Recently, increasing references are made to the international community that is conceptually and analytically useful when distinguished from the international society. Supposedly, the relations of some international agents can be described as a community due to their shared we-feeling, identity or ethos. This article discusses ‘thick’ and ‘thin’ international communities and suggests additional criteria that ought to be considered when determining whether a particular actor or agent is or is not a member of the international community. Moreover, the article suggests a dynamic conception of the international community as a context-dependent configuration rather than as some relatively stable subgroup of the international society. In this sense, this article offers an innovative perspective to collectivities through a focus on the international community. On a different level, this opportunity is used to draw attention to the roles beliefs play in and in the study of international politics.  相似文献

This article concerns the legal regulation of medical research on children in Finland. The topic is covered by the Medical Research Act of 1999 and by the Recommendations issued by the Working group on medical research on children in 2003. The Decisions of the Parliamentary Ombudsman also play an important role in this area in Finland. The article focuses on two specific issues: involvement of guardians in decision-making for the child, and the expansion of the right to self-determination of minors. Two case examples on these topics are also discussed. Overall, the author comes to the conclusion that the Finnish legislation, policy-makers, investigators and the industry have succeeded well in taking into account international legislation in this area, although there is also room for improvement.  相似文献

The application of DNA typing methods after amplification by the polymerase chain reaction (PCR) of DNA derived from body tissues from charred fire victims was investigated. A total of 26 different tissue specimens from ten extensively burned individuals were analyzed. The samples included femoral muscle, psoas muscle, bone marrow and blood. The post-mortem period varied from 38 to 183 h. After amplifying the DNA by PCR from the various tissues, the D1S80 locus was analyzed with a high resolution polyacrylamide gel electrophoresis technique followed by silver staining and the alleles of the HLA-DQ alpha locus were detected by using a reverse dot blot format. All samples could be typed for both loci and the genotypes were consistent in the various tissues from each individual. A parentage test was performed in two cases and Mendelian inheritance of the alleles for both loci was observed.  相似文献

The role of unacknowledged classified programs remains an enigma for fully understanding activities in space and the study of astropolitics. Classified programs by law are not publicly announced, and remain inaccessible to all except those with valid security clearances to be briefed about them. In the United States, waived Unacknowledged Special Access Programs are the most highly classified programs conducted by the military and intelligence community. The same classification protocols are also required of private contractors working with U.S. military departments and intelligence agencies on classified programs. As space continues to grow in its national security significance, the number of these unacknowledged programs pertaining to space is likely to grow significantly from its current number. This requires adopting the necessary conceptual tools and methodological flexibility for investigating unacknowledged activities in space. This also extends to evidence concerning unidentified flying objects and extraterrestrial life. This article suggests that “exopolitics” is a unique multidisciplinary approach to extraterrestrial life that offers a helpful set of conceptual tools for studying unacknowledged space activities, and complements the field of astropolitics.  相似文献

Southeast Asia is one of the most underrepresented regions in the International Criminal Court (ICC). I address the question of non-ratification of the Rome Statute with a case study on Indonesia. While the Yudhoyono Administration has repeatedly promised to join the ICC, ratification has not materialized. I argue that Indonesia's tradition of emphasizing the protection of state sovereignty and economic gains in its foreign policy decisions best explains why it remains outside the ICC's jurisdiction. I test this claim by exploring Indonesia's human rights record, potential legal restrictions for the ratification of the Rome Statute, and the influence of domestic political players and external pressures.  相似文献

Current international legal instruments recognise the use of advance directives to carry on the will of the dementing research participant beyond the boundaries of her present legal capacity. Advance directives are gaining greater recognition in patient care than in medical research, where their legal status is still somewhat unclear. In particular, the three major international documents on medical research - the Council of Europe Convention on Biomedicine and Human Rights (ETS 164), its Additional Protocol on Biomedical Research (ETS 195), and Directive 2001/20/EC on Clinical Trials on Medicinal Products--give conflicting messages on the legal status of advance directives in medical research. This article examines the provisions in these documents and their national applications in Finland and the United Kingdom.  相似文献
