Observer determination of the make,model, and year of questioned vehicles

Often, criminal acts involving a vehicle are caught on digital video surveillance systems. While potentially useful for an investigation, the recording conditions are typically less than optimal for the extraction of key information for the identification of the perpetrator, such as a license plate. Providing the make, model and year of a questioned vehicle is a common request for examiners, to narrow the field of potential suspect vehicles. This study seeks to compare the performance of a nonpeer-reviewed make, model, and year determination between two separate groups, specifically, trained forensic image examiners and nontrained individuals. Results show that even with varied image capture conditions and quality, the trained forensic image examiners more correctly and completely identified the test group of questioned vehicles make, model, and year.

政府购买公共服务是公私协力的表现,是担保国家理论在行政法中的具体化。透过担保国家理论、公私协力背景分析政府购买公共服务的行政法属性,政府保证责任作为政府购买公共服务的责任转型,有其宪法渊源与民事责任阙如的现实需求。基于保障社会公众以合理的价格持续、均等地获得质高价优的公共服务之目的,政府保证责任可以类型化为监督责任、管制责任、接管责任,其内容体现为保证有限竞争、质量与价格供给、持续与均等供给以及公共服务的信息公开与公众参与。可以通过行政规制、契约治理及信用监管等措施,促进政府保证责任的最终实现。     

Elections and Democracy in Turkey: Reconsidering Competitive Authoritarianism in the Age of Democratic Backsliding

This article reflects on the reasons why Erdoğan and the Justice and Development Party (AKP) could still win in the recent 2023 presidential and parliamentary elections in Turkey despite, among other daunting issues, the deep economic crisis and their unsuccessful handling of the February 2023 earthquake. The article discusses the role of state apparatus and the media under a neopatrimonial system, as well as the role of the EU, which turned Turkey into a rentier state with the refugee deals. The discussion considers whether Turkey could still be seen as a competitive authoritarian regime and points to the difficulties in determining whether regimes such as the Turkish one are competitive authoritarian or not until the election results are seen and the opposition candidates actually win.

一 1 9岁男子赌气吞服一白色粉末 ,1 0min后口鼻流血、抽搐 ,迅速送医院 ,经催吐、透析等方法治疗 5天后死亡。根据中毒症状和经验怀疑为毒鼠强中毒。用GC/NPD检验肝中毒鼠强有干扰。改用GC/MS -SIM法分析 ,心血、肝和胃组织中全部检出毒鼠强 ,浓度分别为 0 5 1 μg .mL- 1、0 4 5 μg .g- 1和 0 33μg .g- 1,和文献结果在同一水平。GC/MS -SIM对复杂检材中低含量毒鼠强测定具有更高的选择性 ,也具有较高的灵敏度 ,同时进一步证实毒鼠强排泄较慢 ,经过较长时间后在体内分布比较均匀     

The Future of Northern Ireland: the Role of the Belfast/Good Friday Agreement Institutions

Since the 2016 Brexit referendum a series of crises has gripped Northern Ireland's politics. This has had a destabilising effect across society, which has arguably been felt most acutely by political unionism. The Belfast/Good Friday Agreement (B/GFA) of 1998 created a series of institutions to deal with political conflict in Northern Ireland, manage cross-border cooperation and normalise relations between the UK and Ireland. However, many aspects of it have been sparingly and ineffectually deployed, most notably the second and third strands dealing with north/south and east/west relations respectively. In this article, the authors argue that regular use of the institutional arrangements created by the Agreement would help to deal with the challenges currently facing Northern Ireland and help address unionist anxieties over the Protocol. Use of the North-South Ministerial Council (NSMC), the British Irish Council (BIC) and the British-Irish Intergovernmental Conference (BIIGC) should be prioritised. The unresolved issues arising from Brexit require a recommitment to the intergovernmental logic at the heart of the 1998 Agreement, despite the obstacles.     

