大程度上同国家与社会间良性互动的耦合治理结构相吻合。     

发达国家治理历史虚无主义的实践与启示

近年来,历史虚无主义在发达国家政治生活和舆论空间时有体现,成为不和谐因素,引起了执政当局的高度关注。为了维护意识形态安全和国家安定团结,发达国家不遗余力治理历史虚无主义,在政界、学界和新闻工作中始终强调历史清醒和"政治正确",树立底线意识;加强青少年爱国主义教育,强化历史观塑造;通过立法和司法实践,维护历史共识和民族英雄声誉;着力治理网络舆论,源头防范网络历史虚无主义。发达国家治理历史虚无主义的实践是维护资产阶级政治统治的重要举措,存在典型的"单向度思维"和不可避免的局限性,采取的一些做法对当前我国反对历史虚无主义,具有一定的借鉴意义和参考价值。     

The culture of risk regulation: Responses to environmental disasters

Disasters challenge the equilibrium of regulatory regimes and make policy shifts more likely. Using an institutional theory of cultural biases and the concept of cultural “surprise”, this article analyses the direction and intensity of media argumentation in respect of policy shifts. Instead of assuming a demand for greater State intervention after dramatic focusing events, as suggested by other theoretical frames, cultural theory opens a variety of options that range from embracing regulatory responses from different cultural biases to the radicalization of current, but failing, instruments. The analysis of media reaction to the environmental disasters caused by the oil spills of Exxon Valdez (United States), Erika (France) and Prestige (Spain) shows that the demand for more hierarchy does not monopolize the overall argumentation. The change demanded often implies a radicalization of a particular prevalent view where the associated institutional setting is failing its supporters.

When national symbols divide: the case of pan-Catalanism and the Països Catalans

Shared symbols are an essential element in nationalist mobilisation. National symbols provide perhaps the strongest, clearest statement of national identity and are socially constructed. The effectiveness of these symbols will determine the success or failure of a political and cultural project. The effectiveness of cultural and political symbols can be seen through examination of the project of pan-Catalanism, the Països Catalans (the Catalan-speaking countries). This political project is rather unusual in the nationalist literature in being unable to advance beyond an embryonic stage. While cultural affinity can be determined within the Catalan-speaking territories, a wider claim to pan-Catalan political identity has foundered. This article argues that the absence of a shared attachment to national symbols in Catalonia, Valencia, the Balearics and other Catalan-speaking areas, provides the principal explanation why successful nation building has not been achieved.     

Violence on Iraqi bodies: decolonising economic sanctions in security studies

Abstract

United Nations agencies report that by 1998, Iraqi infant mortality had risen from the pre-Gulf War rate of 3.7% to 12%. Insufficient food and medical supplies and deterioration of sewage and sanitation systems and electrical power systems reportedly caused an increase of 40,000 deaths annually of children under the age of 5 and of 50,000 deaths annually of older Iraqis. Why is this violence on Iraqis absent from analyses of sanctions in international relations and security studies? This paper is concerned with, first, situating sanctions against the Global South as violence by challenging the conventional theorisation of violence inflicted by the hegemon as a mechanism of ‘national security’. Second, we offer a decolonial reading of the sanctions imposed on Iraq by shifting the locus of enunciation from the state to Iraqi people’s suffering.     

高绩效人力资源管理系统与员工创新行为 ：建言行为的竞争机制研究

如何促进员工的创新行为对组织的发展至关重要。本研究通过多源、多时点调研方式，对我国技术型企业的人力资源部门负责人及其下属员工进行问卷调查，探讨了组织实施的高绩效人力资源管理系统对员工创新行为的影响，并检验了促进性建言与抑制性建言的竞争性中介作用及心理安全感的调节作用。研究结果表明：组织实施的高绩效人力资源管理系统对员工创新行为有显著正向影响；促进性建言和抑制性建言在高绩效人力资源管理系统与员工创新行为间表现出部分中介作用；心理安全感调节了高绩效人力资源管理系统与促进性建言之间的关系；同时，心理安全感还调节了促进性建言对高绩效人力资源管理系统与员工创新行为关系的中介作用。     

浮动抵押逸出担保物权体系的理论证成

具有担保功能的权利,并非都是担保物权。如果一项权利既不符合担保物权的特征,亦有违物权法的基本原则,就不属于担保物权。对比浮动抵押与担保物权的特征可以发现,浮动抵押有担保功能但并非担保物权。在民法典编纂背景下,宜将浮动抵押从担保物权体系剔除。考察比较法资料,结合“charge”的词源语义,遵循语言翻译的忠实严谨原则,宜将“floating charge”译为“浮动担保”而非“浮动抵押”。至于浮动担保何去何从,相对合理的方案是将其嵌入合同法域,规定于我国民法典合同编之“合同的担保”章节,以此彰显民法典的体系性与逻辑性。     

新冠肺炎疫情期间公安法医应当加强尸体甄别和个体防护

因鉴定体制特点,公安法医除参与尸体有关的现场勘查工作外,还需进行尸体检验工作。在此过程中,可能面对很多风险,受伤和中毒等事件时有发生。然而,国内公安法医对新冠肺炎等传染病流行期间死亡的尸体如何甄别进行尸体检验鉴定,对现场勘查及尸体检验工作的防护只有少量规定,且内容不够详尽。本文对法医在现场勘查中遇到的尸体及尸体检验中实验室建设、职业现状、风险评估及防范措施等进行了论述。最后,建议出台相关的制度规定等具体约束规范措施,以保障公安法医现场勘查及尸体检验工作的顺利进行,以解除基层鉴定机构和鉴定人的后顾之忧。
