Beyond Rainforests: Urbanisation and Emigration among Lowland Indigenous Societies in Latin America

Indigenous societies across lowland Latin America have recently made impressive political and territorial gains by emphasising their stewardship of and attachment to particular rural landscapes. But surprising new censal and microdemographic evidence shows that these groups have simultaneously been developing a presence in domestic and foreign metropolises. Cities offer employment and advanced education opportunities as well as escape from rural conflicts. We suggest that the dynamics and outcomes of these migrations are distinct from those of other rural Latin Americans. By outlining specific areas in which migration, politics, and territory appear to be interlinked, we seek to stimulate research that engages with these processes and their implications for indigenous advocacy and migration theory.

目前国际社会中同性同居者争取合法地位的运动已经在一些国家或地区取得成功.各国面临是否承认外国或外法域同性同居关系的局面.随着我国对外开放的深入,我国法院将来也会面临这些问题.如果一概拒绝承认基于外法域法律成立的同性同居关系,可能不利于保护依附该关系而成立的其他民事法律关系,因此,应当区分不同情况.区际私法中尤其需要慎用公共秩序保留制度,当同性同居关系仅仅是作为其他问题的先决问题时,我国大陆法院可考虑适当承认该关系的有效性.

Keine ?nderung der wirtschaftlichen Einflussm?glichkeiten liegt vor, wenn es zu Anteilsübertragungen oder Umgründungen zwischen konzernverbundenen Gesellschaften kommt, aber sich bei jenen Personen nichts ?ndert, die auf der obersten Ebene den Einfluss ausüben. Derartige Handlungen innerhalb eines Konzernverbunds verwirklichen nicht den Tatbestand des § 12a Abs 3 MRG.     

An Analysis of the Joint Board or County Model as the Structural Basis for Effective Australian Local Governance

Australian policy‐makers continue to rely on municipal amalgamation as the main engine of structural reform in local government, despite strong evidence that it diminishes participation and representation without improving service efficiency. Several promising, but neglected alternative models of structural reform have been developed, including ad hoc resource sharing models, Regional Organisations of Councils, virtual local government, and agency models. In an encouraging response to the recent policy of enforced council amalgamations in NSW, the Shires Association of NSW (2004) has recently proposed a ‘Joint Board model’ of local governance and invited comment on this model. This article takes up this challenge and seeks to place the Joint Board model in conceptual context and evaluate its characteristics and simulated cost savings.

Wenn der Mieter im Zuge umfangreicher und kostenaufwendiger Adaptierungsarbeiten entgegen der im Mietvertrag ausdrücklich erkl?rten ursprünglichen Einsch?tzung der Vertragsparteien die Undichtheit der Gasleitungen erkennt, dann entspricht es Treu und Glauben, den Vermieter über diesen Mangel zu informieren und ihm die Gelegenheit zur Sanierung zu geben.     

Self-settled Refugees in Uganda: An Alternative Approach to Displacement?

This paper investigates the complex security and economic dynamicsthat influence the lives and opportunities of self-settled refugeesliving in Uganda. It focuses on the opportunities and problemsfaced by self-settled refugees, and questions the assumptionthat Uganda's current local settlement policy is best suitedto the country's social, economic and political realities. Itsuggests that far from being passive victims, self-settled refugeesare taking control of their lives without any additional externalassistance and are planning for the day they can return to theirhomeland. Consequently, the paper argues that there is reasonto believe that local integration is likely to succeed whereother models have failed.

企业集团的多重利益冲突及其治理

企业集团作为一种企业合作组织形式，一方面因其制度优势而在世界经济中的地位日益重要，另一方面因其复杂结构所带来的诸多治理问题又制约了其良性发展。与单个企业相比，企业集团的组织结构复杂多变，治理问题也具有多重性。交叉持股型企业集团中应注意大股东之间的协调问题；纯粹控股型企业集团中注意要加强母公司对子公司的有效监控；而母子关系型企业集团中的治理问题最为复杂，应在母子公司之间建立一个良好的集权和分权机制，防止母公司对中小股东和债权人的利益侵害。     

创设船舶预告登记制度之探讨

结合民法物权预告登记的基本原理,针对海商法领域尚未制定船舶预告登记制度的欠缺,本文从理论和实践两个方面探讨了我国确立船舶预告登记制度之必要性,并对该制度的适用范围做了初步性的探讨,提出了笔者自己的观点。