Reproductive health services: “Business-in-a-Box” as a model social innovation

Access to reproductive health services and products in remote and rural communities is a critical area of concern for developing countries. This article considers a pilot intervention in three districts of Pakistan where “Business-in-a-Box” as a model of place-based social innovation is used to improve the socio-economic conditions of women in remote rural settings through socially responsible micro-franchising. It finds that such programmes help build a sense of community, ownership and grassroots capabilities and skills. The article also discusses the impacts of such actions on the individual and community life, and the need to upscale and sustain these initiatives.     

国家赔偿责任的民法基础

历史上盛行国家无不法行为能力理论,据此国家不对其公务员履行职务时的侵权行为承担责任,公务员要自己承担赔偿责任。随着法治国家观念的确立,国家开始代替其公务员向受害人承担赔偿责任,即所谓的代位责任。也有国家确立了国家的直接赔偿责任,即自己责任。但无一例外,国家的赔偿义务均建立在民法基础上,以全额赔偿为原则。我国国家赔偿制度确立了独一无二的"个人不赔,国家不全赔"的赔偿模式,偏离了赔偿法所固有的民法属性,无法良好保护受害人。而其根源则在于欠缺对国家赔偿责任的历史与本质的全面理解。有鉴于此,应尽快修订《国家赔偿法》,确立国家的全额赔偿责任,更好地服务法治国家的建设。     

浮动抵押逸出担保物权体系的理论证成

具有担保功能的权利,并非都是担保物权。如果一项权利既不符合担保物权的特征,亦有违物权法的基本原则,就不属于担保物权。对比浮动抵押与担保物权的特征可以发现,浮动抵押有担保功能但并非担保物权。在民法典编纂背景下,宜将浮动抵押从担保物权体系剔除。考察比较法资料,结合“charge”的词源语义,遵循语言翻译的忠实严谨原则,宜将“floating charge”译为“浮动担保”而非“浮动抵押”。至于浮动担保何去何从,相对合理的方案是将其嵌入合同法域,规定于我国民法典合同编之“合同的担保”章节,以此彰显民法典的体系性与逻辑性。     

QuEChERS-LC/MS快速检测兽用麻药“舒泰”

目的本文对兽药"舒泰"中有效成分进行了结构确证,并建立了生物检材中替来他明和唑拉西泮的快速检验方法。方法在血液和尿液的生物检材中,通过加标实验,经QuEChERS萃取后,进行LC/MS对替来他明和唑拉西泮的定性定量检测分析。结果在血液和尿液的生物样品的加标实验中,替来他明的RSD%在0.5%~3.5%,唑拉西泮的RSD在0.5%~1.1%;替来他明的回收率在75.8%~100.3%,唑拉西泮的回收率在68.8%~76.6%,其中血液中替来他明的方法检出限为0.16ng/mL,尿液中为0.20ng/mL,唑拉西泮在血液中的方法检出限0.17ng/mL,尿液中为0.22ng/mL。结论建立的QuEChERS萃取方法,操作流程简便,方法重现性好,只需100μL取样量,更适合于痕量生物检材中替来他明和唑拉西泮的检验分析。     

新冠肺炎疫情期间公安法医应当加强尸体甄别和个体防护

因鉴定体制特点,公安法医除参与尸体有关的现场勘查工作外,还需进行尸体检验工作。在此过程中,可能面对很多风险,受伤和中毒等事件时有发生。然而,国内公安法医对新冠肺炎等传染病流行期间死亡的尸体如何甄别进行尸体检验鉴定,对现场勘查及尸体检验工作的防护只有少量规定,且内容不够详尽。本文对法医在现场勘查中遇到的尸体及尸体检验中实验室建设、职业现状、风险评估及防范措施等进行了论述。最后,建议出台相关的制度规定等具体约束规范措施,以保障公安法医现场勘查及尸体检验工作的顺利进行,以解除基层鉴定机构和鉴定人的后顾之忧。
