The terminology of “civil society” has gained currency in recent discussions of democratic movements around the globe. Although less grandiose in its implications than claims about the “end of history,” this terminology does suggest a certain universality in human experience. We argue that this claim of universality is warranted, but also problematic. We establish the relevance of our argument in reference to the literatures in African and Indian studies. We note first that the common employments of the concept ignore the theoretical and historical specificity of civil society: civil society is used to label any group or movement opposed to the state, regardless of its intent or character, or used so generically that it is indistinguishable from the term “society.” Instead, we argue that civil society is a sphere of social life, involving a stabilization of a system of rights, constituting human beings as individuals, both as citizens in relation to the state and as legal persons in the economy and the sphere of private association. Thus, we link the wide resonance of the concept to its embeddedness in the logic of liberal capitalist society and the capitalist global division of labor. This conception allows us to see that, although the emergence of a sphere of civil society involves at least minimal democranization and is supportive of struggles for further democratization, the status of democracy is also made quite problematic by the tensions endemic to liberal capitalism and the processes of uneven development within international capitalism. Our usage also allows us to distinguish more clearly movements dedicated to the construction of civil society from those that may count actually as counter-civil society movements. David L. The present paper uses various data sets and statistical techniques to examine the outcome of gerrymandering under the Voting Rights Act of 1982 on turnover rates in the U.S. House of Representatives, as well as the competitiveness in Party primaries for House seats. Evidence presented here suggests that political redistricting at the federal level (namely for U.S. House seats) has tended to favor incumbents in both the Party primaries and general elections. In fact, some results suggest that turnover rates (for 1988) are between 8.9 and 10.3 percentage points lower within states that engaged in such redistricting efforts. Our findings generally support the main tenets of the public choice view of legislator behavior.  相似文献

The Indian government unveiled new farm legislation on September 27, 2020, with the goal of empowering the farming community. According to the government, new farm regulations will reduce the reliance of indigenous farmers on the mandi (market yard) system, which is now in place and is quite exploitative and full of middlemen and legal cartels. The regulations made contract farming lawful with the intention of luring private sector investment in bolstering agricultural supply chains and infrastructure to give farmers better pricing. But these rules are referred to as repressive and anti-farmer by the farming community. Farmers believe that eliminating the mandi system will eliminate the minimum support price (MSP) mechanism and that contract farming will ultimately be damaging, enticing major corporations and private investors to bind them to unfair contracts that will result in exploitation. Farmers' demonstrations have begun as a result in the former territory of the green revolution. In order to determine if the new farm regulations introduced by the central government are indeed beneficial to the rural community or not, the article followed the debate among many academics, policy makers, economists, researchers, stakeholders, and politicians (the government's spokesman). The article's main focus is on analysing the farmers' demand for the new farm rules to be repealed and the economic justification for their opposition. Additionally, it contends that new farm rules will encourage capitalistic farming and endanger the viability of farming communities, particularly small and marginal farms (S&M).  相似文献

The purpose of this article is to analyze the process of restructuring the Egyptian public health sector according to the new mode of governance principles and the concomitant dilemmas in the process. Based on an interpretative methodology, the findings of this research indicate that (a) despite some positive changes, serious doubts remain over the commercialization of basic public services; (b) confusions have emerged regarding the identity of public hospitals; (c) despite the introduction of the business management principles, the centralized hierarchical power of the state over the local governmental hospitals remains intact; (d) the new system has degraded the professional standards of medical practitioners and made them subservient to the whims of the financial management professionals; and (e) there have been some negative effects on equity.  相似文献

Undergraduate community psychology courses can empower students to address challenging problems in their local communities. Creating a logic model is an experiential way to learn course concepts by “doing.” Throughout the semester, students work with peers to define a problem, develop an intervention, and plan an evaluation focused on an issue of concern to them. This report provides an overview of how to organize a community psychology course around the creation of a logic model in order for students to develop this applied skill. Two undergraduate student authors report on their experience with the logic model assignment, describing the community problem they chose to address, what they learned from the assignment, what they found challenging, and what they are doing now in their communities based on what they learned.  相似文献

The daunting global challenges saddling polities and governments alike have resultantly created a situation whereby governments and corporate civil society have inadvertently reneged on delivering public good and services to citizens. In ensuring and strengthening a public–private actor synergy, with particular emphasis on leveraging acquired knowledge and skills of diaspora‐based students, social entrepreneurship activities could be harnessed to provide sustainable remedies to social challenges such as unemployment, famine amongst others by utilizing social entrepreneurship as a tool. Using the theory of planned behaviour as a theoretical framework, the study elicited data from 322 respondents to empirically investigate determinants of social entrepreneurship intentions of Ghanaian students, with the moderating role of institutional support. Study results revealed that sense of social responsibility and service learning have significant relationship with social entrepreneurship intention. However, social volunteering experience had no significant relationship. Moreover, whereas attitude to social entrepreneurship intention demonstrated a positive relationship, institutional support as a moderator was also revealed to influence the relationship between attitude and social entrepreneurship intention. From the study findings, we discourse on the implications for social entrepreneurship in Ghana to policy makers and stakeholders.  相似文献

The purpose of this article is to discuss and apply data protection principles in the context of employment. The Personal Data Protection Act (PDPA), passed by the Malaysian Parliament in 2010, has affected many aspects of life in Malaysia, including employment. Storage of data by employers is rampant. Management, as the data user, is duty bound to safeguard the employees' data according to the PDPA. Likewise, the employees, as data subjects, enjoy some rights under the PDPA. The author also examines issues of privacy law: whether such law exists in Malaysia and, if so, whether it can be reconciled with the PDPA's principles. The author adopts legal methodology anchored in exploratory analysis, with the legislative text as the main reference point.  相似文献

The present study examines the impactof televised U.S. Senate sessions (byC-SPAN2) on turnover rates in the U.S.Senate over the period 1946–1998. Using atheoretical model wherein politicalservices are viewed as search/experiencegoods, it is argued that there are manyparliamentary procedures available to U.S.Senators (e.g., filibustering, SpecialOrder Speeches, etc.) that serve them aslow-cost forms of persuasive advertising. These outlets provide opportunities forpolitical ``grandstanding'' on popular issueswhich challengers would have to spend largesums of money to combat and/or replicate. Freedom of association for trade union has been generally accepted as part of basic human rights in Islam. Freedom of association, which include the right to join and participate in trade union activities, can be susceptible to disputes between employers and employees as well as trade unions. Islam provides freedom of association in labour relations and also mechanisms to settle disputes pertaining to such freedom. Conciliation (sulh) and arbitration (tahkim) are both used methods in the inception of Islam, which have similarities with the modern sense. We shall discuss in this article the right to dispute resolution between employers and trade unions in the context of freedom of association in labour relations as based on Shari’ah law and using modern legal systems of Islamic countries such as Iran, Malaysia and Saudi Arabia as examples.  相似文献
