New relaxed regulatory regime for private international charities: the Manx Private Charitable Foundation

The Manx Private Charitable Foundation has become a highly attractivevehicle for private charitable arrangements following on a changein the regulatory legislation in the Isle of Man in 2008, especiallywhere there is no UK inheritance tax or US estate and gift taxissues for donors. In the Isle of Man which has its own unique legal system, since1986 non-local charities have been almost impossible to establish,consequent upon the passing of the Charities Registration Act1986. However, with the adoption of the Charities (Exemption)Regulation 2008 that has now changed. Manx law has followed English law in the past. Orchestrating peace in South Sudan: exploring the effectiveness of the European Union’s mediation support

ABSTRACT

Previous research has primarily focused on the EU’s high-profile involvement as direct mediator in peace negotiations. Conversely, less attention has been devoted to the EU’s support to third parties’ mediation efforts, which is a significant component of its mediation activities. Addressing this research gap, this article develops a conceptual framework for the systematic analysis of EU mediation support, identifying key mediation support techniques and the conditions for their success. In terms of mediation support techniques, the EU may rely on “endorsement”, “coordination”, “assistance”, and “lending leverage” to empower and steer third party mediators in line with its mediation objectives and values. We illustrate the utility of the conceptual framework for the EU’s support to IGAD in mediating in South Sudan’s civil war. We find that the EU has contributed significantly to IGAD’s empowerment in terms of endorsement, coordination, assistance, and lending leverage. Simultaneously, our analysis also points to important challenges in the EU-IGAD relationship, which relate to challenges concerning strategic engagement with IGAD’s internal politics that are marked by diverging interests and ties of its member states to the conflict parties.     

Populism and the politics of misinformation

ABSTRACT

The proliferation of fake news and of conspiracy theories has coincided with the emergence of the digital media. Although the extensive distribution of misinformation is nothing new, the emergence of online media proved to be especially fertile for conspiratorial populists in transmitting distorted information. Since 2016, conspiracy theories, disguised as news, have spread like a snowstorm across the political scene on both sides of the Atlantic. As I discuss in this paper, this climate has enabled conspiratorial populists to be especially successful in spreading suspicion of established knowledge, which they claim to have been produced by the elite and which is eschewed for its association with the powerful. Alongside the diminished gatekeeping capabilities of the mainstream media, it thus becomes ever more difficult for people to distinguish between factual stories and fictitious news often spread via unscrupulous websites, as both can be presented in the same guise.     

Co-existing logics of change: The case of the Danish associational development championships

This article addresses modernization processes within the voluntary sector. It examines how volunteer-based sports associations (VSAs) are encouraged to work with their own self-development, when they participate in the Danish Associational Development Championships (DADC). Drawing on Foucault’s concepts of ‘governmentality’ and ‘dispositive’, the article shows how the governmental rationality of the DADC is pieced together by a number of different logics of change. This makes it ambiguous what the function of VSAs is, who they function for, and why they need to change. The article thus advances our knowledge of the socio-political nature of modernization strategies and techniques.     

Attempted Drug‐facilitated Sexual Assault—Xylazine Intoxication in a Child

There are only a few cases of drug‐facilitated sexual assaults on children reported in the literature so far. Here, a case of a four‐year‐old boy is presented. He was unconscious, and the accompanying adults reported that the child had been at a playground on his own. Returning home, he complained of having been stung and collapsed immediately. Urine and serum samples of the child were investigated. In the toxicological analysis, xylazine, a sedative and muscle relaxant used in animals, was detected. Subsequent quantification by GC/MS after solid‐phase extraction revealed 0.053 mg/L xylazine in serum and approximately 0.63 mg/L in urine. Furthermore, the child was examined by a forensic medical specialist. Police investigations revealed that the godfather, who had been previously accused of sexual abuse of children, had injected the child with the drug, possibly in preparation for a shared bath.     

Forty-five revolutions per minute: a qualitative study of Hybrid Order use in forensic psychiatric practice

Psychiatrists who recommend a Hybrid Order (Section 45A) as a disposal option at the point of sentencing accept that the convicted individual, as well as being mentally disordered and in need of treatment, is also culpable and deserving of criminal punishment. Ethical and clinical concerns have typically limited its clinical use. However, in 2015 the Court of Appeal specified in R v Vowles and others that the Hybrid Order disposal should be considered first in terms of potential mental health disposals. This judgement sets a high threshold for the use of the hospital order which has been the bedrock of inpatient forensic psychiatric practice since 1983. This study sought to explore the attitudes of consultant forensic psychiatrists towards the use of the Hybrid Order in the wake of the Vowles judgement. We interviewed 12 consultant forensic psychiatrists with longstanding experience of psychiatric sentencing recommendations. We found that the majority of consultants considered the Hybrid Order to be a valuable disposal option when used under specific circumstances. However, significant concerns were raised about its use in those with an enduring psychotic illness. Community aftercare arrangements for Hybrid Order disposals were viewed as inferior to community aftercare arrangements for Section 37/41 patients.
