The conflicting outcome of the electoral and popular votes inthe 2000 presidential election provoked calls to abolish oralter the electoral college. One prominent criticism is thatthe institution distorts election outcomes by providing disproportionateinfluence to small states. If each state receives a number ofpresidential electors equal to that states' number of membersin the U.S. House of Representatives plus the two senators,then the "federalism bonus" represents the two electoral collegevotes that correspond to the position of each state as an equalentity in the Senate. This research examines how the "federalismbonus" influences presidential selection by addressing threequestions. First, why did the framers include a federal componentin the electoral college? Second, under what circumstances hasthe "federalism bonus" played a role in presidential selection?Third, how would the various alternatives for reform affectthe federal component of the electoral college, and what isthe likelihood of adoption for each?  相似文献

Brief case histories involving incest were presented to police officers, child welfare workers, and community mental health practitioners in a rural area in Canada. Intervention priorities involving “treatment versus punishment” were assessed across the three professional groups for each specific case vignette. Attitudes were assessed on three factors: perpetrator mentally ill rather than criminal, view regarding treatment of victims and mothers, and support for court mandated treatment. Police and community mental health practitioners had significantly different attitudes as to whether perpetrators of child sexual abuse should be viewed more as criminals or as mentally disturbed. Both mental health and child welfare staff differed significantly from police with a less punitive view towards victims and their mothers. All three profressional groups showed no difference in their modest endorsement of the use of mandated treatment by the courts. Gender was not found to influence response to case vignettes.  相似文献

Saliva stains present a unique challenge in the forensic setting, often challenging the analyst to weigh the value of presumptive indication of the fluid versus the potential for DNA analysis to yield identification information. There are many situations in which determining the presence of a body fluid is probative and further corroborates DNA evidence. That said, even a minute portion of sample consumed by a screening test could mean the difference between a full, partial, or null profile obtained through DNA analysis. The basis of presumptive testing or screening of saliva has historically been based on the presence of amylase, a component found in relatively high concentrations in human saliva versus other body fluids and substances. Though the current available methods for the screening of saliva in a forensic application have grown in number, the popularity of these methods seemingly has not. This study attempts to identify a specific and sensitive saliva screening test by comparing three modern techniques--the recently released SALIgAE, Phadebas, and starch-iodine mini-centrifuge test--on the basis of sensitivity, specificity, mixtures, and simulated casework samples while also considering sample consumption. The Phadebas method for presumptive saliva testing detected dilutions of neat saliva down to 1:200 versus considerably less sensitive results with SALIgAE and the starch-iodine mini-centrifuge test. Utilizing a screening test with a high degree of sensitivity, such as Phadebas, allows an analyst to gain a maximum amount of information in the form of body fluid indication and DNA results because of the consumption of a small portion of sample.  相似文献

Parental alienation (PA) is a highly consequential family dynamic that causes harm to children and parents. While many mental health and legal professionals agree that PA is common and potentially very harmful to children, there is still the appearance that there is controversy and discord in the field. The purpose of this study was to test the extent of consensus in the field regarding the basic tenets of PA theory. Specifically, 11 key terms related to PA were identified through expert input and preliminary field-testing. An on-line survey was created specifically for the study to assess level of agreement with these key terms among custody evaluators. This profession was selected because of their high degree of training and experience with a variety of family conflict situations; 119 child custody evaluators selected as members of a professional custody evaluator listing (88% response rate) rated their endorsement of these 11 key definitions with response options including: strongly agree, agree, neither agree nor disagree, disagree, and strongly disagree. Results revealed that roughly 80% of respondents agreed or strongly agreed with each of the 11 definitions. These results demonstrate a high degree of consensus and should guide future trainings of legal and mental health professionals to ensure a common language and understanding of this phenomenon.  相似文献

This paper examines the economic costs and benefits of incarceration of criminals, elaborating upon and correcting flaws in Zedlewski’s 1987 claims that incarceration is a cost-minimizing crime prevention strategy. We use Bureau of Justice Statistics data to demonstrate gross errors in Zedlewski’s crude estimates. We find that the costs of incarceration are more than double the benefits in costs of crime avoided. We conclude that the cost-saving incapacitation effects of incarceration do not warrant either the current levels of imprisonment or any future increases.  相似文献

Recent analyses of workplace organization have stressed that the self-identify of workers constitutes a key resource in new regimes of accumulation. Morever, this significance of self-identify has been understood to form part of an aestheticization of work since the techniques involved in the performance of identity are widely conceived as aesthetic or cultural practices. However, in this article we suggest that in these assumptions the questions of a person's relation to self-identity and of how the labour or work of identity may contribute to the political organization of production remain hidden. Through looking not just at the kinds of self-identity available to and performed by workers but also at the terms and conditions of their performance. We show that a person's self-identity is a key site of conditions of their performance, we show that per' self-identity is a key site of contestation in the struggle that maps out production. In particular, and through a focus on issues of gender and the body, we illustrate the ways in which workers may be denied authorship of their identities and the ability to claim their identity performances as occupational resources. Our analysis indicates that self-possessing workers with performable identities should not be universalized by theorists of the economic and, moreover, that considerations of the aestheticization of work need to be sensitive to what we term socio-cultural regimes of accumulation in which the implications of particular processes of aestheticization for the relation between self and identity and of both to production are explored rather than assumed.  相似文献

A growing recognition that the cost of transportation should be included in calculations of housing affordability has led to efforts to promote location efficiency (LE) in affordable housing policy. Because the program is responsible for most new affordable housing in the United States, the Low Income Housing Tax Credit (LIHTC) program has the potential to be a link between housing affordability and LE. This research analyzes the extent to which LIHTC units built between 2007 and 2011 were in location-efficient places. Ordinary least squares regression analysis was used to test the role of market, policy, developer, and urban form factors in determining state-level LIHTC LE. We find that for the nation as a whole, from a quarter to half of LIHTC units added during this period were in location-efficient places, depending on the LE criteria applied. State-by-state comparisons showed wide variation in both our absolute measures of LIHTC LE and our relative measures of LIHTC LE compared with overall housing in each state. State policy and nonprofit developers were associated with higher LIHTC LE and had a positive effect on a state’s ability to outperform its underlying urban form.  相似文献
