Abstract

The focus in this article is the creation of self and other in the life writing of women associated with famous men. The central texts are the ‘autobiographies’ of the English novelist, Violet Hunt, and the Australian painter, Stella Bowen, both of whom were the partners of the writer, Ford Madox Ford, Hunt from 1908 to 1918, Bowen from 1918 to 1928. The ways in which biography is concealed in autobiography and autobiography in biography and the similarities in representations and storylines in both texts are explored.  相似文献

Abstract

Traditional language of the law is called “legalese” because it is difficult for those not trained in its mystery to understand. A myth about legalese is that it is necessary for certainty in law. This is untrue. The proponents of plain English have shown through their writing that the use of plain language in legal writing produces certainty in language that is easy to read and understand. This article looks at the history of the plain English movement and discusses its benefits, shows how legal writing can be improved by its use and, in the final section, briefly gives an illustration of how a culture of plain English writing can be embedded into a law school curriculum.  相似文献

Abstract

The question posed in this article is how to explain that the governance of secrecy in EU external relations varies. While the Common Foreign and Security Policy appears to retain its secretive character, the EU’s external trade policy has recently seen a shift towards more transparency. This article argues that to understand this variation, one has to take into account the institutional power of the European Parliament as well as the extent to which the rules and practices of secrecy are perceived as legitimate. The empowerment of the Parliament in trade means that it has had recent success in pushing back secrecy in this area. However, a general finding is that the majority of parliamentarians seem only rarely to question the executive’s governance of secrecy in external relations. The analysis shows that perceptions of legitimacy are crucial to account for different secrecy regimes – a finding that is likely to be relevant for the understanding of secrecy in foreign policy beyond the EU.  相似文献

To date the literature on subjective well-being has focused on the developed economies. We provide empirical evidence from two emerging market countries, Peru and Russia. Our results - and in particular a strong negative skew in the assessments of the respondents with the greatest income gains - support the importance of relative rather than absolute income differences. Among other factors, we attribute our results to shifts in reference norms and to macroeconomic volatility. Relative differences seem to matter more for those in the middle of the distribution than for the very wealthy or the very poor. Our respondents were more critical in assessing their progress vis-à-vis others in their country versus those in their community. The large and consistent gap we find between objective income trends and the subjective assessments of the upwardly mobile may have implications for the future economic and political behaviour of a group that is critical to the sustainability of market policies.  相似文献

What happens when the exception becomes the norm, what happens when the law becomes a form for that which cannot have a legal form, that is, the political? The focus of this article is a form of power politics that is institutionalised and set up to work side by side with the existing legal system as a sort of normalized, co‐ordinated court procedure, initiated with the aim of subjecting specific groups (terrorists, criminals) to extended regulatory control and enforcement. These strategic bureaucratic mechanisms of exclusion appear as security enforced measures, which side by side with the existing ‘normal’ legal system govern a specific judicial‐political area. The normalised (or rooted, if one wishes) incorporation of extra‐judicial authority within the legal system will in the article be refered to as institutionalised judicial exceptionalism. The purpose of the article is to theorise and conceptualise the in many ways murky or indistinct phenomenon of institutionalised judicial exceptionalism.This task includes suggesting a model capable of assimilating within its theory the displacement in the relationship between the state, the law and the citizen that stems from the fact that the ever more securitized discourses on terrorism and crime increasingly take priority over the ordinarily non‐derogable principle of equality before the law.  相似文献

ABSTRACT

In this paper I argue that there is a notion of autonomy which can be extrapolated from Wollstonecraft’s work: central to this notion is the need for us all to adopt a disposition to non-domination.Thus, an individual is autonomous when she is not dominated but also, how she behaves towards others is significant, for she is only truly autonomous if she does not dominate others. I argue that such a disposition can be read in Wollstonecraft as something which cuts across the public/private divide. It is based on the notion that individuals are always capable of being rational in both of these spheres. There must be a disposition to non-domination because Wollstonecraft demonstrates how domination is corrupting, and when this disposition is lost we find ourselves faced with myriad concerns from slavery to multiple forms of social oppression. Domination creates relations of dependency. It is arbitrary and contingent and makes us relate to each other with a marked lack of compassion. Instead, Wollstonecraft stresses we have a duty to treat others as equals and key to this duty is the need to not dominate others. Finally, I highlight how Wollstonecraft suggests such a disposition is to be gained through education.  相似文献
