检察机关司法审查制度的构想

鉴于检察机关司法审查主要是针对刑事审前程序中的强制性处分行为,而这种强制性处分行为又可分为人身保全措施和证据保全措施,因而两者的某些具体措施应当成为司法审查的对象。此外,检察机关自行侦查中采取的有关强制性处分行为,也应列入司法审查的范围,只是在审查的方式和要求     

欺诈性抚养关系中“生父”的赔偿责任

欺诈性抚养关系中无抚养义务人受到的财产损失和精神损害应当获得赔偿，非婚生子女的生父、生母应承担连带赔偿责任。在非婚生子女的生母不指认生父、或生父不认领非婚生子女、以及第三者不同意作亲子鉴定的情况下，应考虑在有证据证明第三者可能是生父的情况下强制第三者作亲子鉴定，第三者仍不作亲子鉴定的，应当依法推定第三者为生父，并追究其侵权的赔偿责任，以保护欺诈性抚养关系中无抚养义务人的合法权益，体现法的公平正义。     

事业单位人事法制建设的几点思考

建立完善的人事法律体系是我国民主法制建设的重要组成部分,是建设服务型政府、法治政府的需要。随着事业单位人事制度改革的推进,相关的法律法规建设也有待加强和完善,尤其是增加行政法规和部门规章的立法项目。尽快出台具有权威性的法律法规,对事业单位聘用制度、岗位管理、工资福利等方面进行全面规范。     

A social learning model of adolescent contraceptive behavior

Central to an understanding of adolescent pregnancy and sexually transmitted disease prevention is the study of birth control use among teenagers. This paper critically reviews both recent research findings and dominant theories regarding adolescent contraceptive use. An alternative theoretical framework, one that relies on social learning theory, is offered. This framework uses three major components — environmental context, cognitive influences, and behavior execution constraints — as the foundation for understanding the learning and maintenance of contraceptive behaviors. First, environmental factors, such as the availability of role models, accurate sexuality education, and birth control services, are seen as supporting or inhibiting birth control use. Second, the importance of cognitive functions through which the external environment is viewed and which influence the adolescent's image of the consequences associated with contraceptive use are highlighted. Last, the actual behavioral skills teenagers need in order to use birth control successfully are considered.Received D.S.W. in Social Welfare from the University of California — Berkeley. 刑事法视野中犯罪行为研究体系的修正

对犯罪行为的研究一直以来都是由刑法学和犯罪学来担纲。刑法学把犯罪行为作为构成要件的要素来研究，它以犯罪行为的确定性为前提；犯罪学把犯罪行为作为社会现象来考察，它显示的是概略的、非要件式的行为特征。而实现概略的非要件式行为向确定的要件式行为的过渡，既不是犯罪学也不是刑法学本身所能解决的。对犯罪行为研究的体系存在缺陷。本文通过对犯罪学和刑法学中的犯罪行为的比较研究，提出创设独立学科是完善犯罪行为研究体系的必要途径。     

Who Toes the Party Line? Cues, Values, and Individual Differences

This article explores individual differences in citizens’ reliance on cues and values in political thinking. It uses experimental evidence to identify which citizens are likely to engage in heuristic processing and which citizens are likely to engage in systematic processing in developing opinions about a novel issue. The evidence suggests that political awareness crisply distinguishes between heuristic and systematic processors. The less politically aware rely on party cues and not on an issue-relevant value. As political awareness increases, reliance on party cues drops and reliance on an issue-relevant value rises. Need for cognition fails to yield clear results. The results suggest two routes to opinion formation: heuristic processing and systematic processing. Political awareness, not need for cognition, predicts which route citizens will take.     

‘The Worst Job in the World’: Reform,Revolution, and the Secret Rebellion in Florida's Cane Fields

Governments around the world are embracing guestworkers as a flexible labor force. The untold story of 1960s-era strike wave among Caribbean sugarcane cutters in Florida shows how the longest-running US guestworker program – the H2 Program – has functioned. The program, which began in 1942 and continues today, provided Florida's sugarcane industry with its sole source of harvest field labor, and became all the more important in the 1960s as the Cuban Revolution and the embargo that followed it caused Florida's industry to expand exponentially. Expropriated Cuban sugar moguls adopted the labor practices pioneered by the US Sugar Company, importing mostly Jamaican peasant farmers as temporary workers and deporting those who refused to accept their terms. Federal efforts to mitigate growers' exploitative practices only encouraged worse labor abuses. Cane cutters defended themselves with frequent strikes but deportations made insurgency's gains ephemeral.

观念认同与地区秩序建构——兼谈中国新安全观在建构东亚秩序中的作用

观念认同对地区秩序建构有着重要意义。观念认同建构行为体的身份和利益,进而改变或影响行为体的行为,在地区秩序建构中起到了"路线图"和"粘合剂"的作用。地区行为体之间的观念认同决定了它们互动的形式和态度,界定了地区秩序的自我属性,框定了战后地区秩序的建构原则,因而成为建构地区秩序的重要因素之一。中国首倡的新安全观与东盟主张的地区规范产生了积极互动,推动东亚观念结构由洛克文化向康德文化演进。
